I received a call from our fire department after they had gotten a call from an employee of Motherwear at 320 Riverside Drive. The employee was concerned because she had heard that two of the exits from their warehouse space to the adjoining hallway were going to be blocked. The fire safety officer visited the building, observed some construction work and did not see a building permit. I did a site visit on September 9, 2006. The work being done did not require a permit. It was limited to refinishing one of the offices in Mr. Cummings' portion of the building. The worker on site did confirm that the building's owners were contemplating more extensive work, including blocking off two of the doors between the two portions of the building. Those doors presently serve as one of the two required means of egress from the Motherwear warehouse spaces. I sent an email (below) and letters (attached)to the two owners of the building. I reminded them that permits are required for any work beyond ordinary repairs, and told them that the building is subject to construction control because of its size and use classification (116.1). 1 expressed my concerns about changes to the means of egress from the Motherwear space based present uses and configuration. We subsequently received a building permit application for that building. The proposed work included renovations to the office space in Mr. Cummings' portion of the building, but did not address the doors in question. The application included sketch plans from an architect but did not include construction control certification, nor did it include a fire narrative. I contacted the contractor and asked for the certification and the fire narrative. The contractor has since withdrawn the permit application. 1 believe that the wall separating the two portions of the building was originally constructed as a fire separation assembly. It is of masonry construction and the openings into a freight elevator shaft are protected by steel clad self-closing doors. Over time, however, there have been any number of openings and penetrations, and it no longer meets the requirements for a fire separation assembly. Lacking an intact fire separation, I believe that the property must be considered as a whole, rather than two separate fire areas. Our position is that any changes to means of egress by Mr. Cummings must not result in a hazardous situation for the occupants of the Motherwear space. We will require that plans show adequate means of egress before we issue a building permit. Those means of egress do not need to be through the dividing wall but they must comply with code. I will also forward to you the email responses I received from the owners of the property(Mr. Verson and Mr. Cummings). We need to do this for security purposes with our tenant Tapestry Health who is now leasing the space on the first floor. We simply need to have a separation from our building and the warehouse space, without that Motherwear employees would have open access into our building. She advises that it is permissible, and actually advisable to return the wall separating your building from Alan's to its original function as a fire separation. That would involve closing off the doorways and patching other noncompliant openings. Since there is not, at present, an intact fire separation between the buildings, we agree that I must consider the two parts as a single, unseparated building and any plans must reflect that situation. She and I agree that work of this nature will require the oversight of an architect or a qualified engineer and that the plans must address fire protection, means of egress and life safety concerns on both sides of the wall. I understand that this will require Mr. Verson's participation in this project. I realize that Alan is not interested in any involvement at this time. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. The owner of the property described in this Order must advise any potential buyer of the property that any construction or alteration to said property, including brush cutting or clearance,may require approval by the Northampton Conservation Commission. Any instrument conveying any or all of the owners'interest in said property or any portion thereof, shall contain language similar to the following: "This property is subject to the Northampton Wetlands Protection Ordinance and/or Wetlands Protection Act. Any construction or maintenance work performed on this property requires an Order of Conditions, and/or a Determination of Applicability from the Northampton Conservation Commission. 19. A copy of this Order and associated plans shall remain on site during all construction and/or building activities. The project manager and all equipment operators shall be familiar with the approved plans, and shall be informed of their location on the site. This location shall be accessible to all contractors whenever work is occurring on site. 20. All required permits must be obtained from the Army Corp of Engineers (Section 404, Water Quality Certification), Planning Board, Zoning Board, Department of Public Works, or Building Inspector prior to the start of projects involving fill within any wetland resource area; 21. No disposal of soils or other materials shall be allowed within: a 100-year floodplain; 40 feet of the 100-year floodplain elevation; any wetland; or any area within 100-feet of a wetland, unless such areas are specifically approved by the Commission, in accordance with 310 CMR 10.00, and City of Northampton Ordinances - Chapter 24; 22. All revised plans, referenced within this Order of Conditions, shall be approved by the Conservation Commission and incorporated into this Order by reference and shall be followed during the course of construction. 23. Prior to the start of any site work, excavation or construction, a pre-construction conference shall be held on the site,between the contractor conducting the work, the site/project engineer, the applicant, and a member or agent of the Conservation Commission, in order to ensure that the requirements of this Order are understood by all parties. Prior tp the pre-construction meeting, all erosion control devices must be installed. 25. Silt fencing sh�ll be installed along the entire work area, on the Mill River side. 26. All work shall Ibe done under the super vision of a Licensed Site Professional who shall have been approved by the Commission. 27. Wetland restoration shall be done under the supervision of a wetland scientist who shall have been approved by the Commission. CLEAN-UP BEYOND LIMIT OF WORK: 28. Any foreign material located on the surface of the ground beyond the limit of work, shall be removed by hand or pulled out with the use of chains. No heavy equipment shall be allowed beyond the Limit of Work or downgradient of the line, unless activity in this area has been permitted under this Order of Conditions. POST CONSTRUCTION SUBMITTALS &WORK IN BUFFER ZONE: 29. Wetland Restoration shall be monitored for 3 years, with annual reports submitted to the Commission. 30. If more than 50% coverage of wetland vegetation has not been established after one growing season (1 year), then additional plantings and/or changes to the wetland restoration plan shall be submitted to the Conservation Commission for consideration and approval. 31. If after the third growing season(3 years) less than 85% coverage of vegetation has been established, additional plantings and/or changes to the restoration plan shall be submitted to the Commission for consideration and approval. 32. Upon completion of the project, the Applicant shall submit a certification that all work has been done in conformance with the provisions of the Order of Conditions and request a Certificate of Compliance. Certification shall be by a Licensed Site Professional who shall have been approved by the Commission. Certification of wetland restoration shall be by a wetland scientist approved by the Commission. 33. The work in the Amendment to the Notice of Intent, dated June 08, 2006/May 11, 2006 must be completed by September 01,2006 34. Before the expiration of the Order of Conditions permit#246-546, the stockpile of contaminated material (material buried under the plastic) on the raceway must be removed from the site or incorporated into the site in accordance with the conditions issued in the original permit. 35. After the completion of the work noted in the Amended Notice of Intent, but before November 01, 2006 all slopes must be stabilized using phytoremediaton techniques or coir netting and native seed mix. 36. Erosion control devices and orange hazard fences must be in excellent working condition, as shown on the plan details, and must be inspected monthly. Once a year, by October 1St, monthly inspection reports must be submitted to the Northampton Conservation Commission.
