This opinion is only for that purpose and may not be relied on by any party for any other purpose. The deed to the Stein's property is located at Book 3042, Page 159 in the Registry of Deeds for Hampshire County ("Registry"). I have researched the Stein's deed as far back as the 1903 conveyance found at Book 571, Page 342 in the Registry, which I believe is the source deed for the Property (-Source Deed"). The northerly call in this Source Deed calls to"by land of these grantors." The Source Deed also refers to a subdivision plan created by the same grantors found at Unindexed Book 561, Page 110 in the Registry. The plan depicts a linear monument running to the North of the Property. This linear monument appears to be either a road or alley way. The Stein's deed description (as well as the Stein's lines of actual use and occupation) runs to a flat, hard-packed, dirt linear object, road, or alley North of the Stein's property, which then slopes down to what is now the bike path. The Property is also shown on Northampton Assessors Map 17C/172. The Assessors Map shows this same linear monument(an alley or road) labeled "UNKNOWN." This "unknown" linear monument runs between Plymouth Avenue and Sumner Avenue, and is approximately fourteen (14) feet in width. Here, the deeds in the Stein's chain of title pass title to real estate abutting a way or other linear monument. In the Source Deed the Grantor did not retain ownership of the linear monument or road. Given this fact, under the Derelict Fee Statute as applied to the Stein's property, it is my opinion that the Steins own, at a minimum, to the centerline of the linear object (7 feet) or road, and may own the entire linear monument or road (14 feet).
