Buscher, Chairman cA— Dr. Peter Laband Wi liam Brandt' , Northampton Zoning Board of Appeals September 13, 1989 Meeting The Northampton Zoning Board of Appeals met on Wednesday, September 13 , 1989 at 7 :00 p. m. in Council Chambers, Wallace J. Puchalski Municipal Building, to conduct a Public Hearing on the Application of Frederick H. and Ruth H. Mailloux for a Special Permit under the Provisions of Section 5 . 2 and 10 . 11 of the Northampton Zoning Ordinance to allow a one-family dwelling at 566 Elm Street be converted to a two-family dwelling, and to obtain site plan approval of the addition. Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and William Brandt. Ch. Buscher opened the Public Hearing by reading the Application, the Legal Notice, a memorandum from the Planning Board, and Sections 5 . 2, 10. 11 and 10. 10 of the Ordinance. Atty. Benjamin Barnes appeared for the Applicant, and put the site plan on the board. The existing dwelling houses Mr. and Mrs. Mailloux and their grown son, in a four-bedroom, 1 1/2 story brick cape. The son is getting married, his parents are getting older, and the idea is to turn the house into two apartments so they can all live together. In addition to internal modifications, a 13 ' x 13 ' room is to be built over the enclosed breezeway. The top of the new construction will be below the level of the gable, and the facade of the house will not change appreciably. Mr. Barnes went through the site plan review criteria one-by-one, and received in every instance approval or a waiver. He then addressed the Special Permit criteria, pointing out that the requested use is listed in the Table of Use Regulations, it bears a positive relationship to the public welfare in that it allows children to live with their aging parents, one additional car will not affect neighborhood traffic or pedestrian safety, no municipal systems will be overloaded, and the use is in harmony with the neighborhood, which consists of seven two-family homes in a 150 yard radius, with a nursing home as a direct abutter. Ch. Buscher called for proponents, and Stephen Mailloux, who is the son mentioned above, spoke to the issue of living with and assisting his parents as they get older. He mentioned also that the one front entrance will serve both apartments. There being no one else present to speak either in favor or in opposition, Dr. Laband moved the Public Hearing be closed, and the matter taken under advisement so the members could make a site visit. Mr. Brandt seconded, and the motion passed unanimously. Also present, in addition to those mentioned, was R. J. Pascucci, Board Secretary. Robert C. Mailloux for a special Permit under the Provisions of Section 5 . 2 and 10 . 11 of the Northampton Zoning Ordinance to allow conversion of a one-family dwelling to a two-family dwelling at 566 Elm Street. Present and voting were Chairman Robert C. Buscher, William Brandt, and Dr. Peter Laband. Dr. Laband moved the minutes of the September 13 meeting be approved without reading. Mr . Brandt seconded, and the motion passed unanimously. Dr. Laband found that the requested use is allowed in this zone by Special Permit under the Provisions of Section 5 . 2 ; the use bears a positive relationship to the public welfare in that it creates an additional unit of housing in the city, and allows the Applicant ' s son and wife to live in the same house with his parents; the addition of a second apartment does not unduly create traffic congestion, nor does it impair pedestrian safety. This will result in the addition of only one more car on the premises ; no municipal systems will be overloaded by the addition of one person; the requested use does not unduly impair the character and integrity of the district, and is in fact very much in harmony with the predominately two-family neighborhood. He added that the Planning Board asked that the additional parking be at the side of the existing garage, but he said, "I don' t necessarily agree. It' s the Applicant ' s preference. " Mr. Brandt said, "I ' ll vote in favor. The use is allowed, there ' s a 20 , 800 SF lot here, substantially more than required in the district; the use bears a positive relationship to the public welfare by creating an additional housing unit without requiring land; there are no traffic or pedestrian issues, nor will any municipal systems be affected; he found the two-family house to be in harmony with the many multi-family dwellings on Elm Street. Ch. Buscher concurred with his colleagues . He found the addition to not be extensive, and felt it would not disfigure the appearance of the home. The property is located on a lot the size of 20,822± square feet, in an URB zone which permits single or multi-unit dwellings. The proposed construction would change the second floor of the single family house into a separqte dwelling unit. It would comply in all respects with the dimensional and density regulations of the Northampton Zoning Ordinance (see site plan attached) . The second dwelling unit would be occupied by Stephen Paul Mailloux, my son. 9. My wife and I are older homemakers who have lived in the present residence for forty years. Now in our seventies, we have raised three children. The youngest, Stephen, has always lived with us. We realize that as time passes, we will rely more on Stephen's assistance, if we are to remain in our home. Stephen has provided us with companionship and security. Stephen is getting married in October.
