Demolition of and Related Asbestos Remediation at 278 Burts Pit Road
Invitation to bid and instructions to bidders
(See attached invitations published in the Daily Hampshire Gazette, Central Register, CommBuys, and
Northampton posted and web public notice boards)
Proposals for demolition of structures at 278 Burts Pit Road and related asbestos abatement will be
accepted by: Wayne Feiden, Northampton Office of Planning & Sustainability, 210 Main Street (City Hall)
Northampton, MA 01060.
Bids will be accepted until 11:30 AM, July 13, 2021, at which time bids will be opened and read publicly.
Bids must be submitted:
1. On the attached bid forms
2. In a sealed envelope marked Demolition of 278 Burts Pit Road- sealed bid
3. Accompanied by a bid deposit of 5% of the bid amount in the form of a bid bond, or cash, or a
certified check on, or a treasurer’s or cashier’s check issued by, a responsible bank or trust
company, payable to the awarding authority.
4. By a bidder with proof of asbestos removal and any other required licenses for this work.

The estimated project value is $50,000
There is no pre-bid conference. Bidders are welcome to tour the site at 278 Burts Pit Road
This project is subject to the attached schedule of prevailing wage rates.
The City will award this Contract within 30 days of the bid opening. The City reserves the right to reject any
or all bids, to waive any informality, and to accept the bid deemed to be in the best interest of the City. The
successful bidder will be required to furnish a 50% Payment Bonds.

The project shall begin as soon as possible after the contract is awarded and be completed within
120 days of said contract signing.
1. The Contractor shall attend a post-contract, pre-construction conference prior to construction
arranged by the City. At that time, the Contractor shall be expected to present to the City and its
consultants a plan for the execution of every phase of construction.
2. Remediation of Asbestos and proper disposal from the house and garage at 278 Burts Pit Road in
accordance with the Commonwealth’s standards and the attached “278 Burts Pit Road, Northampton,
Massachusetts, Section 02 81 13, Asbestos Abatement” specification. ANY other method of asbestos
MUST be approved by the City’s asbestos consultant.
3. Demolition, removal, and proper disposal of the house and foundation, the garage and foundation, and
the remnants of an outbuilding foundation at 278 Burts Pit Road, including the basement oil tank.
4. Tree removal cutting and removal of trees necessary to perform this work shall be included in this work,
with other trees within the work area protected, in accordance with the tree protection standards herein.
No trees can be cut within the Burts Pit Road right-of-way.
5. Backfill all foundation holes with clean fill, fill ruts and rough grade all disturb areas, seed and mulch and
ensure a cover crop comes up to stabilize the site.
6. Coordination and notice to ensure that the City’s asbestos abatement consultant and environmental
consultant, OTO, can monitor and inspect asbestos abatement work and the oil tank removal with
inspections as established by OTO.
7. Install sufficient erosion control to any impacts beyond the work area shown on the plans.
8. Obtaining any necessary permits:
a. Wetlands permits have been obtained are no new permit is required.
b. Demolition permits (from the Northampton Building Department)- fee waived for city projects.
c. DigSafe approval and City Trench permits- fee waived for city projects
d. All other permits, if any, and compliance with all OSHA (Occupational Safety and Health
Administration) regulations are the contractor’s responsibility.
9. Maintain work hours between (7:00 a.m. and 4:00 pm unless otherwise approved)
10. Arrange and pay for traffic police coverage, IF required, during their operations in accordance with
Northampton Police Department regulations, and keep track of all scheduled hours. The City shall
reimburse all traffic police fees paid by the Contractor. Civilian flaggers are not to be used except by
specific permission and direction from the Police Department.
11. Contacting all utility companies to ensure compliance with all utility cutoff requirements.
12. Provide certificates of insurance prior to any work, naming the City of Northampton as an additional
insured in the following amounts:
Bodily Injury General Liability............... $1,000,000/$2,000,000

Workers Compensation: As required by state law.
General Liability shall include Explosion, Collapse, and Underground (XCU).
There may be no asbestos exceptions to insurance coverage.
Payments
1. Partial Payments: The Contractor shall, once in each month, provide a Pay Application of the work done
to the time of such estimate and the value thereof. The City shall retain five percent (5%) of such estimated
value as part security for the fulfillment. No Pay Application shall be made when, in the judgement of the
City, the work is not proceeding in accordance with the provisions of the contract.
2. Final Payment: The Contractor shall, after the satisfactory completion of the contract, make a Pay
Application for the remainder of the contract and, upon acceptance of the work, pay the final balance and
previous retainage. After the final payment, the Contractor shall retain liability in respect to responsibility
to comply with the bid specifications and regulatory standards and shall remedy any defects in the work as
needed within a one warranty period.

Rejection of Proposals and Disqualification of Bidders
Proposals which fail to meet the requirements herein or which are incomplete, conditional or obscure, or which
contain additions not called for, erasures, alterations or irregularities of any kind, or in which errors occur, or
which contain abnormally high or abnormally low prices for any class or item of work, shall be declared
informal, provided however that the City of Northampton may, if it deems it to be in the public interest, waive
any or all informalities as to form. Informalities as to substance, however, shall not be waived.
More than one Proposal from the same Bidder, whether or not the same or different names appear on the
signature page, will not be considered. Reasonable proof for believing that any Bidder is so interested in more
than one Proposal for the work contemplated will cause the rejection of all Proposals made by them directly or
indirectly. Any Proposals will be rejected if there is reason for believing that collusion exists among the Bidders.
Proposals may also be rejected if
1. Award of the contract would result in the Bidder exceeding the Aggregate Bonding Capacity established
by its Surety Company, or the Bidder’s Proposal exceeds its single project limit, or the Bidder was not
prequalified in the specified class of work on or before the time of bid opening; or
2. The Bidder is presently debarred from performing work of any kind under provision of M.G.L., Chapter
29, Section 29F, or any other applicable debarment provisions of the Massachusetts General Laws or any
rule or regulation promulgated thereunder; or
3. The Bidder is present from performing work of any kind under the laws of any state other than the
Commonwealth of Massachusetts, or by any Federal agency or authority; or
4. There is substantial reason to believe that the condition of the Bidder’s firm is less favorable than at the
time of its last Application for Prequalification; or
5. The Bidder does not have sufficient equipment, or sufficient assets to provide necessary equipment either
through purchase or lease agreements; or
6. The Bidder’s performance on past or current work with the City or other awarding authorities is or has
been unsatisfactory; or
7. On current projects of the City or other public authorities the Bidder frequently fails or has failed to pay
its subcontractors or material suppliers in a timely manner, or that 5 or more subcontractors or material
suppliers of the Contractor for a project currently under construction have filed demands for direct
payments with the project’s awarding authority in accordance with M.G.L. Chapter 30, Section 39F; or
8. The Bidder is not otherwise an eligible and responsible Bidder capable of performing the work.
Bidders whose Proposals have been rejected because of evidence of collusion may be subject to debarment
under applicable provisions of state and federal law.
Tree Protection (from MassDOT Standard Specifications for Highways and Bridges (2020))
ITEM 102.51 TREE PROTECTION – TRUNK PROTECTION
ITEM 102.52 TREE PROTECTION – TEMPORARY FENCE
Tree trunk protection shall consist of furnishing, installing, maintaining and removing tree trunk protection
measures within the project area. Tree trunk protection shall be implemented when Tree Protection
Temporary Fence is not fully implemented or there is need for the Contractor to conduct work within a
fenced Tree Protection Zone. Tree trunk protection shall include wrapping the tree with ¼” closed cell foam
pad first, then installing 1.5-inch thick wooden boards (“2x4” framing lumber) held to the tree with adjustable
strapping. See Plan Details. No fasteners are allowed to penetrate the tree or its bark. All tree protection
measures shall be submitted for approval by the City prior to installation.
Temporary fence shall consist of furnishing, installing, maintaining and removing tree protection temporary
fence measures within the project area. Tree protection shall consist of installation of temporary chain link
fence at locations as shown on plans and details, or as otherwise directed by the City. Where directed by the
City, additional and alternative measures may be required, see specification Items 102.52, 102.53 and 102.54.
No fasteners are allowed to penetrate the tree or its bark. All tree protection measures shall be submitted for
approval by prior to installation,.
The Contractor is responsible for preventing damage to trees from construction activities, whether the tree is
located in the public way, or on private property. Public Shade Trees are subject to the penalty provisions
contained on MGL Chapter 87, which is under the jurisdiction of the City Tree Warden.
All tree protection measures shall comply with ANSI A300 Part 5, and are to be installed prior to the start of
any demolition and/or construction. Said measures shall be maintained by the Contractor for the duration of
the project. Measures indicated on the plans shall be considered a minimum and shall be revised as
conditions warrant. Removal of tree protection measures shall be done after construction is completed and
with the approval of the City.
The contract price under this item shall constitute full payment for all material, labor and equipment required
or incidental to the satisfactory completion of work as described above. Any devices provided under this
section which are lost, stolen, destroyed or deemed unacceptable while their use is required on the project
shall be replaced without additional compensation.

THE COMMONWEALTH OF MASSACHUSETTS
SUPPLEMENTAL EQUAL EMPLOYMENT OPPORTUNITY, NON-DISCRIMINATION
AND AFFIRMATIVE ACTION PROGRAM

I. Definitions
For purposes of this contract,
“Minority” means a person who meets one or more of the following definitions:
(a) American Indian or Native American means: all persons having origins in any of the original
peoples of North America and who are recognized as an Indian by a tribe or tribal
organization.
(b) Asian means: All persons having origins in any of the original peoples of the Far East,
Southeast Asia, the Indian sub-continent, or the Pacific Islands, including, but not limited to
China, Japan, Korea, Samoa, India, and the Philippine Islands.
(c) Black means: All persons having origins in any of the Black racial groups of Africa, including,
but not limited to, African-Americans, and all persons having origins in any of the original
peoples of the Cape Verdean Islands.
(d) Eskimo or Aleut means: All persons having origins in any of the peoples of Northern Canada,
Greenland, Alaska, and Eastern Siberia.
(e) Hispanic means: All persons having their origins in any of the Spanish-speaking peoples of
Mexico, Puerto Rico, Cuba, Central or South America, or the Caribbean Islands.
“State construction contract” means a contract for the construction, reconstruction, installation, demolition,
maintenance or repair of a building or capital facility, or a contract for the construction, reconstruction,
alteration, remodeling or repair of a public work undertaken by a department, agency, board, or commission
of the commonwealth.
“State assisted construction contract” means a contract for the construction, reconstruction, installation,
demolition, maintenance or repair of a building or capital facility undertaken by a political subdivision of the
commonwealth, or two or more political subdivisions thereof, an authority, or other instrumentality and
whose costs of the contract are paid for, reimbursed, grant funded, or otherwise supported, in whole or in
part, by the commonwealth.
II. Equal Opportunity, Non-Discrimination and Affirmative Action
During the performance of this Contract, the Contractor and all subcontractors (hereinafter collectively
referred to as “the Contractor”) for a state construction contract or a state assisted construction contract, for
him/herself, his/her assignees and successors in interest, agree to comply with all applicable equal
employment opportunity, non-discrimination and affirmative action requirements, including but not limited
to the following:
In connection with the performance of work under this contract, the Contractor shall not discriminate against
any employee or applicant for employment because of race, color, religious creed, national origin, sex, sexual
orientation, genetic information, military service, age, ancestry or disability, shall not discriminate in the
selection or retention of subcontractors, and shall not discriminate in the procurement of materials and
rentals of equipment.
The aforesaid provision shall include, but not be limited to, the following: employment upgrading, demotion,
or transfer; recruitment advertising, layoff or termination; rates of pay or other forms of compensation;
conditions or privileges of employment; and selection for apprenticeship or on-the-job training opportunity.
The Contractor shall comply with the provisions of chapter 151B of the Massachusetts General Laws, as
amended, and all other applicable anti-discrimination and equal opportunity laws, all of which are herein
incorporated by reference and made a part of this Contract.
The Contractor shall post hereafter in conspicuous places, available for employees and applicants for
employment, notices to be provided by the Massachusetts Commission Against Discrimination setting forth
the provisions of the Fair Employment Practices Law of the Commonwealth (Massachusetts General Laws
Chapter 151B).
In connection with the performance of work under this contract, the Contractor shall undertake, in good
faith, affirmative action measures to eliminate any discriminatory barriers in the terms and conditions of
employment on the grounds of race, color, religious creed, national origin, sex, sexual orientation, genetic
information, military service, age, ancestry or disability. Such affirmative action measures shall entail positive
and aggressive measures to ensure non-discrimination and to promote equal opportunity in the areas of
hiring, upgrading, demotion or transfer, recruitment, layoff or termination, rate of compensation,
apprenticeship and on-the-job training programs. A list of positive and aggressive measures shall include, but
not be limited to, advertising employment opportunities in minority and other community news media;
notifying minority, women and other community-based organizations of employment opportunities;
validating all job specifications, selection requirements, and tests; maintaining a file of names and addresses of
each worker referred to the Contractor and what action was taken concerning such worker; and notifying the
administering agency in writing when a union with whom the Contractor has a collective bargaining
agreement has failed to refer a minority or woman worker. These and other affirmative action measures shall
include all actions required to guarantee equal employment opportunity for all persons, regardless of race,
color, religious creed, national origin, sex, sexual orientation, genetic information, military service, age,
ancestry or disability. One purpose of this provision is to ensure to the fullest extent possible an adequate
supply of skilled tradesmen for this and future Commonwealth public construction projects.
III. Minority and Women Workforce Participation
Pursuant to his/her obligations under the preceding section, the Contractor shall strive to achieve on this
project the labor participation goals contained herein. Said participation goals shall apply in each job category
on this project including but not limited to bricklayers, carpenters, cement masons, electricians, ironworkers,
operating engineers and those classes of work enumerated in Section 44F of Chapter 149 of the
Massachusetts General Laws. The participation goals for this project shall be 15.3% for minorities and 6.9%
for women. The participation goals, as set forth herein, shall not be construed as quotas or set-asides; rather,
such participation goals will be used to measure the progress of the Commonwealth’s equal opportunity, non-
discrimination and affirmative action program. Additionally, the participation goals contained herein should
not be seen or treated as a floor or as a ceiling for the employment of particular individuals or group of
individuals.
IV. Liaison Committee
At the discretion of the agency that administers the contract for the construction project there may be
established for the life of the contract a body to be known as the Liaison Committee. The Liaison
Committee shall be composed of one representative each from the agency or agencies administering the
contract for the construction project, hereinafter called the administering agency, a representative from the
Office of Affirmative action, and such other representatives as may be designated by the administering
agency.
The Contractor (or his/her agent, if any, designated by him/her as the on-site equal employment opportunity
officer) shall recognize the Liaison Committee as an affirmative action body, and shall establish a continuing
working relationship with the Liaison Committee, consulting with the Liaison Committee on all matters
related to minority recruitment, referral, employment and training.
V. Reports and Records
The Contractor shall prepare projected workforce tables on a quarterly basis when required by the
administering agency. These shall be broken down into projections, by week, of workers required in each
trade. Copies shall be furnished one week in advance of the commencement of the period covered, and also,
when updated, to the administering agency and the Liaison Committee when required.
The Contractor shall prepare weekly reports in a form approved by the administering agency, unless
information required is required to be reported electronically by the administering agency, the number of
hours worked in each trade by each employee, identified as woman, minority, or non-minority. Copies of
these shall be provided at the end of each such week to the administering agency and the Liaison Committee.
Records of employment referral orders, prepared by the Contractor, shall be made available to the
administering agency on request.
The Contractor will provide all information and reports required by the administering agency on instructions
issued by the administering agency and will permit access to its facilities and any books, records, accounts and
other sources of information which may be determined by the administering agency to effect the employment
of personnel. This provision shall apply only to information pertinent to the Commonwealth's
supplementary non-discrimination, equal opportunity and access and opportunity contract requirements.
Where information required is in the exclusive possession of another who fails or refuses to furnish this
information, the Contractor shall so certify to the administering agency and shall set forth what efforts he has
made to obtain the information.
I. Access to Work Site
A designee of the administering agency and a designee of the Liaison Committee shall each have a right to
access the work site.
VII. Solicitations for Subcontracts, and for the Procurement of Materials and Equipment
In all solicitations either by competitive bidding or negotiation made by the Contractor either for work to be
performed under a subcontract or for the procurement of materials or equipment, each potential
subcontractor or supplier shall be notified in writing by the Contractor of the Contractor's obligations under
this contract relative to non-discrimination and equal opportunity.
VIII. Sanctions
Whenever the administering agency believes the General or Prime Contractor or any subcontractor may not
be operating in compliance with the provisions of the Fair Employment Practices Law of the Commonwealth
(Massachusetts General Laws Chapter 151B), the administering agency may refer the matter to the
Massachusetts Commission Against Discrimination (“Commission”) for investigation.
Following the referral of a matter by the administering agency to the Massachusetts Commission Against
Discrimination, and while the matter is pending before the MCAD, the administering agency may withhold
payments from contractors and subcontractors when it has documentation that the contractor or
subcontractor has violated the Fair Employment Practices Law with respect to its activities on the Project, or
if the administering agency determines that the contractor has materially failed to comply with its obligations
and the requirements of this Section. The amount withheld shall not exceed a withhold of payment to the
General or Prime Contractor of 1/100 or 1% of the contract award price or $5,000, whichever sum is greater,
or, if a subcontractor is in non-compliance, a withhold by the administering agency from the General
Contractor, to be assessed by the General Contractor as a charge against the subcontractor, of 1/100 or 1%
of the subcontractor price, or $1,000 whichever sum is greater, for each violation of the applicable law or
contract requirements. The total withheld from any one General or Prime Contractor or subcontractor on a
Project shall not exceed $20,000 overall. No withhold of payments or investigation by the Commission or its
agent shall be initiated without the administering agency providing prior notice to the Contractor.
If, after investigation, the Massachusetts Commission Against Discrimination finds that a General or Prime
Contractor or subcontractor, in commission of a state construction contract or state-assisted construction
contract, violated the provisions of the Fair Employment Practices Law, the administering agency may
convert the amount withheld as set forth above into a permanent sanction, as a permanent deduct from
payments to the General or Prime Contractor or subcontractor, which sanction will be in addition to any
such sanctions, fines or penalties imposed by the Massachusetts Commission Against Discrimination:
No sanction enumerated under this Section shall be imposed by the administering agency except after notice
to the General or Prime Contractor or subcontractor and an adjudicatory proceeding, as that term is used,
under Massachusetts General Laws Chapter 30A, has been conducted.
IX. Severability
The provisions of this section are severable, and if any of these provisions shall be held unconstitutional by
any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining
provisions.
X. Contractor’s Certification
A bidder for a state construction contract or state assisted construction contract will not be eligible for award
of the contract unless such bidder has submitted to the administering agency the following certification,
which will be incorporated into the resulting contract:

XI. Subcontractor Requirements
Prior to the award of any subcontract for a state construction contract or a state assisted construction
contract, regardless of tier, the Prime or General Contractor shall provide all prospective subcontractors with
a complete copy of this Section entitled “Supplemental Equal Employment Opportunity, Non-
Discrimination and Affirmative Action Program” and will incorporate the provisions of this Section by
reference into any and all contracts or work orders for all subcontractors providing work on the Project. In
order to ensure that the said subcontractor's certification becomes a part of all subcontracts under the prime
contract, the Prime or General Contractor shall certify in writing to the administering agency that it has
complied with the requirements as set forth in the proceeding paragraph.

of the second part, hereinafter called "Owner".
WITNESSETH that for the consideration hereinafter mentioned, the Contractor and the Owner shall agree
to the terms and conditions contained in this contract, enumerated as follows: The Owner-Contractor
Agreement, Advertisement, Bidding Documents, Contract Forms, Insurance Requirements, Specifications,
and all addenda issued prior to and all Modifications issued after execution of the Contract.
THE OWNER shall pay the Contractor for the performance of this contract in the sum of:

This contract shall not be altered in any particular without the consent of all parties to this contract. All
alterations to this contract must be in writing and authorized as such by the Mayor and the signatories to this

this Contract shall be canceled in the event of non-appropriation.
Final payment on this contract shall release and discharge the Owner from any and all claims against the Owner
on account of any work performed hereunder, or any alteration hereto.
The Vendor shall indemnify and hold harmless, the CITY and all of its officers, agents, and employees
against all suits, claims or liabilities of every nature, arising out of, or in consequence of, the acts or omissions
of the Contractor, its employees, agents, or sub-contractors in connection with their rendering of services or
goods under this AGREEMENT and will, at the Contractor’s own cost and expense, defend any and all such
suits and actions
By signing this contract the Vendor agrees to subject any dispute to mediation, at the option of the City, prior
to filing suit in any forum.
This contract shall be deemed to be a Massachusetts contract and its interpretation and construction shall be
governed by the laws of Massachusetts and the Charter and Ordinances of the Owner.
The provisions of this contract are severable. If any provision of this contract shall be held unconstitutional by

The City of Northampton is not bound by this contract until approved by the Mayor of Northampton.

criminal or civil judgment, administrative citation, final administrative determination, order or debarment
resulting from a violation of G.L. c. 149, c. 151, or the Fair Labor Standards Act within three (3) years prior
to the date of the Contract, or b) that if it or any of its subcontractors have been subject to a federal
or state criminal or civil judgment, administrative citation, final administrative determination,
order or debarment resulting from a violation of G.L. c. 149, c. 151, or the Fair Labor Standards
Act within three (3) years prior to the date of the Contract, the Contractor has provided copies of
any such judgment, citation, determination or order to the City prior to the date of the Contract and has

ASBESTOS ABATEMENT
PART 1 GENERAL
1.01 GENERAL PROVISIONS
A. Drawings and general provisions of the Contract, including General and
Supplementary Conditions and Division I Specifications, apply to this Section.
B. Equality of materials, article, assembly or system other than those named of
described in this Section will be determined in accordance with the provisions of
the Contract and General Conditions.
C. The Asbestos Abatement Contractor shall refer to other Sections of the
Specification for work, which, may impact the sequence, or the work of this
Section. Examine all Drawings (if applicable) and all other Sections of the
Specifications for requirement of related section affecting the work of this Section.
No additional compensation or contract extension will be granted for failure to
comply with this requirement.
1.02 DEFINITIONS
A. The following definitions relative to asbestos abatement apply:
1. ABATEMENT – Procedures to control fiber release from asbestos-
containing materials; includes removal, encapsulation, and enclosure.
2. AIR MONITORING – The process of measuring the fiber concentration of
an area or of a person.
3. AMENDED WATER – Water to which a surfactant has been added.
4. ASBESTOS WORK AREA – A regulated area as defined by OSHA 29 CFR
1926. 1101 where asbestos abatement operations are performed which is
isolated by physical boundaries to prevent the spread of asbestos dust,
fibers, or debris. The regulated area shall comply with requirements of
regulated area for demarcation, access, respirators, prohibited activities,
competent persons and exposure assessments and monitoring.
5. COMPETENT PERSON – As defined by 29 CFR 1926. 1101, a
representative of the Contractor who is capable of identifying existing
asbestos hazards in the workplace and selecting the appropriate control
strategy for asbestos exposure. Who has authority to take prompt
corrective measures to eliminate such hazards during asbestos removal.
Competent person shall be properly trained in accordance with EPA's
Model Accreditation Plan.
6. CLASS I ASBESTOS WORK – means activities involving the removal of
thermal system insulation (TSI) and/or surfacing materials. This work
includes picking up and bagging asbestos debris/dust during Class I work.
7. CLASS II ASBESTOS WORK – means activities involving the removal of
asbestos containing material which is not thermal system insulation or

surfacing material. This includes, but is not limited to, the removal of
asbestos containing wallboard, floor tile and sheeting roofing and siding
shingles, and construction mastics.
8. ENCAPSULATION – The abatement of an asbestos hazard through the
appropriate use of chemical encapsulants.
9. ENCAPSULANTS – Specific materials in various forms used to chemically
or physically entrap asbestos fibers in various configurations to prevent
these fibers from becoming airborne. There are three types of encapsulants
to be used on this project:
a. Removal encapsulants used as a wetting agent during removal
b. Bridging encapsulants used to provide a tough, durable surface
coating to the asbestos containing material.
c. Lock-Down Encapsulant used to seal off or “lock down” microfibers
left on surfaces which asbestos containing materials had been
removed.
10. HEPA FILTER – A high efficiency particulate air (HEPA) filter in compliance
with ANSI Z9.2-1979.
11. HEPA VACUUM EQUIPMENT – Vacuum equipment with a HEPA filter
system for filtering the effluent air from the unit.
12. NEGATIVE AIR PRESSURE EQUIPMENT – A portable local exhaust
system equipped with HEPA filtration used to create negative pressure in
a regulated area (negative with respect to adjacent unregulated areas) and
capable of maintaining a constant, low velocity air flow into regulated areas
from adjacent unregulated areas.
13. NESHAP – National Emissions Standard for Hazardous Air Pollutants
regulations enforced by the EPA.
1.03 DESCRIPTION OF WORK
A. The performance-oriented design specifications contained herein are intended to
provide the guidelines under which Contractors and personnel are expected to
perform asbestos abatement in the residential structures (main house, and
detached garage) located at 278 Burts Pit Road in Northampton, Massachusetts
as part of a proposed demolition project. They are not intended to replace or
supersede any pertinent local, State or Federal regulation but should be used
along with applicable regulations as the work is performed at 278 Burts Pit Road.
B. This project involves the removal of asbestos containing building materials from
two residential structures located at 278 Burts Pit Road in Northampton,
Massachusetts to prepare the buildings for demolition.
C. The Asbestos Abatement Contractor shall furnish all labor, materials, services,
training, insurance and equipment necessary to complete the removal of asbestos
containing and asbestos-contaminated materials as indicated below. The
Asbestos Abatement Contractor shall follow all Federal, State and local
ordinances, regulations, rules pertaining to asbestos, including abatement,
storage, transportation and disposal.

D. An asbestos assessment (dated April 5, 2021) of the two structures have been
performed by O’Reilly, Talbot & Okun Associates, Inc. The asbestos assessment
was conducted to provide the City of Northampton with general information and
estimated quantities of asbestos containing materials in and on the two buildings.
The assessments were conducted in general accordance with the Environmental
Protection Agency (EPA) National Emission Standard for Hazardous Air Pollutants
(NESHAP) regulation.
1.04 WORK UNDER THIS CONTRACT
A. Provide labor, materials and equipment necessary to complete the work of this
Section, including but not limited to the following.
B. This Section includes the following scope of work:
1. Main Residential Building
a. Removal and disposal of approximately 195 square feet of
asbestos containing resilient floor tile (brown) and associated
mastic from the first floor kitchen.
b. Removal and disposal of approximately 125 square feet of
asbestos containing resilient floor tile (grey) and associated mastic
from the second floor C/D corner bedroom. (Walls are labeled A
through D in a clockwise manner, with the A-wall being parallel to
the main road or street, in this case, Burts Pit Road.)
c. Removal and disposal of approximately 850 square feet (total) of
wall plaster from the first floor Dining room (450 sq. ft.) and Pantry
(400 sq. ft.)
d. Window pane glazing compounds on approximately 32 windows
throughout the buiding.
e. Removal and disposal of approximately one metal clad boiler from
the basement level with asbestos containing gaskets, refractory
and/or fire brick from the basement.
f. Removal and disposal of approximately 250 linear feet of asbestos
containing thermal insulation from piping and fittings.
g. Removal and disposal of approximately 600 square feet of
asbestos containing thermal insulation debris from the basement
level.
h. Removal and disposal of approximately 1,500 square feet of
asbestos containing cementitious siding from the exterior of the
residence.
i. Removal and disposal of approximately 1,050 square feet of
asbestos containing slate roofing from the exterior of the
residence. Slate roofing is limited to areas with asphaltic adhesive
cement sealant.
2. Detached Garage
j. Removal and disposal of approximately 600 square square feet of
asbestos containing cementitious siding from the exterior of the

residence.
C. These quantities of asbestos containing materials are estimations only; deviations
based upon actual conditions shall not constitute an expansion of the scope of the
work of this Section of the Specifications. The asbestos abatement Contractor shall
also field verify the condition of the asbestos containing materials and to clean
asbestos containing debris from areas adjacent to where abatement is being
performed.
D. The above asbestos containing materials are known to be present at the worksite
that the asbestos abatement Contractor shall have contact. If any materials are
found, which are suspected of containing asbestos fibers, notify the Owner’s
asbestos project monitor immediately. Do not disturb the suspected materials.
E. The Contractor is required to have an experienced work crew of sufficient size and
the necessary equipment to complete this project within the time period defined in
the renovation construction specifications and General Contract.
F. The asbestos Contractor shall be responsible for the performing the interior
demolition as necessary to access and remove the asbestos containing materials.
G. The asbestos abatement of the two structures as part of the 278 Burts Pit Road
property is defined by the OSHA regulation 29 CFR 1926.1001 as Class I and II
asbestos abatement work. In addition to existing federal and state abatement
regulations, Class I and II asbestos abatement requires specific engineering
controls and work practices. These specifications identify the procedures and work
practices required for this abatement project.
1.05 PLAN OF ACTION
A. The Contractor shall submit a detailed plan of the procedures proposed for use in
complying with the requirements of this specification. Include in the plan the
location and layout of decontamination areas, methods to be used to assure the
safety of contractor personnel and building occupants, and a detailed description
of the methods to be employed to control pollution. Expand upon the use of
portable HEPA ventilation system, method of removal to prohibit visible emissions
in work area, and packaging of removed asbestos debris. The plan must be
approved in writing by the Owner's Representative prior to commencement of
work.
B. The Contractor shall provide the Owner with a work schedule that identifies the
completion date of each work phase of the project.
C. The Contractor shall provide the Owner with notice that asbestos negative
pressure enclosures have been inspected and sufficient negative pressure/air
filtration has been established.
1.06 STOP WORK
A. If the Owner, the Owner's Representative, the Project Administrator or a regulatory
official presents a stop work order, immediately and automatically stop all work.
Do not recommence work until authorized in writing by Owner's Representative.

1.07 CONTRACTOR USE OF PREMISES
A. Contractor's Use of the Existing Building: Maintain existing building in a safe and
weather tight condition throughout the abatement period. Repair damage, to the
owner’s discretion, caused by abatement operations. Take all precautions
necessary to protect the building and personnel onsite during the abatment period.
B. Keep areas such as walkways, roads, hallways, and stairs free from accumulation
of waste, rubbish or construction debris. Fire lanes and fire department access
shall be maintained at all times to the site and work area.
C. All cutting and hot work will be approved by the Owners Representative prior to
initiating the work and shall comply with NFPA 51B, Standard for Welding, Cutting
and other Hot Work.
D. The Contractor shall perform and ensure the proper safeguards are in place during
interior demolition and asbestos abatement in accordance with NFPA 241,
Standard for Safeguarding during Construction, Alteration and Demolition.
E. There is NO SMOKING anywhere on the 278 Burts Pit Road property.
1.08 OWNER OCCUPANCY
A. The Owner reserves the right to place and install equipment as necessary in areas
of the building in which all asbestos abatement and project decontamination
procedures have been completed, and to occupy such completed areas prior to
substantial completion, provided that such occupancy does not substantially
interfere with completion of the work. Such placing of equipment and partial
occupancy will not constitute acceptance of the work or any part of the work.
1.09 SUBMITTALS
A. Before the Start of Work: Submit the following to the Owner's Representative for
review. Do not begin work until these submittals are returned with Owner's
Representative's written approval.
1. Plan of Action.
2. Work Sequence Schedule.
3. Copy of the Massachusetts Asbestos Abatement Contractor’s License.
4. Certificate of Insurance.
5. Name of Project Superintendent, Resume, MassDLS (Massachusetts
Department of Labor Standards) Supervisor License.
6. Copy of notifications to regulatory officials and emergency services
agencies.
7. Asbestos/Demolition Permits.
8. Waste Hauler Permits.
9. Material Safety Data Sheet (MSDS) for all chemicals used or brought
onsite.

1.10 ADMINISTRATIVE AND SUPERVISORY PERSONNEL
A. General Superintendent: Provide a full-time General Superintendent who is
experienced in administration and supervision of asbestos abatement projects
including work practices, protective measures for building and personnel, disposal
procedures, and other applicable items. This person is the Contractor’s
Representative responsible for compliance with all applicable federal, state and
local regulations, particularly those relating to asbestos-containing materials.
B. Experience and Training: The General Superintendent must have completed a
course at an EPA AHERA Training Center or equivalent certificate course in
asbestos abatement procedures and have had a minimum of five (5) years on-the-
job training in asbestos abatement procedures with projects of similar scope and
size.
C. Competent Person: The General Superintendent is to be a Competent Person as
required by OSHA in 29 CFR 1926.
D. Accreditation: The General Superintendent is to be accredited as an Asbestos
Abatement Supervisor in accordance with the AHERA regulation 40 CFR Part 763,
Subpart E, Appendix C.
E. Workers: Removal workers shall have successfully completed an EPA approved
asbestos training course within one year prior to the commencement of the work.
Each removal worker shall be certified as required by Massachusetts Department
of Labor and Industries Regulations 453 CMR 6.00.
F. Identification Cards: All persons engaged in asbestos abatement on the job site
shall keep their certification identification card at the job site and shall present it to
any state or federal regulatory agency upon request. No person is to enter the job
site unless this card is present.
1.11 PRE-CONSTRUCTION CONFERENCE
A. An initial progress meeting recognized as "Pre-Construction Conference" will be
convened by the Owner's Representative prior to start of any work. Meet at project
site, or as otherwise directed with General Superintendent, Owner, Owner's
Representative, Project Administrator, and other entities concerned with the
asbestos abatement work.
B. 72 hours advance notice will be provided to all participants prior to convening Pre-
Construction Conference.
C. This is an organizational meeting to review responsibilities and personnel
assignments and to locate the specific work and decontamination areas and
temporary facilities including power, light, water, and other applicable equipment
or items.

A. Daily Log: Maintain within the Decontamination Unit a daily log documenting the
dates and time of but not limited to, the following items:
1. Meetings: purpose, attendees, brief discussion;
2. Visitations: authorized and unauthorized;
3. Personnel: by name, entering and leaving the work area;
4. Special or unusual events: i.e. negative pressure enclosure breeching,
equipment failures, accidents;
5. Personal air monitoring sampling and results; and
6. Documentation of Contractor's completion of the following:
· Inspection of work area preparation prior to start of removal and daily
thereafter.
· Removal of any sheet plastic barriers.
· Contractor's inspections prior to encapsulation, enclosure or any other
operation that shall conceal the condition of asbestos-containing
materials or the substrate from which such materials have been removed.
· Removal and quantity of waste materials from work area.
· Decontamination of equipment (list items).
· Contractor’s final inspection/final air test analysis.
7. Provide two (2) copies of this log to Project Administrator at the conclusion of
the project.
1.13 SPECIAL REPORTS
A. General: Except as otherwise indicated, submit special reports directly to Owner
within one day of occurrence requiring special report, with copy to Owner's
Representative and others affected by occurrence.
B. Reporting Unusual Events: When an event of unusual and significant nature occurs
at site (examples: failure of pressure differential system, rupture of temporary
enclosures), prepare and submit a special report listing chain of events, persons
participating, and response by Contractor's personnel, evaluation of results or effects,
and similar pertinent information. When such events are known or predictable in
advance, advise Owner in advance at earliest possible date.
C. Reporting Accidents: Prepare and submit reports of accidents or injuries, at the
worksite and anywhere else work is in progress. Record and document data and
actions; comply with industry standards. For this purpose, an accident is defined to
include events where personal injury is sustained, property loss of substance is
sustained, or where the event posed a significant threat of loss or personal injury.
D. Report Discovered Conditions: When an unusual condition of the building is
discovered during the work (i.e., structural, building safety/security) prepare and
submit a special report indication condition discovered.

A. Contingency Plan: Prepare a contingency plan for emergencies including fire,
accident, power failure, pressure differential system failure, structural collapse,
supplied air system failure, or any other event that may require modification or
abridgment of decontamination or work area isolation procedures. Include in the
plan specific procedures for decontamination or work area isolation. Note that
nothing in this specification should impede safe exiting or providing of adequate
medical attention in the event of an emergency.
B. Post: in clean room of Personnel Decontamination Unit and in the job trailer
emergency telephone numbers and locations of emergency services.
C. The contractor shall identify in the contingency plan the type of communications to
be used on site and the method to notify emergency services.
1.15 NOTIFICATIONS
A. Notify other entities at the job site of the nature of the asbestos abatement
activities, location of asbestos-containing materials, requirements relative to
asbestos set forth in these specifications and applicable regulations.
B. Send notifications to each of the following regulatory agencies:

C. All notifications to regulatory offices must be made at least ten (10) days prior to
beginning work. Copies of the notifications are to be delivered to the Owner and
the Owner’s representative.
D. The asbestos regulatory notifications may be submitted directly (electronically) to
MassDEP who then enters the data into an inter-department database for the other
agencies.
E. The Contractor shall provide notification to the City of Springfield Emergency
Service Agencies including:

PART 2 PROJECT CONDITIONS
An asbestos assessment of the Site buildings has been performed in accordance with the
NESHAP regulation to prepare the building for demolition. Accessible suspected insulation and
building materials were sampled and analyzed for asbestos content.
2.01 ASBESTOS ABATEMENT SCHEDULE
A. The schedule of asbestos abatement of the buildings will be determined and
conveyed to the abatement contractor by the Owner and Owner’s Representative.
2.02 BUILDING MATERIALS
A. An asbestos assessment has been performed in the two structures located 278
Burts Pit Road in Northampton, Massachusetts. Details of the asbestos containing
materials, their locations and quantity are included in the asbestos assessment
report. In summary the following are the materials to be removed prior to
performing demolition activities.
· Resilient floor tile and adhesive mastic from 1st floor kitchen, and 2nd floor
bedroom,
· Wall plaster in Dining Room and Pantry,
· Window pane glazing compounds,
· One boiler,
· Thermal systems pipe insulation and debris,
· Exterior cementitious siding, and
· Exterior slate roofing (asphaltic tar/flashing cement).

PART 3 EXECUTION
3.01 ABATEMENT WORK PROCEDURES
A. This project involves Class I and II asbestos abatement and shall require the use
of negative pressure enclosures, HEPA air filtration, poly work enclosures critical
barriers and aggressive resilient floor tile removal techniques. The following are
the requirements and work practices for performing Class I and II asbestos
abatement using the full containment abatement removal methodology.
3.02 ASBESTOS SURFACING, THERMAL SYSTEM INSULATION (CLASS I) AND
RESILIENT FLOORING REMOVAL PROCEDURES (CLASS II)
A. The removal of the asbestos containing surfacing and thermal system insulation is
an OSHA Class I abatement operation. The removal of window glazing, resilient
flooring and adhesive mastic, roofing materials, and cementitous siding are an
OSHA Class II abatement operation.The removal of Class I and Class II materials
shall be performed using the full containment asbestos abatement methodology
and/or the negative pressure glovebag removal methodology. The full containment
abatement methodology includes the use of a negative pressure differential, HEPA
air filtration, polyethylene work enclosures, wet removal practices and
cleaning/decontamination procedures.
B. The following work practices are to be performed when removing asbestos using
the full containment abatement removal methodology:
1. Temporary Pressure Differential and Air Circulation System:
Before the start of work submit design of pressure differential system to the
Owner's Asbestos Project Monitor for review. Do not begin work until
submittal is returned with the Owner's Asbestos Project Monitor's action
stamp indicating that the submittal is returned for unrestricted use. Include
in the submittal at a minimum:
a. Number of HEPA filtered fan units required and the calculations
necessary to determine the number of machines
b. Description of projected airflow within Work Area and methods
required to provide adequate airflow in all portions of the work area
2. Pressure Differential Isolation:
a. Isolate the Work Area from all adjacent areas or systems of the
building with a Pressure Differential that will cause a movement of
air from outside to inside at any breach in the physical isolation of
the Work Area.
b. Relative Pressure in Work Area: Continuously maintain the work
area at an air pressure that is lower than that in any surrounding
space in the building, or at any location in the immediate proximity
outside of the building envelope. This pressure differential when
measured across any physical or critical barrier must equal or
exceed a static pressure of -0.02 inches of water.

c. Accomplish the pressure differential by exhausting a sufficient
number of HEPA filtered fan units from the work area. The number
of units required shall depend on machine characteristics, the seal
at barriers, and required air circulation. The number of units shall
increase with increased make-up air or leaks into the Work Area.
Determine the number of units required for pressure isolation by the
following procedure:
d. Establish required air circulation in the work area, personnel and
equipment decontamination units.
e. Establish isolation by increased pressure in adjacent areas or as
part of seals where required.
f. Exhaust a sufficient number of units from the work area to develop
the required pressure differential.
g. The required number of units is the number determined above plus
one additional unit.
h. Vent HEPA filtered fan units to outside of building unless authorized
in writing by Owner's Asbestos Project Monitor.
i. Mount units to exhaust directly or through disposable ductwork.
j. Use only new ductwork except for sheet metal connections and
elbows.
k. Use ductwork and fittings of same diameter or larger than discharge
connection on fan unit.
l. Use inflatable, disposable plastic ductwork in lengths not greater
than 100 feet.
m. Use spiral wire-reinforced flex duct in lengths not greater than 50
feet.
n. Arrange exhaust as required to inflate duct to a rigidity sufficient to
prevent flapping.
o. If direction of discharge from fan unit is not aligned with duct use
sheet metal elbow to change direction. Use six feet of spiral wire
reinforced flex duct after direction change.
3. Air Circulation in the Work Area:
For purposes of this section air circulation refers to either the introduction
of outside air to the Work Area or the circulation and cleaning of air within
the Work Area.
a. Air circulation in the Work Area is a minimum requirement intended
to help maintain airborne fiber counts at a level that does not
significantly challenge the work area isolation measures. The
Asbestos Abatement Contractor may also use this air circulation as
part of the engineering controls in his worker protection program.
b. Determining the Air Circulation Requirements: Provide a fully
operational air circulation system supplying a minimum of 4 air
changes per hour
c. Determine Number of Units needed to achieve required air

circulation according to the following procedure:
d. Determine the volume in cubic feet of the work area by multiplying
floor area by ceiling height. Determine total air circulation
requirement in cubic feet per minute (CFM) for the work area by
dividing this volume by the air change rate and multiplying by 60.
Air Circulation Required in Cubic Feet of Air per Minute (CFM) =
Volume of work area (cu. ft.) X Number of air changes per hour /
60 (minutes per hour)
e. Divide the air circulation requirement (CFM) above by capacity of
HEPA filtered fan unit(s) used. Capacity of a unit for purposes of
this section is the capacity in cubic feet per minute with fully loaded
filters (pressure differential which causes loaded filter warning light
to come on) in the machine's labeled operating characteristics.

f. Add one (1) additional unit as a backup in case of equipment failure
or machine shutdown for filter changing.
4. Exhaust System:
Pressure differential isolation and air circulation in the Work Area are to be
accomplished by an exhaust system as described below.
a. Exhaust all units from the Work Area to meet air circulation
requirement of this section.
b. Location of HEPA Filtered Fan Units: Locate fan unit(s) so that
makeup air enters work area primarily through decontamination
facilities and traverses Work Area as much as possible. This may
be accomplished by positioning the HEPA filtered fan unit(s) at a
maximum distance from the worker access opening or other
makeup air sources.
c. Place End of Unit an intake duct or its exhaust duct through an
opening in the plastic barrier or wall covering. Seal plastic around
the unit or duct with tape.
d. Vent the exhaust Outside of Building unless authorized in writing by
the Owner's Asbestos Project Monitor.
e. Decontamination Units: Arrange Work Area and decontamination
units so that the majority of makeup air comes through the
Decontamination Units. Use only personnel or equipment
Decontamination Unit at any time and seal the other so that make
up air passes through unit in use.
5. Air Circulation in Decontamination Units:
a. Pressure Differential Isolation: Continuously maintain the pressure
differential required for the work area in the negative pressure
enclosure.
b. Personnel Decontamination Unit: across the Shower Room with

the Equipment Room at a lower pressure than the Clean room.
c. Equipment Decontamination Unit: Across the Holding Room with
the Washroom at a lower pressure than the Clean Room.
d. Air Circulation: Continuously maintain air circulation in
Decontamination Units at same level as required for Work Area.
e. Air Movement: Arrange air circulation through the Personnel
Decontamination Unit so that it produces a movement of air from
the Clean Room through the Shower Room into the Equipment
Room. Maintain continuous minimum velocities of Sixty (60) feet
per minute in the breathing zone area of the shower and thirty (30)
feet per minute in all other locations of the shower.
6. Use of System During Abatement Operations:
a. Start fan units before beginning work (before any asbestos-
containing material is disturbed). After abatement work has begun,
run units continuously to maintain a constant pressure differential
and air circulation until decontamination of the work area is
complete. Do not turn off units at the end of the work shift or when
abatement operations temporarily stop.
b. Do not shut down air pressure differential system during
encapsulating procedures, unless authorized by the Owner's
Asbestos Project Monitor in writing. Supply sufficient pre-filters to
allow frequent changes.
c. Start abatement work at a location farthest from the fan units and
proceed toward them. If an electric power failure occurs,
immediately stop all abatement work and do not resume until power
is restored and fan units are operating again.
d. At completion of abatement work, allow fan units to run as specified,
to remove airborne fibers that may have been generated during
abatement work and cleanup and to purge the Work Area with clean
makeup air. The units may be required to run for a longer time after
decontamination, if dry or only partially wetted asbestos material
was encountered during any abatement work.
7. Dismantling the System:
When a final inspection and the results of final air tests indicate that the
area has been decontaminated, fan units may be removed from the Work
Area. Before removal from the Work Area, remove and properly dispose
of pre-filter, decontaminate exterior of machine and seal intake to the
machine with 6-mil polyethylene to prevent environmental contamination
from the filters.
8. Temporary Enclosures:
a. Work Area: the location where asbestos-abatement work occurs.
It is a variable of the extent of work of the Contract. It may be a
portion of a room, a single room, or a complex of rooms. A "Work
Area" is considered contaminated during the work and must be
isolated from the balance of the building, and decontaminated at
the completion of the asbestos-control work.

b. Completely isolate the Work Area from other parts of the buildings
so as to prevent asbestos-containing dust or debris from passing
beyond the isolated area. Should the area beyond the Work
Area(s) become contaminated with asbestos-containing dust or
debris as a consequence of the work, clean those areas in
accordance with the procedures indicated. Perform all such
required cleaning or decontamination at no additional cost to owner.
c. Place all tools, scaffolding, staging, and other equipment necessary
for the work in the area to be isolated prior to completion of Work
Area isolation.
d. The Asbestos Abatement Contractor shall be responsible for
cleaning and decontaminating all movable objects contaminated
with asbestos as determined by the Owner’s Asbestos Project
Monitor in accordance with the procedures described. Completely
cover all non-movable objects with two (2) layers of polyethylene
sheeting, at least 6 mil in thickness, securely taped in place with
duct tape. Such non-movable objects shall be considered outside
the work area unless covering plastic or seal is breached.
e. Disable ventilating systems or any other system bringing air into or
out of the Work Area. Disable system by disconnecting wires,
removing circuit breakers, by lockable switch or other positive
means that shall prevent accidental premature restarting of
equipment.
f. Lockout power to Work Area by switching off all breakers serving
power or lighting circuits in work area. Identify the breakers with
personal lockout tags. Lock panel and have all keys under control
of the General Contractor and Asbestos Abatement Contractor's
Superintendent.
9. Control Access:
a. Isolate the Work Area to prevent entry by building occupants into
Work Area or surrounding controlled areas. Accomplish isolation
by the following:
b. Submit to Owner's Asbestos Project Monitor a list of doors and
other openings that must be secured to isolate Work Area. Include
on list notation if door or opening is in an indicated exit route.
c. If building occupants or other construction trades are present on
site, the abatement Asbestos Abatement Contractor shall construct
critical barrier partitions or closures across any opening into Work
Area. Partitions are to be a minimum of 8 feet high.
d. Fabricate partitions from 2 X 4 wood studs with 1/2" plywood on
both faces. Brace at 4'-0" on center.
e. Locked Access: Arrange Work Area so that the only access into
Work Area is through lockable doors to personnel and equipment
decontamination units.
f. Install temporary doors with entrance type locksets that are key
lockable from the outside and always unlocked and operable from
the inside. Do not use deadbolts or padlocks.

g. Provide one key for each door to the Owner, and Owner's Asbestos
Project Monitor and maintain one key in clean room of
decontamination unit (3 total).
h. Immediately inside door and outside critical barriers post an
approximately 20 inch by 14 inch manufactured caution sign
displaying the following legend with letter sizes and styles of a
visibility required by 29 CFR 1926:

i. Provide spacing between respective lines at least equal to the
height of the respective upper line.
10. Critical Poly Barriers:
a. Completely Separate the Work Area from other portions of the
building, and the outside by closing all openings with sheet plastic
barriers at least 6 mil in thickness, or by sealing cracks leading out
of Work Area with duct tape.
b. Individually seal all ventilation openings (supply and exhaust),
lighting fixtures, clocks, doorways, windows, convectors and
speakers, and other openings into the Work Area with duct tape
alone or with polyethylene sheeting at least 6 mil in thickness, taped
securely in place with duct tape. Maintain seal until all work
including Project Decontamination is completed. Take care in
sealing of lighting fixtures to avoid melting or burning of sheeting.
c. Provide Sheet Plastic barriers at least 6 mil in thickness as required
to seal openings completely from the Work Area into adjacent
areas. Seal the perimeter of all sheet plastic barriers with duct tape
or spray cement.
d. Mechanically Support sheet plastic independently of duct tape or
spray cement seals so that seals do not support the weight of the
plastic.
11. Primary Barrier:
Protect building and other surfaces in the Work Area from damage from
water and high humidity or from contamination from asbestos-containing
debris, slurry or high airborne fiber levels by covering with a primary barrier
as described below.
Sheet Plastic: Protect surfaces in the Work Area with two (2) layers of
plastic sheeting on floor and walls, or as otherwise directed on the Contract
Drawings or in writing by the Owner's Asbestos Project Monitor. Perform
work in the following sequence.

a. Cover Floor of Work Area with 2 individual layers of clear
polyethylene sheeting, each at least 6 mil in thickness, turned up
walls at least 12 inches. Form a sharp right-angle bend at junction
of floor and wall so that there is no radius that could be stepped on
causing the wall attachment to be pulled loose. Both spray-glue
and duct tape all seams in floor covering. Locate seams in top layer
six feet from, or at right angles to, seams in bottom layer. Install
sheeting so that top layer can be removed independently of bottom
layer.
b. Cover all walls in Work Area including "Critical Barrier" sheet plastic
barriers with two individual layers of polyethylene sheeting, at least
4 mil in thickness, mechanically supported and sealed with duct
tape or spray-glue in the same manner as "Critical Barrier" sheet
plastic barriers. Tape all joints including the joining with the floor
covering with duct tape or as otherwise indicated.
c. Stairs and Ramps: Do not cover stairs or ramps with unsecured
sheet plastic. Where stairs or ramps are covered with plastic,
provide 3/4" exterior grade plywood treads securely held in place,
over plastic. Do not cover rungs or rails with any type of protective
materials.
d. Repair of Damaged Polyethylene Sheeting: Remove and replace
plastic sheeting that has been damaged by removal operations or
where seal has failed allowing water to seep between layers.
Remove affected sheeting and wipe down entire area. Install new
sheet plastic only when area is completely dry.
e. If the Critical or Primary barrier fails or is breached in any manner
stop work immediately. Do not start asbestos removal work until
authorized in writing by the Owner's Asbestos Project Monitor.
f. Extension of Work Area: If the Critical Barrier is breached in any
manner that could allow the passage of asbestos debris or airborne
fibers, then add affected area to the Work Area, enclose it as
required by this Section of the specification and decontaminate it as
described in Project Decontamination.
12. Secondary Barrier:
a. Secondary layer of plastic as a drop cloth to protect the primary
layer from debris generated by the asbestos abatement work is
specified in the appropriate work sections.
b. All electrical equipment used in the regulated areas shall be
energized with Ground Fault Circuit Interrupter (GFCI)
panels/disconnects.
3.03 REMOVAL OF ASBESTOS CONTAINING MATERIALS
A. The Contractor is responsible for performing all demolition activities required to
safely access the asbestos containing materials including but not limited to:
1. The removal of all walls and ceilings and other building structure
enclosures to access asbestos pipefittings.

2. The removal of all carpeting, leveling compounds, wood sub-flooring, steel
plates, and other as needed to access resilient floor covering and adhesive
mastics.
3. The removal of non-asbestos roofing to access the asbestos containing
roof flashing mastic.
4. The disassembly of the boilers and incinerator to access enclosed
asbestos containing materials.
B. All asbestos abatement shall be performed using the full containment abatement
removal methodology and/or glovebag removal for pipe insulation and pipe fittings.
C. Poly Barrier:
1. Install a drop cloth a clear 6-mil sheet plastic in all areas where asbestos
removal work is to be carried out using the negative pressure glovebag
methodology and/or removal of surfacing material. The drop cloth is to
extend a minimum of ten (10) feet beyond the surface of the material that
is being removed. Where the work is within 10'-0" of a wall extend the poly
drop cloth up wall five (5) feet above the surface being removed or to the
ceiling. Support sheet plastic on wall with duct tape.
2. Install the Poly Barriers at the beginning of each work shift. Install only
sufficient plastic for work of that shift.
3. Remove Poly Barrier at end of each work shift or as work in an area is
completed. Fold plastic toward center of sheet and pack in disposal bags.
Keep material on sheet continuously wet until bagged.
4. Thoroughly wet Asbestos-Containing Materials to be removed prior to
stripping and/or tooling to reduce fiber dispersal into the air. Accomplish
wetting by a fine spray (mist) of amended water or removal encapsulant.
Saturate material sufficiently to wet to the substrate without causing excess
dripping. Allow time for amended water or removal encapsulant to
penetrate material thoroughly. If amended water is used, spray material
repeatedly during the work process to maintain a continuously wet
condition. If a removal encapsulant is used, apply in strict accordance with
manufacturer's written instructions. Perforate outer covering of any
installation which has been painted and/or jacketed in order to allow
penetration of amended water or removal encapsulant or use injection
equipment to wet material under the covering. Where necessary, carefully
strip away while simultaneously spraying amended water or removal
encapsulant on the installation to minimize dispersal of asbestos fibers into
the air. The Owner’s Asbestos Project Monitor will check compliance of
these provisions.
5. Mist work area continuously with amended water whenever necessary to
reduce airborne fiber levels.
6. Remove saturated Asbestos-Containing Material in small sections from all
areas. Do not allow material to dry out. As it is removed, simultaneously
pack material while still wet into disposal bags. Twist neck of bags, bend
over and seal with minimum three wraps of duct tape. Clean outside and

move to Wash Down Station adjacent to Material Decontamination Unit.
7. Pipe and Pipe Fitting Insulation: Spray with a mist of amended water or
removal encapsulant. Allow amended water or removal encapsulant to
saturate material to substrate. If a removal encapsulant is used, use in
strict accordance with manufacturer's instructions. Cut the canvas
covering, cut open the cementitious mud fitting, remove and hand-place in
a disposal bag. Remove fitting insulation in chunks and hand place in a
disposal bag. Do not drop to floor. Remove any residue on pipe or fitting
with stiff bristle nylon hand brush.
3.04 THERMAL SYSTEMS INSULATION REMOVAL
A. The Asbestos Abatement Contractor shall use full containment and negative
pressure glovebag techniques for the removal of thermal system boiler and pipe
fitting insulation. The Asbestos Abatement Contractor may use the provisions of
this section for glovebag removal or use the full containment abatement removal
methodology for thermal system pipe insulation.
1. Before the start of work establish a regulated area in accordance with 29
CFR 1926.1101.
2. Remove asbestos-containing material inside a glove bag according to the
following procedure:
3. Use at least two persons to perform glovebag removal operations.
4. Check pipe where the work will be performed. Wrap damaged (broken
lagging, hanging, and other forms of damage), pipe in 2 mil plastic and seal
with duct tape or "candy-stripe" with shrink wrap poly. Place one layer of
duct tape around undamaged pipe at each end where the glove bag will be
attached.
5. Place one layer of 6-mil poly under the surface where glovebag removal is
being performed.
6. Use each glovebag only once.
7. Do not move the glovebag once it has been mounted in place.
8. Do not use glovebags on surfaces whose temperature exceeds 150o F.
9. Slit top of the glove bag open (if necessary) and cut down the sides to
accommodate the size of the pipe (about two inches longer than the pipe
diameter).
10. Place necessary tools into pouch located inside glove bag. This shall
usually include: bone saw, utility knife, rags, scrub brush, wire cutters, tin
snips and pre-wetted cloth.
11. Place one strip of duct tape along the edge of the open top slit of glove bag
for reinforcement.
12. Place the glove bag around section of pipe to be worked on and staple top
together through reinforcing duct tape. Next, duct tape the ends of glove
bag to pipe itself, where previously covered with plastic or duct tape.
13. Install device used to prevent collapse of bag by negative pressure
14. Use smoke tube and aspirator bulb to test seal. Place tube into water

sleeve (two-inch opening to glove bag) squeezing bulb and filling bag with
visible smoke. Remove smoke tube and twist water sleeve closed. While
holding the water sleeve tightly, gently squeeze glove bag and look for
smoke leaking out, (especially at the top and ends of the glove bag). If
leaks are found, tape closed using duct tape and re-test.
15. Run HEPA vacuum cleaner or other device used to create a negative
pressure in the bag continuously during the operation.
16. Insert wand from garden sprayer through water sleeve. Duct tape water
sleeve tightly around the wand to prevent leakage.
17. Thoroughly wet material to be worked on with amended water or removal
encapsulant and allow to soak in. Wet adequately to penetrate and soak
material through to substrate.
18. One person places his hands into the long-sleeved gloves while the second
person directs garden sprayer at the work.
19. Use bone saw, if required, to cut insulation at each end of the section to be
removed. A bone saw is a serrated heavy gauge wire with ring-type
handles at each end. Throughout this process, spray amended water or
removal encapsulant on the cutting area to keep dust to a minimum.
20. Remove insulation using putty knives or other tools. Place pieces in bottom
of bag without dropping.
21. Rinse all tools with water inside the bag and place back into pouch.
22. Using scrub brush, rags and water, scrub and wipe down the exposed pipe.
23. Remove water wand from water sleeve.
24. Prior to removing the glovebag from the pipe surface, collapse the
glovebag by removing air within it using a HEPA vacuum
25. Remove the vacuum nozzle, twist water sleeve closed and seal with duct
tape.
26. From outside the bag, pull the tool pouch away from the bag. Place duct
tape over twisted portion and then cut the tool bag from the glove bag,
cutting through the twisted/taped section. Contaminated tools may then be
placed directly into next glove bag without cleaning. Alternatively, tool
pouch with the tools can be placed in a bucket of water, opened
underwater, and tools cleaned and dried. Discard rags and scrub brush
with asbestos waste.
27. With removed insulation in the bottom of the bag, twist the bag several
times and tape it to keep the material in the bottom during removal of the
glove bag from the pipe.
28. Slip a 6-mil disposal bag over the glove bag (still attached to the pipe).
Remove tape or cut bag and open the top of the glove bag and fold it down
into disposal bag.
29. Clean all surfaces in the Work Area using disposable cloths wetted with
water with surfactant or removal encapsulant added. When these surfaces
have dried, clean with a HEPA filtered vacuum. Material adhered to a
surface with removal encapsulant may require the application of
addi¬tional removal encapsulant to facilitate cleaning.

30. Remove disposable suits and place these into bag with waste.
31. Collapse the bag with a HEPA vacuum twist top of bag, seal with at least 3
wraps of duct tape, bend over and seal again with at least 3 wraps of duct
tape.
32. Provide a back-up HEPA vacuum on site at all times during operation of
the negative pressure glovebag system.
3.05 RESILIENT FLOOR TILE / MASTIC REMOVAL – AGGRESSIVE WORK PRACTICES
A. The removal of the asbestos resilient floor tile and adhesive mastics is an OSHA
Class II abatement operation. It is expected that the floor tiles will not be removed
intact and will be rendered friable during the removal process. There is a strong
possibility that elevated levels of airborne fibers may be generated by the removal.
B. The following work practices are to be performed when removing resilient floor tile:
1. Prepare the area by erecting poly critical barriers and installing HEPA air
filtration units. A negative pressure differential shall be maintained in the
work area throughout abatement process. Non-movable objects shall be
covered and sealed with poly sheets.
2. Remove binding strips or other restrictive molding from doorways, walls,
and other adjoining buildng components, clean and dispose of as non-
asbestos waste. Dispose of any materials that have glue or floor mastic on
them as asbestos containing waste.
3. Wet the floor surface with amended water, removal encapsulant or a
detergent solution so that the entire surface is wet. Do not allow water to
puddle or run off to other areas. Cover with sheet polyethylene to allow
humidity to release tiles from the substrate. Keep floor continuously wet
throughout the removal process.
4. Remove tiles using a manual or powered spade or stripping machine.
Continuously mist floor in area where removal is being performed. The
Contractor may use other abatement methods provided they receive prior
approval from the Owner’s Representative.
5. Start removal by carefully wedging a wall scraper in the seam of two
adjoining tiles and gradually forcing the edge of one of the tiles up and away
from the floor. Continue to force the balance of the tile up by working the
scraper beneath the tile. Exert both a forward pressure and a twisting
motion on the blade to promote release of the tile from the adhesive and
the floor.
6. When the first tile is removed place it in a waste bag or container.
7. After the first tile is removed and accessibility to other tiles is improved,
force the wall scraper under the exposed edge of another tile. Continue to
exert a prying twisting force to the scraper as it is moved under the tile until
the tile releases from the floor. Dispose of the tile and succeeding tiles by
placing in a waste bag. Continue in this manner until all floor tiles have
been removed.
8. Adhesive mastics shall be removed by abrasive shot blasting. The abrasive
shot blasting equipment shall be used inside a negative pressure enclosure

and the equipment shall be equipped with a HEPA filtration system. The
adhesive mastic may also be removed as a component attached to the
wood sub-floor. The use of chemical mastic removers is prohibited.
9. All plywood, wood underlayment and other layers of floor shall be removed
to the concrete and/or wood sub-floor level and disposed as asbestos
waste.
3.06 CEMENTITIOUS SIDING AND ROOFING MATERIALS
A. The removal of the asbestos containing cementitious siding shingles or tiles, and roofing
materials are an OSHA Class II abatement operation. It is expected that the siding and
roofing materials will be removed intact and will not be rendered friable during the removal
process.
B. The following work practices are to be performed when removing cementitous
siding and roofing materials:
1. Prepare the area by placing tarpauline or polyethethene sheeting on the
ground surface below the area(s) where shingles are to be removed.
2. Each shingle is to be sprayed and wetted with amended water prior to removal.
3. Cutting, abrading or breaking siding tiles or shingles shall not occur unless the
Contractor can demonstrate to the Owner’s representative that methods less
likely to result in a fiber release cannot be used as part of the siding removal
process.
4. Unwrapped or unbagged shingles shall immediately be lowered to the ground
by using a dust-tight chute, crane or hoist, or placed in an impervious container
or waste bag or wrapped in plastic sheeting and lowered to the ground no later
than the end of the work shift.
3.06 DECONTAMINATION UNITS
A. Provide Personnel and Equipment Decontamination facilities. Require that the
Personnel Decontamination Unit be the only means of ingress and egress for the
Work Area. Require that all materials exit the Work Area through the
Decontamination Unit. The Asbestos Abatement Contractor may use a remote
decontamination unit during this project. If the Asbestos Abatement Contractor
elects the use of this option, they shall submit the location and remote decon
procedures prior to the start of the project.
B. Provide a Personnel Decontamination Unit consisting of a serial arrangement of
connected rooms or spaces, Changing Room, Drying Room, Shower Room, and
Equipment Room. Require all persons without exception to pass through this
Decontamination Unit for entry into and exiting from the Work Area for any
purpose. Do not allow parallel routes for entry or exit. A personal decontamination
unit shall be required for regulated work area during the abatement phase of the
project.
3.07 CLEANING AND DECONTAMINATION PROCEDURES
A. Accomplish wet cleaning during decontamination with paper towels or disposable
rags:

1. Immerse paper towel or rag in container of water with surfactant, or diluted
removal encapsulant.
2. Wipe surface once and refold to a fresh face of cloth. Proceed in this
manner until all available faces of paper towel or rag have been used.
3. Dispose of paper towel or rag.
4. Do not place rag back in container to rinse out or for any other purpose. If
a used towel or rag comes in contact with water, empty container and refill.
5. Material adhered to a surface with removal encapsulant may require the
application of additional removal encapsulant to facilitate cleaning.
3.08 REMOVAL OF ASBESTOS CONAINING DEBRIS
A. HEPA vacuum an area 10 feet beyond the location in which visible debris was
found in two directions each at right angles to the other.
B. HEPA vacuum surfaces in the room starting at the top of wall and working
downward to the floor. Then start at corner of floor farthest from Work Area
entrance and work towards entrance.
C. HEPA vacuum the floor using a floor attachment with rubber floor seals and
adjustable floor to attachment height. Vacuum the floor in parallel passes with each
pass overlapping the previous by one-half the width of the floor attachment. At the
completion of one cleaning vacuum the floor a second time at right angles to the
first.
3.09 CLEANING AND DECONTAMINATION OBJECTS
A. Perform all work of decontaminating objects wherever possible on a plastic drop
sheet.
B. HEPA vacuum all surfaces of object and immediate area before moving the object.
C. Pick-up object, if possible, and HEPA vacuum all surfaces.
D. Hand to worker who shall wet-clean object, if possible, and place in storage
location.
E. Decontaminate area where object was located by HEPA vacuuming twice, in two
perpendicular directions. Wet clean if necessary to remove any debris.
3.10 WASTE DISPOSAL
A. All asbestos containing materials and associated debris associated with this
project shall be disposed in an EPA approved asbestos landfill. Any vehicle used
to transport asbestos waste from the facility shall be properly labeled in
accordance with the Department of Transportation and maintain a copy of a bill of
laden indicating the quantity and contents.
1. Completely seal all asbestos containing and asbestos-contaminated
materials in double 6-mil thick plastic bags. Use drums for waste that may
potentially puncture plastic wrap.

2. Keep all waste sufficiently wet within containers.
3. Evacuate bags with HEPA vacuum before sealing.
4. Label all asbestos bags or drums in accordance with NESHAP and include
the generator, address, date and the name and address of the abatement
personnel. The asbestos abatement contractor is responsible for providing
a secure locked dumpster/trailer on site for the temporary storage of
asbestos waste. Label every bag with appropriate notices as required by
DOT regulations. Notices shall read as follows:

5. In addition, a label listing the building owner, the abatement contractor and
the date of generation shall be securely fixed to each bag.
6. Maintain a log of waste material. Submit copies of the log to the Owner’s
Representative.
7. Transport each bag of material to a secure site for storage.
8. Landfill receipts indicating the asbestos materials have been accepted and
properly deposited in the landfill are to be provided to the Owner’s
Representative within 30 days of shipment.
3.11 AIR MONITORING – INDUSTRIAL HYGIENE LABORATORY SERVICES
A. Not in Contract Sum: This section describes work being performed by the Owner.
This work is not in the Contract Sum.
B. This section describes air monitoring that may be carried out by the owner to verify
that the building beyond the work area and the outside environment remains
uncontaminated. This section also sets forth airborne fiber levels both inside and
outside the work area as action levels, and describes the action required by the
Asbestos Abatement Contractor if an action level is met or exceeded.
1. Air monitoring required by OSHA is work of the Asbestos Abatement
Contractor and is not covered in this section.
2. Work Area Isolation: The purpose of the Owner's air monitoring is to detect
faults in the work area isolation such as:
· Contamination of the building outside of the work area with airborne
asbestos fibers,
· Failure of filtration or rupture in the differential pressure system,
· Contamination of air outside the building envelop airborne asbestos
fibers.
3. Should any of the above occur immediately cease asbestos abatement
activities until the fault is corrected. Do not recommence asbestos removal

work until authorized by the Owner's Asbestos Project Monitor.
4. Work Area Airborne Fiber Count: The Owner may monitor airborne fiber
counts in the Work Area. The purpose of this air monitoring will be to detect
airborne asbestos concentrations that may challenge the ability of the Work
Area isolation procedures to protect the balance of the building or outside
of the building from contamination by airborne fibers.
5. Work area clearance: To determine if the elevated airborne fiber counts
encountered during abatement operations have been reduced to an
acceptable level, the Owner will sample and analyze air per Work Area
Clearance.
6. The Owner may conduct air monitoring throughout the course of the
project.
7. Inside Work Area: Maintain an average airborne count in the Work Area of
less than 0.5 fibers per cubic centimeter. If the fiber counts rise above this
figure for any sample taken, revise work procedures to lower fiber counts.
If the Time Weighted Average (TWA) fiber count for any work shift or 8-
hour period exceeds 0.5 fibers per cubic centimeter, stop all work, leave
Pressure Differential System in operation and notify Owner's Asbestos
Project Monitor. After correcting cause of high fiber levels, do not
recommence work for 24 hours unless otherwise authorized, in writing, by
Owner's Asbestos Project Monitor.
8. If airborne fiber counts exceed 2.0 fibers per cubic centimeter for any period
of time cease all work except corrective action until fiber counts fall below
0.5 fibers per cubic centimeter and notify Owner's Asbestos Project
Monitor. After correcting cause of high fiber levels, do not recommence
work for 24 hours unless otherwise authorized, in writing, by Owner's
Asbestos Project Monitor.
9. Outside Work Area: If any air sample taken outside of the Work Area
exceeds the base line established, immediately and automatically stop all
work except corrective action. The Owner's Asbestos Project Monitor will
investigate the source of the high reading and so notify the Asbestos
Abatement Contractor in writing.
10. If the high reading was the result of a failure of Work Area isolation
measures initiate the following actions:
11. Immediately erect new critical barriers to isolate the affected area from the
balance of the building. Erect Critical Barriers at the next existing structural
isolation of the involved space (e.g. wall, ceiling, floor).
12. Decontaminate the affected area in accordance with Cleaning &
Decontamination Procedures.
13. Require that respiratory protection be worn in affected area until area is
cleared for re-occupancy in accordance with Work Area Clearance.
14. Leave Critical Barriers in place until completion of work and ensure that the
operation of the pressure differential system in the Work Area results in a
flow of air from the balance of the building into the affected area.
15. If the exit from the clean room of the personnel decontamination unit enters
the affected area, establish a decontamination facility consisting of a
Shower Room and Changing Room as set forth in Decontamination Units

at entry point to affected area.
16. After Certification of Visual Inspection in the Work Area remove critical
barriers separating the work area from the affected area. Final air samples
will be taken within the entire area as set forth in Work Area Clearance.
17. Fibers Counted: The following procedure will be used to resolve any
disputes regarding fiber types when a project has been stopped due to
excessive airborne fiber counts.
C. "Airborne Fibers" referred to above include all fibers regardless of composition as
counted by phase contrast microscopy (PCM), unless additional analysis by
transmission or scanning electron microscopy demonstrates that non-asbestos
fibers are being counted. "Airborne Fibers" counted in samples analyzed by
scanning or transmission electron microscopy will be asbestos fibers, greater than
5 microns in length and greater than 0.25 microns in diameter. For purposes of
stop action levels, subsequent to analysis by electron microscopy, the number of
"Airborne Fibers" will be determined by multiplying the number of fibers, regardless
of composition, counted by PCM by a number equal to asbestos fibers counted
divided by all fibers counted in the electron microscopy analysis.
3.12 WORK AREA CLEARANCE
A. Not in Contract Sum: This section describes work being performed by the Owner.
This work is not in the Contract Sum.
B. This Section sets forth required post-abatement airborne asbestos concentrations
in the Work Area and describes testing procedures the Owner will use to measure
these levels.
1. Asbestos Abatement Contractor Release Criteria:
The Asbestos Abatement Work Area is cleared when the Work Area is
visually clean, all surfaces are dry and airborne asbestos structure
concentrations have been reduced to the level specified.
2. Visual Inspection:
Work of this Section will not begin until all surfaces are dry and the visual
inspection is complete. No visible debris will be identified in the regulated
work area.
3. Air Monitoring:
To determine if the elevated airborne asbestos structure concentration
encountered during abatement operations has been reduced to the
specified level, the Industrial Hygiene firm will secure samples and analyze
them according to the following procedures.
a. Aggressive sampling procedures as described below will be
followed.
b. Clearance air samples will be collected and analyzed by phase
contrast microscopy (PCM) according to the EPA post abatement
clearance requirements.
c. Areas that do not comply with clearance requirements as
determined by the Owner’s asbestos project monitor will be re-

cleaned and air test resampled at Contractor’s expense.
d. Work Area Clearance: upon meeting the PCM clearance
requirements the work of Project Decontamination can continue.
e. All Air Samples will be taken using aggressive sampling techniques
as follows:
f. Before sampling pumps are started the exhaust from forced-air
equipment (leaf blower with an approximately 1 horsepower electric
motor) will be swept against all walls, ceilings, floors, ledges and
other surfaces in the room. This procedure will be continued for 5
minutes per 10,000 cubic feet of room volume.
g. Air samples will be collected in areas subject to normal air
circulation away from room corners, obstructed locations, and sites
near windows, doors of vents.

• This wage schedule applies only to the specific project referenced at the top of this page and uniquely identified by the
“Wage Request Number” on all pages of this schedule.
• An Awarding Authority must request an updated wage schedule from the Department of Labor Standards (“DLS”) if it has
not opened bids or selected a contractor within 90 days of the date of issuance of the wage schedule. For CM AT RISK projects
(bid pursuant to G.L. c.149A), the earlier of: (a) the execution date of the GMP Amendment, or (b) the bid for the first
construction scope of work must be within 90-days of the wage schedule issuance date.
• The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149,
§ 27. The wage schedule shall be made a part of the contract awarded for the project. The wage schedule must be posted in a
conspicuous place at the work site for the life of the project in accordance with M.G.L. c. 149 § 27. The wages listed on the
wage schedule must be paid to employees performing construction work on the project whether they are employed by the prime
contractor, a filed sub-bidder, or any sub-contractor.
• All apprentices working on the project are required to be registered with the Massachusetts Department of Labor
Standards, Division of Apprentice Standards (DLS/DAS). Apprentice must keep his/her apprentice identification card on
his/her person during all work hours on the project. An apprentice registered with DAS may be paid the lower apprentice
wage rate at the applicable step as provided on the prevailing wage schedule. Any apprentice not registered with DLS/DAS
regardless of whether or not they are registered with any other federal, state, local, or private agency must be paid the
journeyworker's rate for the trade.
• The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction
projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule.
Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the
contract was executed by the awarding authority and the general contractor. For multi-year CM AT RISK projects, awarding
authority must request an annual update no later than two weeks before the anniversary date, determined as the earlier of: (a)
the execution date of the GMP Amendment, or (b) the execution date of the first amendment to permit procurement of
construction services. Contractors are required to obtain the wage schedules from awarding authorities, and to pay no less than
these rates to covered workers. The annual update requirement is not applicable to 27F “rental of equipment” contracts.
• Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll
reports and a Statement of Compliance directly to the awarding authority by mail or email and keep them on file for three years.
Each weekly payroll report must contain: the employee’s name, address, occupational classification, hours worked, and wages
paid. Do not submit weekly payroll reports to DLS. A sample of a payroll reporting form may be obtained at
http://www.mass.gov/dols/pw.
• Contractors with questions about the wage rates or classifications included on the wage schedule have an affirmative
obligation to inquire with DLS at (617) 626-6953.
• Employees not receiving the prevailing wage rate set forth on the wage schedule may report the violation to the Fair Labor
Division of the office of the Attorney General at (617) 727-3465.
• Failure of a contractor or subcontractor to pay the prevailing wage rates listed on the wage schedule to all employees who
perform construction work on the project is a violation of the law and subjects the contractor or subcontractor to civil and
criminal penalties.

Minimum wage rates for apprentices employed on public works projects are listed above as a percentage of the pre-determined hourly wage rate established by the
Commissioner under the provisions of the M.G.L. c. 149, ss. 26-27D. Apprentice ratios are established by the Division of Apprenticeship Training pursuant to M.G.L.
c. 23, ss. 11E-11L.
All apprentices must be registered with the Division of Apprenticeship Training in accordance with M.G.L. c. 23, ss. 11E-11L.
All steps are six months (1000 hours.)
Ratios are expressed in allowable number of apprentices to journeymen or fraction thereof, unless otherwise specified.
