The building has been continuously used as commercial office space by the current owner and/or its tenants since February,2001,and the property has been continuously used for commercial purposes since approximately 1900. The current owner of the property, G&S Sandler Acquisitions LLC (G&S), purchased the building from Christopher Kennedy,who previously used the property for commercial office and retail uses. G&S rented the building to ThinkGlobal Incorporated, which continuously occupied and used the building for office space, from February, 2001 through Jan. 15,2019. ThinkGlobal continued use of the building throughout 2018,during which time a proposed purchase and sale agreement was pending between G&S and 236 South Street Properties, LLC -- contingent on the - city's approval of the buyer's planned re-development of the property. In December,2018, after the buyer withdrew its development proposal with the city, G&S listed the property for sale as office space, which is consistent with its preexisting,continuing use. ThinkGlobal vacated the building as of Jan. 15, 2019,at which time G&S Sandler Acquisitions obtained "vacant building" insurance coverage. Moreover, since January 15, 2019, G&S Sandler Acquisitions has continued to pay utilities and property taxes on the building at 3 Olive Street--and to occupy and use it as an office for the sale of the property,as well as for administrative and storage purposes. The contract purchaser of the building, Bernadette Stark, has indicated that she intends to continue the pre-existing commercial use, with no changes to the current use as a commercial office space.
