There are 2 aspects of the question; zoning and building code. Both would see it as a separate dwelling unit based on
definitions of a dwelling unit in either.The building code requires fire separation, 2 means of egress and has specific
smoke/co/heat detector requirements.As drawn, it wouldn't meet building code requirements because there's only one
means of egress that meets code.
If it wasn't part of a development, zoning could allow an accessory apartment, but it is part of a development and the
approval was for a specific number of units.An apartment, accessory or not, is a dwelling unit. They could come back to
the planning board for an amendment to the decision. I don't know what the board would decide. The planning board
would consider the implications; I don't know how many of the planned buildings are single family, but if one single family
house gets an accessory apartment, then all the other single family houses could also have them. I'm thinking 28 units
could become 39 or 40 units.
People don't realize that the houses will be there long after we're all gone and the whole planning process is designed to
make sure the development works both now and in the future.
Beyond that, Mass Development is involved. I have no idea

spoken with you about previously.The Home Owner of Unit 7 wants to add the accessory apartment element to the
basement and originally had plans to add a Full Kitchen.She has now eliminated the stove and venting within that
kitchen, but aside from that has remained the same.
Could you take another look at the attached building plans and the attached rendering of the "Kitchen area" (minus the
Stove)as shown. You see there is still a Kitchen, Dishwasher& Sink.They will use a microwave within the shelving
unit. Would this be acceptable to you and would you grant the Building permit when we submitted it for approval? If
you would not, what further elements would we need to eliminate?
I appreciate you taking another look at this.
