I live at 10 Damon Road, across the street from the Pride Convenience Store at the corner of King and Damon. Ever since early last year when the Pride station remodeled and began staying open 24 hours, there has been nothing but problems...NOISE problems! Virtually every night, there are either groups of people gathering outside to "BS" with the clerks, or"customers" (not paying customers...just obvious buddies of the clerks) leaving their cars running while their stereos are blasting at window rattling volume. And as if that's not enough, we're also routinely bombarded by workers yelling to one another while they empty trash cans, BAMMING the lids on the ground as they go; and clerks yelling to each delivery truck that comes in, carrying on a hollering conversation as if they were in different sections of a football stadium. We are woken up at all hours of the night, almost EVERY night. And I mean ALL hours: 12:10AM, 1:15AM, 1:30AM, 2:10AM, 2:30AM, 3:15AM, 4:00AM...any and all hours and sometimes more than once a night. THIS morning, for example, I was bolted out of a sound sleep at 2:55AM by some idiots blasting their stereo from a car parked directly in front of Pride. Who was out there but a clerk from the store (in short sleeves, nonetheless, with the outside temp around 18-20°) and some other punks from other cars all standing around the guy's open trunk to admire his stereo system and how LOUD he can make it. I called the cops but they took longer than usual to arrive and the punks had already left just moments earlier. It's just a regular hangout for brainless, irresponsible bums who haven't the slightest regard for the peace and quiet of the area. They couldn't care less! There's a Dunkin' Donuts store within the building and THEIR clerks are often involved as well, meeting with their friends outside to carry on a long, LOUD gab session or to admire LOUD stereos. The owner of Pride as well as the managers have been told about this problem several times, but they simply brush it off with empty promises of doing something about it. One obvious solution, at least a partial one, would be to fire the clerks involved and hire people who are mature enough, responsible enough, and intelligent enough to obey the laws of the community; or at least give them an extremely strong warning that these actions won't be tolerated. But apparently neither of these has been done, because many, many times it's the same cars that are gathered out front at their favorite hangout. A . "Hey,with any brains would say: turn off that noise...there are people living around here!" Or just tell them to be quiet in general. BUT NO...they only go outside to JOIN IN on the noise! They don't give a damn — THEY'RE THE INSTIGATORS, THEY'RE THE RINGLEADERS, THEY are the reason for the gatherings. If the workers/clerks were made to cease these actions, probably a large part of the problem would be solved, but the problem just goes on and on and on. This noise, in fact, has gone on all SUMMER and I thought that at least it might subside during winter when the weather is too cold to stand around outside. Not so. It can be even in the teens or single digits, and the bastards are still out there, yelling and laughing as if at a pep rally having absolutely no respect for residents living in the area. The police have been called on many occasions; their response is usually quick, but they only come by to break up the gang and then a "different" noise starts again later. Maria Tymoczko, City Councilor for Ward 3, was the one who advised me to contact you. She also told me that there is a city ordinance against loud noise during the hours of 10:00PM to 7:00AM. This ordinance is continuously violated at that Pride station and something needs to be done, and done SOON! We would very much appreciate your help in this matter and any advice on what legal actions can be taken. I don't know if lawsuits are appropriate in this case, since there is already an existing law, but if I have to, I would be only too happy to take it to court. I note that his letter is dated January 6t'. Before even getting into this problem I note that your fax says: "as complaints keep coming in"which implies that you have had other complaints and yet this is the first that we hear from either you or Mr. Karakula. Second, Mr. Karakula states"the owner of Pride .... has been told" and this is totally untrue as I am the owner of Pride and Mr.Karakula has never contacted me. I am at work from 7:00 AM to 6:00 PM daily and my policy is to take all complaint calls personally so it cannot be that someone is handling these calls for me. We also have complaint forms at the location which Mr. Karakula could have filled out and my home phone number is even listed on that form. He never filled out any complaint forms either. I have spoken with our manager at that location(who has been the manager since January 2000), and she told me three things: 1. That Mr. Karakula did complain to her and she told him to call her at home, even in the middle of the night,the next time it happened and she would personally take care of it. He never called. 2. One of the times that Mr.Karakula did complain to her she pointed out to him that the noise was not coming from our store or our customers but in fact from a Rave concert that was going on nearby at Hampshire Heights. We should not be held responsible for this. . 3. Our manager states that in most cases the customers with loud music are young adults driving around(probably from the Hampshire Heights area) with their radios blaring anyway, and they only stop at our store to buy something but not to hang around. We may have had an employee at one time who was friendly with them and they hung around longer but that is not the case now. Also, such employees usually do not last long working for Dunkin Donuts and therefore this is not a continuing problem. Regarding the employees of the Dunkin Donuts operation at that facility, it is run by the local franchise operator and I will bring this problem to his attention immediately. In this extremely tight labor market he too is sometimes forced to hire less mature employees but he does work very hard to ensure that they act responsibly at all times. As for the future, now that we know of this problem,we will certainly deal with it with our employees immediately. By copy of this letter to Mr. Karakula and to Councillor Tymoczko I encourage them to call me at the office anytime during the work day or at my home anytime evenings or weekends. I would also ask that they call me during the night at home every time that they have a problem so that I may resolve it. This way we will also have a record of whenever it happens. As you know we work very hard at all times and in all ways to operate a clean professional business. I encourage everyone to bring such matters to my attention immediately from now on because we do not want any neighbors upset at any time. I'll respond to and clarify some specific key points: Reference # 1 : The letter states: I note that his letter is dated January 6th. My response: I fail to see what bearing this statement has on anything. I wrote the letter on January 6th after seeing that no action was being taken on the part of any of the supervisors/managers at Pride. I don't know why there was such a long delay in getting the information to the storeowner— I assume that you responded to it when it came up on your agenda. The statement, however, is irrelevant since this noise problem has been going on since early last year, as I had stated. Reference # 2: The letter states: "as complaints keep coming in". My response: I don't know what, if any, complaints have been made by other neighbors, but IF there are any more, they will most likely be from ME since I am directly on the "front line" of all the "attacks". A complaint is a complaint. Must it come from multiple sources? Reference # 3: The letter states: ...Mr. Karakula states "the owner of Pride...has been told" and this is totally untrue as I am the owner of Pride and Mr. Karakula has never contacted me. My response: I never said that I had contacted him. I said he "had been told." My mother is the one who has made many complaints to the manager(s) at Pride, going back to mid-2000, and on these occasions she has told them of the noise, of the calls to the police, etc. She was usually met with a response such as "we'll look into it." I am assuming that problems that are told to the manager are in turn brought up with the owner, but I saw no changes that would indicate that anyone had done anything. On December 12th, 2000, my mother spoke to a gentleman at Pride who appeared to be in charge and asked: "Are you the boss?" He said: "Yes." She told him of the continuing problems,just as she had told the other managers, and he said he would take action on it and that he would put up a "No Loitering" sign. Was this Mr. Bolduc? I don't know. He did claim to be the boss, and since he said he would put up a sign, then he obviously had the authority to do so. If it was Mr. Bolduc, why does he now say that he didn't know anything about the problem? Was he one of the managers? I don't know. If it was, why didn't he tell Mr. Bolduc of the problem? In any case, whoever it was never did anything, at least nothing visible. To this date, there is no sign up about "No Loitering", "No Loud Noise after Dark", etc, etc. Since there are no visible signs of action, I can only assume that there was no action of any kind. Reference # 4: The letter states: We also have complaint forms at the location. My response: I don't know what location he means: the Pride store on King Street or the Pride central office in Springfield? It seems funny that after the numerous complaints that my mother has made to the manager, not once has she been given a complaint form to fill out. The manager simply says something like: Oh, they'll take care of it. Reference # 5: The letter states: ...Mr. Karakula did complain to her [i.e., the manager] and she told him to call her at home...He never called. My response: This is a lie! I have NEVER spoken to ANY manager at Pride. In fact, in the past 2-1/2 years that I've been here, I've been in the Pride store ONCE, and that was to make a few copies. I don't do business there; I do not want to do business there. I don't want to give any business to a store which has given me nothing but headaches, anger, high blood pressure, NOISE, and countless sleepless nights! No, I never called her because I was never given her number and, I repeat, have NEVER spoken to her. In fact, you'll notice that her number was not given to me in the letter, either. Reference # 6: The letter states: One of the times that Mr. Karakula did complain to her she pointed out to him that the noise was not coming from our store or our customers but in fact from a Rave concert that was going on nearby at Hampshire Heights. My response: To say that this is a blatant, bald-faced lie would be a gross understatement. It can more aptly be called: "100% PURE BULLSHIT!!!" First of all, let me repeat, again: she has NEVER SPOKEN TO ME, and has thus NEVER told me about some concert or anything else. Secondly, I know the G--D--- difference between the noise coming from a gang of punks that I'm looking right at in the Pride yard and the noise coming from a concert a quarter mile-or-so away at Hampshire Heights. Thirdly, Hampshire Heights has never been a problem. And lastly, if a concert did occur, I assume it would be on one night! I'm talking noise, noise, noise, over a period of many months, since early last year. This is simply a very vain attempt to try to pass the blame onto someone else. That statement in the letter is the biggest lie yet!! Reference # 7: The letter states: ...they only stop at our store to buy something but not to hang around. My response: WRONG! When a person or persons stop to buy something, as he says, I believe that the procedure goes something like: go into store, pick out the item, pay the clerk, leave the store, drive or walk away. When the procedure changes to: go into store, pick out the item, pay the clerk who then goes outside with them to join the other so-called "customers" to laugh loudly, holler, joke, yell, play blaring stereos which they proudly show-off to their friends on how loud they will go, and stay for 15, 20, 30 minutes or more, that becomes loitering, that becomes "hanging around", that becomes NOISE, that becomes a violation of community laws and standards. Reference # 8: The letter states: call me...at my home anytime evenings or weekends. My response: I am encouraged by this statement, but as with the manager, Mr. Bolduc didn't give his home number. Now that I have set the record straight, I would like to say that I very much appreciate and am optimistic about Mr. Bolduc's closing remarks in which he states "we will certainly deal with [the problem]" and "we do not want any neighbors upset at any time." Before receiving the correspondence from Tony Patillo, Ronald Karakula, and yourself, the Police Committee had a general discussion concerning noise in the city as a whole, particularly noise associated with sound systems in vehicles. Although such noise has caused problems in a variety of other districts of the city, difficulties caused to residents living near your facilities by patrons of your service station were mentioned as a specific instance that should be addressed. We have heard complaints that late at night--after 10 p.m. when by ordinance things are to be quiet in the city-- people drive into your establishment and park for indeterminate amounts of time with loud stereo systems "blast- ing". No doubt your customers do not realize that there are houses nearby or that there are city ordinances requir- ing quiet. We would like to ask you to post notices requesting that sound systems be turned off after 10 p.m and to train your employees on the night shift to request that customers turn off their sound systems when they are on your premises, however briefly, in the late evening and during the night. We appreciate being copied into the correspondence that you have had with others on this matter. We also appreciate the resolve you show to attend to this problem, and we are confident that you will back up these cooperative intentions with actions that will achieve lasting solutions to the issues before us. I am again writing about noise at King and Damon, again the result of Pride Convenience Store being open all night. Although not directly their fault, they are certainly the cause, as if we don't have enough noise from Pride already. Beginning about the middle of August, it seems every semi-tractor trailer traveling down I-91 has gotten the word that Pride has a donut store. Let me be blunt: EVERY GODDAMN NIGHT, we are bombarded by trucks that have made D'Angelo's Sandwich Shop parking lot their own personal truck stop. Anytime and ALL times between 10:30 at night to 5:00 in the morning they pull in there, leave their engines clattering (often with the accompanying high squeal of refrigeration units) for 10-15 minutes at a time while they go to Pride to get their coffee and donuts. There have been as many as FIVE at a time, most often TWO or THREE —when they leave, more come. It's their hangout now— as they exit the trucks, there is of course the door slamming and then the usual hollering and yelling as they meet to cross the street, and then hollering and yelling as they return. In fact, they often blast the horns to one another as they come off I-91 to announce their arrival to the others. We are DAMN SICK AND TIRED of it. When they leave, they swing around by Pride and go down Damon Road probably getting back onto I-91. EVERY DAMN NIGHT getting woken up at 2:30 or 2:45 or 3:00 or 3:25 or 4:30 or ALL of the above. We have called the cops at least EIGHT times. Out of those EIGHT times, they came over maybe three or four— sometimes they come after about 15 or 20 minutes — after the first bunch leaves; sometimes they don't come at all!! When they do show up, they talk to them and they leave, but then 10 minutes later MORE show up. I spoke to Lt. Rogowski of the Northampton Police Dept. on August 27th. He said he would increase surveillance of the area. I think that he did, but that only lasted perhaps a few days or a week. When we called last night, we got the excuse: "Oh, that's commercial property, so they have a right to park there." So does that mean they can park in our yard or on our lawn? Does that mean they can fill up the insurance yard across the street with trucks? They can park any blasted place they want?? So now, instead of taking care of the problem, the police are making excuses for them! Does that mean they can park all along King Street? In fact, one parked on Damon Road this morning with his engine running for about 10 minutes just east of our driveway while he apparently ran in to Pride! The first thing I did when all this started was to contact D'Angelo's. Their manager brought it up to the district manager, and the district manager couldn't care less. They refused to block the entrance, they refused to put up a sign, they refused to DO ANYTHING!! They don't want to block the entrance because of the ATM. I don't know how many people rush over at 3:00 in the morning to use the ATM, but there are THREE damn entrances to that parking lot! Blocking the ONE that the trucks enter all the time would probably do a lot to stop the trucks from making it a convenient drive-through, but NO—they can't even do that. I don't know how these trucks have a right to make a truck stop out of any place they please, but WE don't have the right to a GODDAMN decent night's sleep. The owners of the lot won't do anything, the police seem to be backing out of this, so now I'm approaching the city. If YOU won't do anything, I'll have to do something MYSELF!!!
