'v1 LECISION OF i ��� (7 ZONING BOARD OF APPEALS n At a meeting held on July 23, 1986, the Zoning Board of Appeals of jl the City of Northampton voted unanimously to rant the Special Permit 111 request of New Pioneer Valley, Inc. , d/b/a Pioneer Valley Nursing Home, { 548 Elm St eet, Northampton, MA, for the purpose of extending the parking area in a southeasterly direction to allow for the construction of 3 3 additional parking spaces at their property located on the northeasterly side of Federal Street, Northampton (URB Zone). Present and voting were: Chairman Robert C. Buscher, William Brandt and Peter Laband. The findings were as follows: W. Brandt, referring to Section 10.13 and then Section 10.10, found that the use is listed in the Table of Use Regulations; that the requested use bears a positive relationship to the public convenience, as the additional parking space will alleviate some of the parking congestion in the immediate and surrounding areas; that the requested use will relieve traffic congestion and improve pedestrian safety; that the requested use will not overload any municipal systems; and that the expansion of parking space will not be detrimental nor impair the character of the zone; (see conditions below in reference to Article XI). P. Laband concurred that all criteria are fulfilled. R. Buscher also concurred with Mr. Brandt's findings. The following conditions shall apply: 1. That if more than 500 c.y. of fill are found to be necessary in the construction of this parking area, an additional Special Permit will be required. 2. That if the proposed parking area is found to be located in a floodplain, an additional Special Permit will be required if more than 50 c.y. of fill are used. . { Robert_ C. Set forth reasons upon which application is based: The use of the property as a nursing home is allowed by a Special Permit issued on 22 May 1973. Under Section 9.2, the Northampton Zoning Ordinance applies to any extension of such a use for the same purpose, but to a substantially greater extent. Section 9.3 allows for the extension of such a use upon a finding by the Special Permit Granting Authority that such extension or alteration shall not be substantially more detrimental than the existing non-contorming use to the neighborhood. 10.
