Re: Your letter dated, April 25, 1985 - alledged violation; Pioneer Valley Nursing Home.
Dear Attorney O'Leary:
Paragraph 1 of your letter implies that there has been an increase in the intensity
of use (beyond that which was allowed by the Special Permit granted to Pioneer Valley
in 1973;) which would make the use subject to Section 9.3 of the Northampton Zoning
Ordinance. The increase in the intensity, you feel, is the result of the establishment
of a head trauma unit and increase in employment.
Addressing the above concern; we agree that there is an increase in the number of
employees which may be related to the establishment of the head unit. However, we can
not justify issuing a cease & desist order against Pioneer Valley; since the present
use continues to reflect the nature of that which was allowed by the special permit;
i.e. the care of convalescent or chronic patients; regardless of their medical classifi-
cation.
Pioneer Valley has agreed to proceed to correct its' parking problem. This office
will require that a special permit be issued by the Zoning Board of Appeals before any
extension of the parking area begins. At that time all abutters will be notified and
will have the opportunity to express their concern.
As to your other concerns (paragraph 3) Pioneer Valley and our office are aware that
the special permit dated April 20, 1983, has expired.
We hope that in correcting the parking situation we aliviate the concerns of your
client.
