Gonski 78 Ridgewood Terrace Northampton, Ma. 01060 Dear Mr. Gonski: Due to numerous complaints we have received from motorists on both Ridgewood Terrace and Blackberry Lane, our office made an inspection on June 14, 1978 and found that the height of your hedges obstruct visibility at the inter- section of Ridgewood Terrace and Blackberry Lane to the traffic on those streets. This condition violates Section 6.8 of the Zoning Ordinance, which limits the height of hedges to three (3 ) feet in height above the ground line where traffic visibility is endangered. The Ci y of Northampton ZOnill4 Ordinance . section 6.8, Paragraph 10 on Page 6-9 status: "A fence, hedge, wall, sign or other structure or vegetation may be maintained on any lot pr,::•vided that in the front yard area au such utructure ..r vegetation shall be over three (3) feet in height above the adJaceAt ground within five (5) feet of the front lot line unless it can be shown that such vegetation will not restrict visibility in such a way as to hinder the safe entry of a vehicle from any driveway to the street. " As I was riding down the street I noticed that 50% of the properties on the street are in violation of this section and also the assistant building inspector who lives on the same street is in violation. As a practical matter, a large per- centage of the city is in violation. By this letter I am requesting that the order of the Building Inspector be held in abeyance until a hearing can be scheduled between you, the Building Inspector and myself, to determine whether there is a violation. Goneki: In reference to the letter of June 21, 1978 from the Office of William Welch: It is the opinion of this office that The City of Northampton Zoning Ordinance, Paragraph 9, Section 6.8, definitely covers the property at 78 Ridgewood Terrace. This is a corner lot at the intersection of Ridgewood and Blackberry Lane. There is no variance from this paragraph. Paragraph 10 refers to interior lot lines and private driveways. This paragraph has a variance which states, criote, -------"unless it can be shown that such vegetation will not restrict visibility in such a way as to hinder the safe entry of a vehicle from any driveway to the street." As I know you would not intentionally create a hazard that would cause an accident on a public way, I felt I should bring this to your attention. Thank you for your cooperation.
