NORTHAMPTON ZONING BOARD OF APPEALS
Decision on Application of Lawrence
J. Ruell

The Board of Appeals met in the City Council Chambers at 6 : 00 p.m.
_ 7 1981 _to render a decision on the petition of Lawrence J.
Ruell for a special permit to construct a three-family dwelling
on Warner Street. Present were William Brandt, Acting Chairman,
Marianne Zurn and Peter Laband .
On a motion made and seconded, the minutes of the public hearing
of June 17 , 1981 , were accepted and the reading was waived.
In the discussion of the petition, Mr. Brandt found that the
use requested was listed in the table of Regulations as requiring
a special permit in the district in which the application was
made. He also found that the requested use bears a positive
relationship to the general public welfare and convenience because
it would help solve the city' s housing problem. He found, however ,
that the requested use would not bear a positive relationship to
the neighborhood, and, more specifically, under Section f of
Section 10. 10 of the Northampton Zoning Ordinance , he found that
the requested use will impair the integrity of the zone because
the neighborhood is predominantly one family structures , the
architecture of which would not be compatible with the architec-
ture of the proposed structure.
Mr. Brandt found further that the proposed structure would not
cause undue traffic congestion or unduly impair pedestrian safety
although he expressed a concern that any increase in traffic on
Warner Street might impair pedestrian safety due to the narrow
width of the street. Furthermore , he found that the requested
use would not overload any public water , sewer or other municipal
system. He added,however, that he felt there would be a possibility
of a drainage problem which would have to be addressed if the
special permit were approved. Finally, he found that Section 10 . 10 ..
did not apply.
Dr. Laband found that the use requested is listed in the Table of
Use Regulations and that the use bears a positive relationship to
the general public welfare and convenience because of the need
for housing in the area and of the difficulty of finding rental
housing in the area. Dr. Laband referred to a letter from Peter
McNulty, Superintendent of Highways , stating that the requested
use would not creat any traffic or pedestrian safety problems,
and he concurred with the conclusion of that letter. He found
that Section (e) does not apply and he further found that the
requested use does not unduly impair the integrity or character
of the district and would not be detrimental to the general
welfare. Specifically, he found that the housing units proposed
would be three one-bedroom units; that those units would not
add extra density to the neighborhood because a family with
children could not possibly be accommodated by a small one-bedroom
unit. In addition, Dr. Laband found that the population density
in the area is not excessive and that the area includes many

houses that are two and three family houses.
Ms. Zurn agreed with the specific findings made by Dr. Laband,
and she added that she felt that the need for housing in the
area outweighs the objection of Mr . Brandt that the appearance
of the house does not comport with the neighborhood.
On a motion made and seconded the matter was voted upon. Dr.
Laband and Ms . Zurn voted to grant the petition; Mr. Brandt voted
to deny the petition. The Acting Chairman ruled that the petition
was denied, and on a motion made and seconded the meeting was
adjourned.
