West Simsbury, CT 06092 Subject: Property at Ridgewood Terrace and Prospect Avenue Zoning Violation Dear Michael & Catherine Katz, I received a complaint from the Department of Public works about property which you are listed as owners of. The complaint(copy attached) states you have hedges or shrubs which impede vision at the intersection of Ridgewood Terrace and Prospect Avenue. I have included with this letter a copy of Northampton Zoning 6.8 section 5. The ordinance states "at np street intersection in any district shall obstruction to vision exceeding three (3) feet in height above the plane established by the intersection of streets be placed or permitted to grow, on any lot within the triangle formed by the lot lines abutting the intersection and line connecting points on these lines at a distance of twenty- five(25) feet from the point of intersection of the lot lines." The hedges cannot exceed a height of 3 feet for twenty five feet in each direction of the intersection. You have 15 days to correct the violation. The penalty for failure to comply is $100 per day for each day violation continues and or court action. Please contact this office upon receipt of this letter with you plans to correct violation. This restriction shall also apply to the intersection of a street and a driveway in a "B" or"I"District. 5. A fence,hedge, wall, sign or other structure or vegetation may be maintained on any lot provided that in the front yard area, no such structure or vegetation shall be over three (3) feet in height above the adjacent ground within five(5) feet of the front lot line unless it can be shown that such vegetation will not restrict visibility in such a way as to hinder the safe entry of a vehicle from any driveway to the street. In Residential Districts, no fence shall exceed a height of 6 1/2 feet (8'when abutting a non-residential District)unless a Special Permit has been received from-the Zoning Board of Appeals.
