Permission is granted to make an opening of minimal width in the southbound vegetated shoulder of Route 10 in order to install a water service to the proposed storage facility (Parcel #44-031-001). Permission is not granted to make an opening in the hardened surface of Route 10. The Grantee is advised that there are potentially multiple underground utilities within this area. Prior to starting any work under this permit, the Grantee shall be responsible for investigating and locating all underground facilities in the vicinity of the proposed work. All shoulder areas, paved areas, sidewalk, grass areas, driveway and street aprons, drainage lines and structures, granite curbing, edging, guardrail, retaining walls, pavement markings, or other highway appurtenances that are disturbed due to the construction work shall be replaced and/or restored to original or better condition. Any disturbed area shall be replaced in kind, e.g., loamed, fertilized, limed and seeded, bituminous concrete, gravel, etc. All repairs shall be neat, uniform, and conform to the existing grade. Any ponding of water, which may occur in this area as a result of the work herein described,shall be the responsibility of the Grantee. No trees shall be removed nor shall any roots be cut. The Grantee shall utilize mechanical sweepers, water, calcium chloride or bitumen and sand, in accordance with Section 440, Roadway Dust Control, of the 1988MassHighwayDepartment'sStandardSpecifications for High ways and Bridges, as amended. If the Director deems it necessary, an inspector shall be assigned to the work and the cost of said inspector shall be charged to the Grantee. All work shall be done in a professional manner. If in the opinion of the District Highway Director the work was not done in a satisfactory manner, the Grantee shall return to the area in question and perform the necessary work,as directed by the Director. Adequate warning signs, traffic cones and other traffic control devices must be erected in accordance with the Manua/on Uniform Trak Control Devices X2009 Edition/, as amended, which can be found at http//mutcd.fhwa.dot.gov, and in accordance with the Road Flagger& Police Regulations 701 CMR 7.00. Signs and sign supports located on or near the traveled way must pass the criteria set forth in the NCHRP 350 Report. Said devices shall be placed and replaced by the Grantee at the work site as required. Reflectorized plastic drums shall be used in the highway work zones; the use of metal drums is not allowed. Adequate lights, signs and barriers shall be provided by the Grantee. All personnel working within the State Highway Layout shall wear approved safety vests and hard hats. Uniformed police shall be in attendance at the expense of the Grantee. Traffic shall be maintained at all times. No equipment or personnel shall occupy any portion of the State Highway Layout except between the hours of 9:00 A.M. and 3:30 P.M. Monday through Friday. Saturday and Sunday work is not allowed under the terms of this permit. Work will not be allowed the day before or the day after a long weekend, which involves a holiday,without prior approval of the Director. No work shall be performed under this permit during periods of inclement weather to ensure MassDOT Snow and Ice operations are not impeded. As detailed in the MassDOT, Highway Division, Uti/ityAccommodationPolicy on State HighwayRightof Way, except in the case of emergency repairs, highway surface openings are prohibited between November 15 and April 1. DIG SAFE NUMBER: Prior to the start of any work under this permit, the Grantee shall notify the Public Utility Underground Plant Damage Prevention System (DIG SAFE),which can be found at www.digsafe.com or by calling 1-888-3447233. Upon issuance of the DIG SAFE NUMBER the Grantee shall forward said number to the MassDOT Highway Division, District Two Office by calling (413) 582-0599. Page#2 Permit#2-2019-0108 All utility companies whose services are located within or adjacent to the proposed work areas shall be notified in writing of the proposed work at least 48 hours prior to the start of any excavation in said areas. This is independent of required Dig Safe notification. The Grantee shall procure all permits, licenses, required easements and give all notices necessary and incidental to the due and lawful prosecution of the work (including Conservation Commissions, Tree Wardens, etc.). All work proposed and materials used shall conform to MassDOT's 1988Standard Specifications for HighwaysandBridges, with the current SUPPLEMENTAL SPECIFICATIONS, and MassDOT's, 1996 Metric Edition of the Construction and Traffic Standard Detai/s, along with the 1977 Massachusetts Department ofPublic Works Construction Standards, with the current METRIC/ENGLISH SUPPLEMENTAL DRAWINGS, as amended. The Grantee shall also adhere to the Massachusetts Highway Department Project Development and Desi gn Guide. Backfill and gravel material shall meet the requirements of Section 100 of the 1988 MassHighwayDepartment'-Standard Spe6ficationsfor Highwaysand Bridges, as amended. Backfill shall be placed in successive layers not more than b inches in depth, uniformly distributed,and each layer thoroughly compacted. All Bituminous Concrete shall be Hot Mix Asphalt Pavement and shall meet the requirements of Section 400. Grading, Fine Grading and all other work shall be in accordance with the appropriate Section(s). All material necessary for the restoration of the highway (including but not limited to Hot Mix Asphalt Pavement, Cement Concrete Masonry; Control Density Fill;stone; gravel; backfill materials; etc.) shall be furnished by a MassDOT Certified Supplier. The Grantee must adhere to 520 CMR 14.00: EXCAVATION AND TRENCH SAFETY as promulgated by the Department of Public Safety in conjunction with the Division of Occupational Safety pursuant to authority granted by M.G.L. c. 82A § 1. The shoring and bracing of trenches along with other related excavations shall conform to the applicable rules and regulations of the Commonwealth of Massachusetts Division of Industrial Safety and the U.S. Department of Labor, Occupational Safety and Health Administration. Trench walls shall be shored, braced, or tapered as necessary in order to maintain the integrity of the highway. Attention is called to the clauses on the back of this permit pertaining to the laying of pipes, etc. MassDOT Highway Bounds shall not be disturbed. In the event any bounds are disturbed, they shall be located by a Registered Civil Engineer or Land Surveyor using MassDOT Layout Plans and reset according to the current MassDOT standards. An as-built sketch, including proper bearings of the reset bound,shall be submitted to the District Highway Director. All expense shall be borne by the Grantee. Page#3 Permit#2-2019-0108 The rights granted under this permit are contingent upon strict adherence to: MGL c. 131, s.40 (Wetland Protection Act- WPA) and its implementing regulations 310 CMR 10.00; and M.G.L c.131A (Massachusetts Endangered Species Act- MESA) and its implementing regulations 321 CMR 10.00. The Grantee shall ensure that all work is done in accordance with the policies and procedures of the WPA and MESA Regulations. As required, erosion controls shall be installed in accordance with Part III (Erosion and Sediment Control Practices) of the Massachusetts Department of Environmental Protection Erosion and Sediment Control Guidelines for Urban and Suburban Areas. Failure to comply with the terms of this Permit,past and future directives from MassDOT, or any other local, state,or federal regulatory agencies, shall be cause for immediate revocation, and may be cause for denial of future permits. The Grantee shall indemnify and save blameless the Commonwealth and its MassDOT Highway Division, against all suits, claims or liability of every name and nature arising at any time out or in consequence of the acts of the Grantee in the performance of the work covered by this permit whether by themselves or their employees or subcontractors. A copy of this Permit must be on the job site at all times for inspection. Failure to have this Permit available at such site will result in suspension of the rights granted by the Permit The Grantee's attention is directed to the requirement of Chapter 228 of the Acts of 1972 concerning excavation. Interim District Highway Director EJE/-1i� C-TEB Page#4 "FOLLOWING CONDITIONS APPLY TO PERMITS- Conditions Relating Particularly to Permits for the Laying of Pipes,Conduits,etc. After any pipes,conduits,drains or other underground structures are laird,or any excavation is made in the roadway,the trenches or openings shall be properly backfilled with suitable material,the back-filling shall be thoroughly tamped,and the surface of the road over said structures shall be left even with the adjoining ground. If the work is done in cold weather no frozen material shall be used for back-filling. Wherever the hardened surface of the roadway,gutters,or any part of the surface of the highway is disturbed it shall be replaced in as good condition as before it was disturbed,and if new materials are required they shall correspond with those already in place on the road. Where service pipes are to cross the highway the connections shall be made without disturbing the hardened surface of the roadway, by driving the pipes under the roadway,or the service pipes shall be carried under and across the road in a larger pipe,unless otherwise ordered by the Director. The Grantee shall maintain the surface of the roadway over said structures as long as MassDOT may deem necessary,until all signs of the trenches shall have been eliminated. Conditions Relating Particularly to Permits for the Erection of Poles.Wires,and Overhead Structures,and the Cutting and Trimming of Trees In the erection of pole lines,unless otherwise herein provided,no trees located within the limits of the State Highway shall be cut or trimmed. No guy wires shall be attached to trees without a special permit from MassDOT,and in no event shall they be so attached as to girdle the trees or in any way interfere with their growth. The wires shall be so protected at all times and placed such that they shall not interfere with or injure the trees either inside or outside the location of the highway. Where the cutting or trimming of trees is authorized by this permit.only such cutting and trimming shall be done as may be designated by the Director. In the construction or reconstruction of pole lines no guy wires shall be erected nearer to the surface of the ground than six feet; provided,however,that the owners of such lines may maintain such guy wires at a lower elevation than six feet from the ground until such time as MassDOT shall notify them to remove said wires or to the elevation first stated. In order to protect the trees through which any wires may pass,said wires shall be insulated and such other tree guards used as may be directed by the Director. Where high tension wires are erected under this permit,they shall be so located that,under conditions of maximum severity as regards a coating of ice or snow,there shall be a space of at least eight feet between such high tension wires and other wires. The Grantee shall,within sixty days from the date of completion of the work file in the office of MassDOT a plan showing the location of each pole erected in accordance with the permit,said plan to be of such size and in such form as MassDOT may direct General and Additional Conditions Whenever the word'MassDOT"is used herein it shall mean the Massachusetts Department of Transportation of the Commonwealth of Massachusetts. Whenever the word "Director' is used herein it shall mean the District Highway Director or other authorized representative of MassDOT. Whenever the word"Grantee'is used herein it shall mean the person or persons,corporation or municipality to whom this permit is granted,or their legal representatives. During the progress of the work all structures under ground and above ground shall be properly protected from damage or injury, such barriers shall be erected and maintained as may be necessary for the protection of the traveling public; the same shall be properly lighted at night;and the Grantee shall be responsible for the damages to persons or property due to or resulting from any work done under this permit. Except as herein authorized,no excavation shall be made or obstacle placed within the limits of the State highways in such a manner as to interfere unnecessarily with the travel over said road. If any grading of sidewalk work done under this permit interferes with the drainage of the State highway in any way,such catch basins and outlets shall be constructed as may be necessary, in the opinion of the Director,to take proper care of such drainage. Wherever the hardened surface of the roadway is disturbed and the Director may consider it necessary or advisable to do so,said surface will be restored by the employees of MassDOT,at such time as MassDOT may direct and the expense thereof shall be bome by the Grantee, who shall purchase and deliver on the road the materials necessary for said work if and when directed by the Director. All payments to the supplier and to laborers,inspectors,etc.,employed by MassDOT for or on account of the work herein contemplated shall be made by said Grantee forthwith on receipt of written orders,pay rolls,or vouchers approved by MassDOT. IF THE GRANTEE DOES ANY WORK CONTRARY TO THE ORDERS OF THE DIRECTOR,AND,AFTER DUE NOTICE,FAILS TO CORRECT SUCH WORK OR TO REMOVE STRUCTURES OR MATERIALS ORDERED TO BE REMOVED,OR FAILS TO COMPLETE WITHIN THE SPECIFIED TIME THE WORK AUTHORIZED BY THIS PERMIT,MASSDOT MAY,WITH OR WITHOUT NOTICE,CORRECT OR COMPLETE SUCH WORK IN WHOLE OR IN PART, OR REMOVE SUCH STRUCTURES OR MATERIALS, AND THE GRANTEE SHALL REIMBURSE MASSDOT FOR ANY EXPENSE INCURRED IN CORRECTING AND/OR COMPLETING THE WORK OR REMOVING THE STRUCTURES OR MATERIALS. ALL OF THE WORK HEREIN CONTEMPLATED SHALL BE DONE UNDER THE SUPERVISION AND TO THE SATISFACTION OF THE MASSACHUSETTS DEPARTMENT OF TRANSPORTATION,AND THE ENTIRE EXPENSE THEREOF SHALL BE BORNE BY THE GRANTEE. On the completion of the work herein contemplated all rubbish and debris shall be removed and the roadway and roadsides shall be left neat and presentable and satisfactory to the Director. MassDOT hereby reserves the right to order the change of location or the removal of any structure or structures authorized by this permit at any time, said change or removal to be made by and at the expense of the Grantee or its/their successors or assigns. This permit may be modified or revoked at any time by MassDOT without rendering said MassDOT or the Commonwealth of Massachusetts liable in any way. The Grantee shall pay the salary,subsistence and travel expenses of any inspector appointed by MassDOT to supervise the work herein contemplated. All of the above conditions shall be applicable to the work herein authorized,unless the same are inconsistent with the conditions on the face of the permit in which case the conditions written or printed on the face of the permit shall apply.
