A variance is sought to permit the use of the premises as a
four family dwelling not exceeding three stories in height. This
use is allowed by right under Article V of the Zoning Ordinance,
but the premises lacks, by approximately 8,000 square feet, the
minimum lot area requirements as set forth on Page 6-3 of the
Zoning Ordinance. All other requirements are met including lot
width, depth and frontage, side and rear setbacks and off street
parking provisions.
The premises constitutes the largest lot by area in the
neighborhood, being approximately 14,000 square feet in area.
The neighborhood is composed principally of multi-family dwellings
housing three and four families and in some cases more than four.
There is no land adjoining the premises which is available to
satisfy the minimum lot area thus creating a condition especially
affecting the land in question. For the premises to be a sound
and productive financial investment, four apartments are a neces-
sity and consequently a literal enforcement of the lot area dimen-
sions would involve financial hardship to the petitioner. Because
of the present nature and use of the dwellings in the area as
above set forth, they being principally multi-family dwellings,
the variance sought would .not create a detriment to the public
good {in fact, the variance if granted would enhance the premises
and the area generally and because of the improvements made would
undoubtedly result in a greater tax· revenue to the City and thus
be of benefit to the public good rather than a detriment), and would
not nullify or derogate substantially from the intent and purpose
of. the Ordinance.

OPINION OF THE PLANNING BOARD IN THE MATI'ER OF
Application by Donald Ouimette for a variance from the dimensional and density
regulations to allow the use of a three family dwelling as a four family
dwelling
At its regular meeting of October 13, 1976, the Planning Board voted to expre ss
to the Board of Appeals its opinion that the subject application should be
denied as there is not evidence in the application of t he existence of a legit-
imate hardship, particularly one that is unique to this property. The Board
noted that the application explains that the applicant added a sizeable addition
t o the building, apparently with the expectation that more than three units could
be permitted, but that the building permit clearly indicated that the use would
be for three units. The Board also noted tqat the property was 8,000 square
feet short of the required 22,000 square feet and that this constituted a request
for a sizeable reduction. Finally, the Board noted that the area in que stion
is becoming more heavily congested, and it is the purpose and intent of the
zoning ordinance to prevent such congestion from impairing the quality of the
living environment as would be the case if proposals such as this are approved.

The State of Massachusetts allows the homeowner the right under 780CMR l 08.3 .4 to
act as hidher construction supcr·:is9r. The stati: defines "Homeowner" as," Person(s)

dwelling, attached or detached structures accessory to such use and/or farm structures. A
person who constructs more than one home in a two-year period shall not be considered a

use the home owner exemption, to act as their own construction supervisor, to be aware
that by doing so you become responsible for compliance with state building codes
and (.egulations. The inspection process requires that the building department be called
to inspect work at various stages, which include foundation/footings (before backfill), . .
sonotube holes (before pour). a rough building inspection (before work is
conceaied). insulation inspection(if required) and a final building inspection.:The
building department requires these inspections before the work is concealed, failure to
secure these inspections can result in failure to obtain a certificate of occupancy
until the work can be inspected.
If the homeowner hires other trades to perform work (electrical, plumbing & gas) the
homeowner will be responsible to make sure that the trades hired secure their proper
permits in conjunction to the building permit issued, and that they get their required
inspections. Failure of the individual trades to secure the permits and inspections as
required can DELAY the project until such time as the proper permits and inspections are
made

permits in conjunction to the building permit issu ed, and that they get their required
