Prior to that change, the lot area requirements only allowed a single dwelling unit. The zoning ordinance did allow a second dwelling unit as an accessory apartment subject to specific restrictions, including a restrictive covenant recorded at the Registry of Deeds. The accessory apartment was created in 2010 and the restrictive covenant was recorded. The 2015 change in the zoning ordinance removes the use restriction on the apartment and the status has changed from a single family house with accessory apartment to a two family dwelling with no zoning restrictions on occupancy. This letter shall serve as notice that the terms of the restrictive covenant (Hampshire County Registry of Deeds Book 10459, Page 156), are removed. The building is classified as a two family dwelling without occupancy restrictions.
