Their request appears to be on land owned by the City's Conservation Commission,with a Restriction held by the Massachusetts Audubon Society. If this is correct, this installation s not permitted. According to DPW records, Ox Bow Road is a farm rod, not a public road or public'right-of- way. Abutters to the road may or may not have some rights to pass on the road, but I am not aware of any record that there is a right-of-way or utility easement. As with any other privately or publicly-held land outside of a street right-of-way, a third-party private party cannot string power lines on someone elsel's property. The City and Massachusetts . Audubon Society jointly purchased the City's property along the Connecticut River Oxbow to keep the area pristine, allow public access to the water, Viand preserve the buffer of the:Oxbow. Power lines crossing a conservation area are inconsistent with these purposes. The property owner may well have other options to bring in power to tlieir property by running a power line to their frontage on Old Springfield Road. If bringing in power is part of any development or renovations, the property owner will clearly need to obtain any additional required permits from the Building Commissioner, the harming Board or Zoning Board, and the Conservation Commission.
