We are building an upper deck which serves as a means of egresss from the back door. This deck will be 4 rises tall (28-30" depending on final grading), will be approximately 12'x 8' and will be attached to the house sill with ledger locks and horizontal tension ties, and will conform to all standard codes, including footings that will extend below the frost line as shown in the accompanying drawings. The second part of the deck will be 2 rises high at its tallest (14-15") and will float on top of a gravel bed over sandy gravelly soil. The ground below has been previously filled with gravel and was previously covered with asphalt. The soil has not heaved or moved in the 5 years we have lived here. The deck will be built to normal codes and hurricane tied to PT beams laid onto hard packed gravel. Ordinarily this deck would not require a waiver, but because it will also serve as the step down from the upper deck and will be a means of egress, we were asked to provide this narrative and to request a waiver. The step down to the ground and the step up to the upper deck, and any corresponding railings, will be attached to the lower" deck, will be built robustly, and the lower deck will not be attached in any way to the upper deck or the housjan We are requesting this waiver in order to allow the deck to sit at the desired height without requiring digging setting posts into some sensitive tree roots and to manage a sloping landscape better. There are two reasons why this was denied: 1- You need a minimum of a 5' side setback, you have it drawn at 4'. You can move to the 5' setback or you can apply for a ZBA finding at 4' 2- 1 also need to know the distance from the garage to the deck. I have some questions/comments regarding the building of the decks: 1- Need details for all the connections. 2- You will have to install solid blocking between the joist over the beam because the cantilever is larger than allowed. 3. The stairs will have to come off the upper deck to the grade to serve as the means of egress. 4. The final grade will determine if you will have to install guards/railings around the deck. If the deck is 30" or higher above finished grade measured 3' out, you will need to install the guards/railings. 5. Stairs that have 4 or more risers will require a graspable handrail on at least one side of them. 6. On the drawings you submitted you have the 10" sonotubes 44" deep, they need to be at least 48" deep. 7. What is the size of the carrying beam for the upper deck? I see it is a 3 ply. 8. What is the distance between the two 10" sonotubes? Please let me know if that is sufficient. 3. when I spoke with someone in the office about this design they suggested that it would be okay for the lower deck to serve as a means of egress even though it were floating due to the low height and the size and stability that it will have. If you are saying that is not possible, please confirm. I know that's stairs ordinarily sit on grade anyhow, so I was not exactly clear why this would not be allowed. obviously if it is necessary and then we will do so, but please let me know if there is any other option. 4. 1 am clear about the codes on the height and will manage that appropriately.
