HARDSHIP: CONDITION OF APPROVAL: 1) Parking shall not be located closer to Prince Street than where it is shown on the plans. 2.)The proposed chain link fence shall only have slats(if desired)on the western side of the property abutting the loading dock area and not along the east side of the site. 3.)Snow storage shall be in locations indicated on the plans,in the parking lot,or removed off-site. 4.)Four additional shade trees shall be planted on the south side of the building in a location approved by the Office of Planning and Development to create additional buffer,unless Office of Planning& Development finds that such planting conflicts with green building elements that are critical for the function of the building to meet the proposed LEED standard. 5.)As offered by the applicant,two parking lot pole lights per lot may remain on after 10 p.m.unless the Planning Board approves otherwise. Lights within 20'of the perimeter of the building may also remain on after 10 p.m. 6.)Prior to a certificate of occupancy, the applicant must submit stamped engineering plans indicating that the light levels meet the levels shown on the plans approved by the Planning Board. 7.)Six months after the certificate of occupancy,the applicant shall submit a statement from a sound engineer to the Office of Planning and Development indicating that sound levels within the loading dock area conform to Chapter 350-12 of Northampton Code of Ordinances. Kollmorgen Electro-Optical Landscape Maintenance Plan,by Carol R.Johnson Associates,inc.dated June 11, 2009. In granting approval the Board found the following criteria in Chapter 350-11.1 had been met. 1)The requested use protects adjoining premises against seriously detrimental uses. This use is allowed within the Planned Village district and specifically called out in the master plan for redevelopment as well as the special permit granted for the redevelopment of the site. Sound and sight buffers are provided along the western edge of the site that abuts the URB district with some residential uses (2)The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets,minimize traffic impacts on the streets and roads in the area. The redevelopment of the site will utilize two existing curb cuts from Prince Street. The main entry is slightly narrower than the previously planned street width in order to be aligned with Village Hill Road and create a focal entry to the site. The service drive will be used primarily for delivery vehicles to the loading dock and uses greater than a 24'wide curb cut. Pedestrian access is created from Prince Street to the main entry door. Covered bicycle storage is provided near the front of the building. As presented,Kollmorgen will institute site specific traffic demand management strategies and • mitigation will also include installation of a traffic signal at Prince and Village Hill Road along with other improvements undertaken by Hospital Hill LLC. (3) The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape,existing buildings and other community assets in the area. The applicant will be protecting specimen trees and landscaping in a 100'deep buffer at the front of the site. One of the parking lots will be constructed utilizing'low impact design standards to infiltrate parking lot run off and recharge rainwater on-site. As stated in the landscape maintenance plan,plantings will be inspected annually in the spring for damage and/or demise. Plants shall be replaced accordingly and within one growing season. (4) The requested use will not overload,and will mitigate adverse impacts'on,the City's resources including the effect on the City's water supply and distribution system,sanitary and storm sewage collection and treatment systems. A stormwater permit has been obtained. All utility improvements are consistent with those identified in the Village Hill buildout analysis. The project will include sustainable building elements that will qualify to be certified by the US Green Building Council under the LEED program. (5)The requested use meets any special regulations set forth in this chapter including section lighting,stormwater management (6) The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of character of the district or adjoining zones,nor be detrimental to the health,morals,or general welfare. The use shall be in harmony with the general purpose and intent of the ordinance. The construction of the facility will enable a local business to expand within the city and result in job retention and growth. (7) If applicable,the requested use will promote City planning objectives to the extent possible and will not adversely affect those objectives,as defined in City master or study plans adopted under MGL c.41,§81C and 81 D. This development represents a significant step forward in developing the commercial aspects of the master plan approved for the redevelopment of the Northampton State Hospital.
