Dear Mr . Sienkiewicz :
I refer you to my prior correspondence dated October 1 ,
1990 which I am attaching to this letter . I would also
refer you to a letter dated November 29 , 1989 that I sent to
Alan Verson. I also append to this a copy of a Complaint
filed by my tenant , Eugene Borowski on November 21, 1989 .
This letter is a request for enforcement of the Zoning
Ordinances and the Building Code of the City of Northampton
with respect to the propert owned by Alan Verson at 100 King
Street , Northampton, Massachusetts . This is a request for
enforcement of the Zoning Ordinances pursuant to the
provisions of Massachusetts General Laws , Chapter 40A, Section
7 .
I have been unable to reach an agreement with Alan Verson
with respect to this issue . I believe that Alan Verson ' s
position is that he did not have to comply with the site
plan that he submitted at the time that he constructed the
building. My contention is that the site plan must have been
complied with . Further , the spirit and intent of the
special permit was granted to him was that no impervious
material be placed in his parking area which would cause
runoff to flood my property.
I would appreciate it if you would take action on this
matter by way of requiring an alteration of this parking
area within fourteen days of receipt of this letter .

The parking area in the_s_ear._has been eltvated and the topographical features proposed
have been changed such that water from 100 King Street flows onto the rear of 110 King
Street which has caused damage by way of flooding to the basement area of 110 King Street.
The Complaintants contend that the construction does not comply with the Special Permit
granted nor with this site plan presented and is in violation of the State Building Code.

When I moved into my basement office I never had any water problems. Recently, my
basement office was flodded, the rug was ruined, walls were damaged and I sustained
other financial loss.
I believe that the building being constructed by Man Verson and the grading that was
done to his parking area casued the flooding of my basement office. I believe that the
parking area has not been constructed according to the site plan filed by Alan Verson
for this project.
