Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. The findings were as follows: 1. The applicant requested a variance for an addition to an existing building on the land. The addition is conforming in the rear, but as it moves forward it falls below the 20 ' setback level and reaches a 16 ' setback level. The majority of the addition would conform to the setback requirement. 2 . The applicant meets the criteria for soil conditions, shape or topography of the land because the shape, angle, and different grades of the lot causes a topographical problem. The lot is unusual in terms of shape and grade and thus the applicant does not meet the required setback requirements for the addition. The peculiarities in the applicant' s lot size do not affect any other lots in the neighborhood. PAGE 1 � 7 ' 3 . The applicant meets the hardship criteria because the bedroom addition will allow the applicant to provide housing for her elderly, infirm uncle. Granting a variance to allow for a bedroom addition for her uncle will relieve the applicant of the hardship of having to drive back and forth to Worcester several times a week to care for him. 4 . The requested bedroom addition will not be a substantial detriment to the public good because the encroachment to the setback requirement is only 4 ' . The abutting neighbors have expressed their support for the proposed addition. Other properties in the neighborhood have structures that are not close to the applicant' s. The addition will not create any traffic problems, nor will it create any burdens on the public water/sewer systems. The variance will not substantially diminish the intent and purpose of the ordinance. The Northampton Zoning Board of Appeals hereby certifies that a variance has been approved and that copies of this decision and all plans referred to in it have been filed with the Planning Board and the City Clerk. Present and voting were Chairman Robert C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr. The findings were as follows: 1. The Board found no unique circumstances relating to the soil conditions or topography. 2 . The Board did not find any substantial hardship, financial or otherwise because the garage/bedroom addition would be a convenience to the family and did not meet the hardship criteria. 3 . The Board found that the request, if granted, would be a detriment to the public good because it would substantially encroach on the setback requirements as outlined in the zoning ordinance.
