CONDITION OF APPROVAL:
1) No site work outside the driveway project limits as shown on the plan shall begin until a stormwater
permit has been issued by Department of Public Works.
2. Prior to issuance of any building permit,the applicant must apply for and receive any special
permits, as necessary for any retail use over 10,0000 square feet,and site plan from the Planning
Board for any proposed use greater than 2,000 square feet and/or any other requirement within the
zoning for special permits and/or site plan approval. The application for such permits must show
cross-access or easement areas for vehicle traffic to flow from abutting properties to the signal. The
application shall also show proposed pedestrian easements across property boundaries and conform
to all aspects of the zoning including those relating to retail establishments over 10,000 sf.
NOTE: Northampton's zoning requires special permit for reuse of existing commercial buildings with
any substantial improvements.
3. Prior to issuance of a building permit, the applicant shall ensure and fully execute easements or
other permanent cross access agreements for abutters to the north and south to access the traffic
signal.
4.The mast arm and signal shall not be installed until Department of Public Works is satisfied that the
warrants can be met with an actual proposed use.
5. Catch basins shall be relocated to the radius of the curves of the newly created intersection.

to the site for pedestrian safety.

FINDINGS:
The Planning Board granted the Site Plan for the creation of a curb cut greater than 24'based on the following plans submitted with the
application. The Planning Board granted the permit based on the applicant's stated request to obtain pre-permit approval for marketing
purposes and did not grant approval for any other aspect of the use of the site relative to the required elements in section 11.1

In granting the permit to construct a driveway curb cut greater than 24'(approximately 67'), the Board found the following applicable
standards for a curb cut width and did not make any findings relative to the use under section 11.6.
Portion of subsection B The requested curb cut will promote the convenience and safety of vehicular and pedestrian movement on
adjacent streets,minimize traffic impacts on the streets and roads in the area. The proposed intersection design would allow separation
of vehicular and pedestrian access for the future build-out of the site,yet to be determined. The intersection design proposed includes a
4-way crosswalk with pedestrian activated crossing that will allow safe pedestrian crossing while all vehicular movement is stopped.
Though the proposed intersection is intended to facilitate traffic movement in the future at the site, the pedestrian access to the west side
of King Street will be enhanced through this design to provide safe access to businesses located there.
A full traffic analysis of proposed uses was not conducted because there are no anticipated users at this time. The Board made no
determination about the status of level of service at the site intersection which must be completed at the time a use is proposed. Any
additional mitigation will be analyzed at such time.
F. Compliance with the following technical performance standards:
(1)Curb cuts onto streets shall be minimized.Access to businesses shall use common driveways, existing side streets, or loop service
roads shared by adjacent lots when possible. More than one curb cut shall be permitted only when necessary to minimize traffic and
safety impacts. Once an end user is determined, the applicant will allow unencumbered cross-access to this intersection and traffic signal
from the abutting properties to the north and south.
(2)This application and permit decision makes no determination about meeting the required pedestrian,bicycle and vehicular traffic
movement on site.
(3)This permit decision makes no finding regarding the criteria in 11.6 F3 that Major projects,except in the Central Business District,
must be designed so there is no increase in peak flows from the one-or two-and ten-year Soil Conservation Service design storm from
predevelopment conditions(the condition at the time a site plan approval is requested)and so that the runoff from a four-to ten-inch rain
storm(first flush)is detained on site for an average of six hours. These requirements shall not apply if the project will discharge into a
City storm drain system that the Planning Board finds can accommodate the expected discharge with no adverse impacts. in addition,
catch basins shall incorporate sumps of a minimum of three feet and,if they will remain privately owned, a gas trap.
