ZBA Minutes of 10/5/94 Meeting
Dr. Laband opened the Public Hearing on the request of Richard R.
Boyle for a Special Permit to construct four self-storage buildings
and associated grading and utility work in a Watershed Protection
District under §14.3, page 14-1 of the Zoning Ordinance on Lots B
& con Easthampton Road (Route 10).
Present and sitting on the case were: Chairman Peter Laband,
Member M. Sanford Weil, Jr., and Associate Member Elaine Reall.
Dr. Laband reviewed procedures for conducting Public Hearings and
noted that a public notice had been published in the Daily
Hampshire Gazette on September 21, and September 28, 1994. Laband
noted that the Planning Board had reviewed the request and voted
unanimously 6:0 to recommend that the ZBA grant approval of the
Special Permit since it met the criteria as outlined under §14.3,
page 14-1 and §10.10 of the Zoning Ordinance.
Glenn Ofcarcik from NKA Consultants was present on behalf of the
applicant. Ofcarcik reviewed the site plan and the Order of
Conditions which had been granted by the Conservation Commission.
He noted that the construction would be on slabs with no basement
and no floor drains.
Chairman Laband reviewed Special Permit criteria under §14.3, page
14-1 of the Zoning Ordinance and found that the criteria had been
met. He further noted that §14.5 does not apply in this case since
there is no 100-year flood plain on the property and §14.6 was not
applicable since there will be no water, sewage, or basements on
the property.
No one spoke in favor or in opposition to the proposal.
M. Sanford Weil, Jr. moved to close the Public Hearing.

Board found:
1. The requested use for total square footage construction in
excess of 5,000 square feet requires a Special Permit under
§10.11 of the Zoning Ordinance.
2. The requested use bears a positive relationship to public
convenience or welfare by providing additional storage
facilities.
3. The requested use will not create undue traffic congestion or
unduly impair pedestrian safety because the increase in
traffic to the site will be negligible according to the
traffic study conducted by the Pioneer Valley Planning
Commission. submitted with the application.

will be no employees on the site, and no public water or sewer
facilities will be provided.
5. The requested use meets all special regulations set forth in

character of the district or adjoining zones, will not be
detrimental to the health, morals, or general welfare, and is

199411 as no waivers were requested.

At 8:55 p.m. Chair Crystal opened the Public Hearing on the request
of Richard R. Boyle for a site Plan Special Permit under §10.11,
page 10-6 of the Zoning Ordinance to allow construction of four (4)
self-storage buildings, associated grading and utility work on Lots
B & con Easthampton Road (Route 10). Crystal read a copy of the
legal notice which was published in the Daily Hampshire Gazette on
September 29, 1994 and October 6, 1994. Crystal reviewed
procedures for conducting a public Hearing.
Glenn Ofcarcik, from NKA Consultants, was present on behalf of Mr.
Boyle. He reviewed the site plan and said that an Order of
Conditions had been issued by the Conservation Commission for work
on the site and that the ZBA had issued a Special Permit.
Additionally he noted that the applicant already had a Special
Permit for this property for another use which was a much more
intensive use than the one proposed for self-storage buildings.
Ofcarcik said there would be no human habitation on the site, and
thus there will be no sewer or water. There will be a single
access driveway off Route 10. The site is completely closed at all
times with renters gaining access by a "keyed" gate. Ofcarcik
reviewed drainage plans, and said that the area around the site is
heavily vegetated and will remain that way. There will be a
security fence around the site to prevent entrance.
Joseph Beauregard asked about signage. Ofcarcik said the applicant
has proposed one sign and the State D.E.P. is fighting about the
location of the sign. The applicant would like the sign visible
from the road.
No one spoke in favor or in opposition to the plan.
Nancy Duseau, a site inspector, said she had no problem with the
plan. Kenneth Jodrie said he had visited the site and found no
problems as long as there is adequate screening, which he thought
was there already.
A memo was received from the DPW which stated that the project
requires a driveway permit from the Massachusetts Highway
Department. Andrew Crystal questioned whether there was access for
Fire Department equipment on the site. Ofcarcik explained that
there was adequate space and methods available for emergency
equipment, to access the site.
Paulette Kuzdeba reviewed the old permit conditions. Andrew
Crystal said it might be appropriate to note that if the Highway
Department does not approve the sign location, then the Planning
Board should approve the alternative sign location, and that the
Board should reference the Conservation Commission's Order of
Conditions in any approval of a Special Permit for this location.
Joseph Beauregard moved to close the Public Hearing. Nancy Duseau

DECISION OF
NORTHAMPTON PLANNING BOARD
At a meeting held on September 12, 1991, the Planning
Board of the City of Northampton voted unanimously to GRANT
the request of Richard R. Boyle for a Special Permit/Site
Plan Approval for a major project under the Provisions of
Section 10.11 of the Northampton Zoning Ordinance to allow
the construction of a 6,000 square foot "Business Service and
Supply Service" . building on a three acre parcel on
Easthampton Road, specifically, Parcels 14 and 15 of Sheet 51
of the Northampton Assessors' maps. Present and voting were
Chairman J. Beauregard, N. Duseau, A. Crystal, w. Larkin, D.
Welter, M. Mendelson, B. Riddle, and J. Hale.
The findings were:
1. The Board found that all the criteria of Sections
10.11(4) and 10.11(5) have been met.
The following conditions apply:
1. The requirements of the Northampton Conservation
Commission's Order of Conditions #246-237 must be adhered to.
2. There must be a sidewalk extending from the edge of Route
10 to the ramp access to the building, and the sidewalk must
be at least as wide as the minimum width required by the
Commonwealth of Massachusetts for handicapped access.
3. The drainage calculations contained in the twelve page
document entitled, "Runoff Curve Number computation"
submitted on behalf of the applicant, and the drainage
calculation summary in the cover letter addressed to Wayne
Feiden, must be documented and certified by a Registered
Professional Engineer.
4. Any change in use from the non-retail uses proposed, any
enlargement of the building, and any use that leads to an
increase in traffic over the level indicated in the plan.

Item S -Project Description
Construction of four (4) self-storage buildings, associated
grading and utility work on Lots B & Con Easthampton Road (Route
10). The Wetland Boundary was delineated by Kevin Richardson as
part of the original Notice of Intent, and the lines were reviewed
again in 1992 as part of the amended Notice of Intent process.
The proposed work falls within the 100' Buffer Zone of a Bordering
Vegetated Wetland. No work is proposed within any resource area.
The Limit of Work line will be permanently marked along most of
its length by a chain link security fence. The following work
will take place within the 100' Buffer Zone:
-install Limit of Work markers for haybales
-staking and installation of haybales and silt fence
-clear, stump and strip topsoil of building area and driveway
-set construction stakes
-excavation for building foundations
-excavation of utility trenches
-construction of buildings and utility installation
-grading and paving of driveways
-grading and construction of drainage swales
-installation of chain link security fence
-grading, seeding and stabilizing of disturbed areas
A grass swale is proposed along the southeast and southwest side

This letter is to help clarify some technical performance
standards for this design.
The proposed buildings are self storage units. Traffic egress and
entrance are provided by the 16' driveway. There are no curb cuts
within 100' of the site. A turning area is provided immediately
outside the security gate to allow any unauthorized vehicles to
turn around rather than backing onto Route 10. The 40' drive
immediately inside the gate is provided to allow large trucks to
maneuver within the site.
Within 800' of the driveway entrance there are other secondary
roads which can minimize the impact on Route 10. Lovefield Street
to the north, O'Neil Street and Lyman Street to the south are
alternatives the traffic may utilize. Due to the varying times of
trips, the impact on Route 10 will be minimal and not decrease its
level of service. From a traffic study by Champagne Associates on
June 1, 1987, directional orientation of traffic associated with a
proposed site on the corner of O'Neil Street and Route 10 is as
follows:
-10% of the traffic oriented to and from O'Neil Street and
points to the east.
-60% of the traffic oriented to and from the north on
Route 10.
-30% of the traffic oriented to and from the south on
Route 10.
The ADT (average daily traffic count) created by the site is
estimated to be 50 trips. Due to the nature of the businesses,
vehicle traffic would be dispersed throughout the day.
Information on the existing and proposed traffic volume was
compiled from the January 1991, Route 10 corridor study by the
Pioneer Valley Planning Commission. Copies of the pertinent
information are included for reference.
An ADT was taken at the Northampton/Easthampton Town Line (13,692
ADT). New trip generations were calculated from the table
provided from the Institute for Transportation Engineers, Trip
Generation. The use of the proposed building is "warehousing"
category.
We approximated the average weekday vehicle trips to equal 4.9 per
1000 square feet (50 trips/day). This calculated to less than one
percent (0.37%) increase of the existing volume of traffic on
Route 10.
The pavement width upon entering the site is 16'; after entry past
the security gate, the pavement widens to 30' for entering and
exiting storage spaces. There are no employees at the site,
therefore no parking spaces are provided. Main circulation
driveways are 30' wide to allow cars parking and travel lanes.
One curb cut is being requested on Route IO/Easthampton Road with
a 16' drive (50' throat width). A guard rail is provided on both
sides of the access drive.
Each catch basin and drop inlet will be constructed with a 3' sump
and an elbow for oil/water separation.
Thirteen trees and five shrubs are planned for the site. The site
presently contains many trees and selective cutting will be used
to protect the natural setting that exists.

There were two ADT's in Northampton, one at
the beginning of the corridor (19,282 ADT) and

(13,692 ADT) . It was assumed that most of the
traffic at the beginning of the corridor was
diverted into the Urban Residential district.
As a result an additional ten percent (10%) of
the town line ADT was calculated as the ADT
for the General Industrial District and the
Business Park District.
The ADT at the Northampton/Easthampton town
line (13,692) was used as the ADT for the
Industrial district in Easthampton.
For the General Business district in
Easthampton, the ADT was calculated as the
average of the ADT Is taken at the
Northampton/Easthampton town line (13,692) and
at Florence Road (17,616).
Column 5: New Number of New Trips Generated was
derived as follows:
Step 1: Trip generation rates for business types along
Route 10 were calculated.
The information in Table 8 was taken from the TRIP
GENERATION MANUAL by the Institute of Transportation
Engineers. Studies conducted show the average number of
trips that each type of business generates per day. A
sampling of high, medium and low traffic generators was
used and the number of trips per day calculated.

Step 2: The gross number of trips expected to be
generated under each build-out scenario was calculated.

General Conditions ~
1 . Failure to comply with all conditions stated herein, and with aJJ related statutes and other regulatory meas-
ures, shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges: it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal. state or local statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act: or
(b) the time for completion has been extended to a specified date more than three years, but less than
five years. from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority tor one or more periods of up to three years each
upon application to the issuing authority at lea.st 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. containing no trash. refuse, rubbish or de-
bris. including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators. motor vehides or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or. if
such an appeal has been filed. until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the uuid
Court for the district in which the land is located, within the chain of title of the affected property. In the
case of recorded land. the F'1r1al Order shall also be noted in the Registry's Granter Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land, the
Final Order shall also be noted on the uuid Court Certificate of Title of the owner of the land upon which
the proposed work is to be done. The recording information shall be submitted to the Commission
on the form at the end of this Order prior to commencement of the work.
9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size
bearing the words, "Massachusetts Department of Environmental Quality Engineering,

10. Where the Department of Environmental Quality Engineering is requested to make a determination and
to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings
and hearings before the Department.
11 . Upon completion of the work described herein, the applicant shall forthwith request in writing that a
Certificate ot Compliance be issued stating that the work has been satisfactorily completed.

1) Kevin Richardson or other wetlands consultant approved by the
Conservation Commission must be on site during all work on the
access road between South Street and the parking lot and must
supervise the work and mitigating measures.
2) Wetlands must be flagged clearly before any work begins on the
project and the wetland flags must remain up during the entire
project.
3) All erosion control devices, including the entire hay bale
line shown in the plans, m~st be installed before any other work
is done on the site, including tree cutting. Once any construction
begins, including tree cutting, all erosion control devices must
be maintained in proper working order until the project is complete
and the Commission has issued a Certificate of Compliance. No work
shall occur beyond the hay bale line shown on the plans.
4) No hazardous materials shall be used or stored within the 100
foot buffer and 310 CMR 30 must be complied with for all work on
the site and building. The on-site sewage disposal (septic) system
shall be used for domestic wastewater only and not for any
industrial or hazardous materials.
5) Floor drains are not included in the design and are not
permitted with this order. If floor drains are added an amended
order will be required.
6) No maintained lawn is permitted within the buffer zone more
than 20 feet from the approved driveway, parking lot, septic
system, or building. No chemical treatment of the lawn is allowed
anywhere on the site. Disturbed soil beyond 20 feet from the
driveway, parking lot, septic system or building may be seeded to
stabilize the area. This area may be planted with shrubs or
natural vegetation can be allowed to reestablish itself.
7) The crushed stone/traprock basins at the end of each drain
line shall be 12 feet long (rather than 6 feet as shown on the
plans) but shall otherwise be the same dimensions as shown on the
plans.

SUBJECT: Proposed traffic generation
RE: Easthampton Road

Information on the existing and proposed traffic volume was
compiled from the January 1991, Route 10 corridor study by
the Pioneer Valley Planning Commission. Copies of the
pertinent information are included for reference.
An average daily traffic count (ADT) was taken at the
Northampton/Easthampton Town Line (13,692 ADT). New trip
generations were calculated from the table provided from the
Institute for Transportation Engineers, Trip Generation. The
use of the proposed building best fit under a combination
of the business park and warehousing categories since each
space will house an office with warehousing for parts and
supplies.
We approximated the average weekday vehicle trips to equal
8.0 per 1000 square feet (48 trips/day). This calculated to
less than one percent (0.35%) increase of the existing volume
of traffic on Route 10.

district is 15/24 while in the General
Business district it is 11/26.

various locations along the corridor.
Estimates of average daily traffic were
calculated for each district.
There were two ADT's in Northampton, one at
the beginning of the corridor (19,282 ADT) and
one at the Northampton/ Easthampton town line
(13,692 ADT). It was assumed that most of the
traffic at the beginning of the corridor was
diverted into the Urban Residential district.
As a result an additional ten percent (10%) of
the town line ADT was calculated as the ADT
for the General Industrial District and the
Business Park District.
The ADT at the Northampton/Easthampton town
line (13,692) was used as the ADT for the
Industrial district in Easthampton.
For the General Business district in
Easthampton, the ADT was calculated as the
average of the ADT's taken at the
Northampton/Easthampton town line (13,692) and
at Florence Road (17,616).
Column 5: New Number of New Trips Generated was
derived as follows:
Step 1: Trip generation rates for business types along
Route 10 were calculated.
The information in Table 8 was taken from the TRIP
GENERATION MANUAL by the Institute of Transportation
Engineers. Studies conducted show the average number of
trips that each type of business generates per day. A
sampling of high, medium and low traffic generators was
used and the number of trips per day calculated.
A trip is defined as one vehicular movement to or from a
destination. For example, a vehicle driving to a
business and leaving the business is two trips.
Step 2: The gross number of trips expected to be
generated under each build-out scenario was calculated.
This gross number was derived by multiplying the average
