9. The applicant seeks a special permit to construct an addition
to a two-story wood frame building used for mixed residential
and business purposes. In support of this application, the
applicant states :
A. The building that is the subject of this application is a
pre-existing nonconforming structure in that it was constructed
prior to the enactment of the Northampton Zoning Ordinances in
1975 and it does not comply with the minimum setback requirements
of Section 6. 2 of the ordinance.
B. The structure as it now exists comes to within twelve feet
of the northern boundary of the lot (side lot) and the proposed
addition would bring the structure to within 2 .17 feet of the
boundary.
C. The proposed extension of the non-conforming structure would
not be substantially more detrimental to the neighborhood than
the existing nonconformity because the area, although zoned
residential, is primarily business and the construction on the
northern side of the lot would preserve off-street parking in
an already congested commercial area.

DECISION OF THE
ZONING BOARD OF APPEALS

The Board of Appeals for the City of Northampton met on July 28, 1982 and
voted unanimously to Qrant the petition of Thomas Growhoski for a special per-
mit under Section 9.3 of the Zoning Ordinance to construct an addition to his
building at 60 State Street.
i; Based upon the evidence presented to the Board, the Board made the follow-
ing findings in regard to the special permit:
i'
i1. The proposed use, though not listed in the Table of Use
Regulations is a use allowed within the City of Northampton,
and would be allowed by right on the opposite side of the
i street.
2. The proposed use will not generate an increase in traffic
since the building has been used for law offices for many
years, with no apparent traffic problems specifically
i
relating to the existing use.
3. The building is served by municipal water and sewer systems
and no restroom facilities will be included in the addition.
4. The proposed use would not be substantially more detrimental
than the existing nonconforming use, since the neighborhood
contains a mixture of residential and commercial uses.
5. The proposed use will not be detrimental to the neighborhood
since the properties in the area are close to the boundary
lines, and the abutter to the proposed addition had not ob-
jected to the proposal.
