Re: Hazardous Glazing in Stairway
Dear Jim,
During a recent visit to your establishment, I noticed that there are some cracked panes of glass
in the exterior enclosed stairway. Upon further investigation, I observed that none of the glazing in that
stairway is "Safety Rated". Pursuant to 780 CMR (the Massachusetts State Building Code) Chapter
2406.4.7, glazing in stairways that is less than 60" (sixty inches) above the floor is required to be safety
rated. The glazing in that stairway is completely unprotected from floor to ceiling. This is a major safety
violation and liability concern.
Due to this situation, I am ordering that all of the glazing in that stairway be replaced with
glazing that is compliant for use in hazardous locations.
If you are aggrieved by this decision, you have the right to appeal to the Building Code Appeals Board
In accordance with M.G.L chap. 143-100.
