COM June 30, 2015 Mr. Tim Seney TJDL Development, LLC 371 Prospect Street Northampton, MA 01060 Re: Wetland Resource Area Delineation Route 66 Map 41 Lot 70 Northampton, MA 01060 Dear Mr. Seney: Per your request, Stockman Associates LLC performed a wetland resource area delineation within the proposed project area located on Route 66 in the City of Northampton as depicted on the Assessors Map 41 Lot 70. Based on observations made during the site visits and reference maps retrieved from MassGIS, the property contains Bordering Vegetated Wetlands (BVW), an Isolated Wetland and Buffer Zone. Site Description The subject parcel is located on the north side of Route 66 in the City of Northampton, approximately 0.20-miles west from the intersection with Glendale Road. The project area is located within the easterly portion of an approximately 19-acre subject parcel. The evaluated land is dominated by upland forest with moderate to very steep predominantly south and east facing slopes. The frontage is comprised of open field with evidence of agricultural impacts. The forested area has been historically harvested for timber. Logging roads exists throughout the property. The site is currently undeveloped. Three wetland systems were delineated within the property. Resource Area Descriptions Bordering Vegetated Wetland (BVW) As stated in 310 CMR 10.55 (2) (a), “Bordering Vegetated Wetlands are freshwater wetlands which border on creeks, rivers, streams, ponds and lakes. The types of freshwater wetlands are wet meadows, marshes, swamps and bogs. Bordering Vegetated Wetlands are areas where the soils are saturated and/or inundated such that they support a predominance of wetland indicator plants…” The B and C-series wetlands border on larger wetland complexes located off the Map 41 Lot 70 Route 66 Northampton, MA 2 | P A G E property to the north and associated intermittent stream channels. As such, the wetlands are jurisdictional based on 310 CMR 10.02 Statement of Jurisdiction. (1) Areas Subject to Protection under M.G.L. c. 131 § 40. The BVWs within the property are classified as a Palustrine wetland. As stated in the Classification of Wetlands and Deepwater Habitats of the United States, 1979, “The Palustrine System includes all nontidal wetlands dominated by trees, shrubs, persistent emergents, emergent mosses or lichens…” More specifically, the delineated BVWs are commonly known as forested swamps. Stockman Associates LLC visited the site on June 15th and 18th 2015. The BVWs were delineated using methodology presented in the Massachusetts DEP Handbook: Delineating Bordering Vegetated Wetlands, March 1995 as well as the 1987 Corps of Engineers Wetlands Delineation Manual and the 2010 Regional Supplement to the Corps of Engineers Delineation Manual: NC/NE Region. Consecutively numbered blue flagging B1 to B32END and C1 to C14 were placed in the field. Flags C8a and C9a are located near the property line. In addition, data were collected on the vegetation, hydrology, and soils to complete the required data forms, which have been enclosed. The B and C-series flagging demarcates the boundary of the forested swamps, which are located in the northeast section of the property. Hydrology The hydrology that maintains the delineated BVWs is supplied primarily from direct precipitation, surface water runoff, and seasonal high ground water. Observed indicators of hydrology include: hydric soils, standing water, saturated soils, blackened leaves, hydrogen sulfide odor, geomorphic position and drainage patterns. The majority of water exits the wetland systems by evaporation and transpiration. Map 41 Lot 70 Route 66 Northampton, MA 3 | P A G E Soils The mapped soil types within the subject property are the very stony Charlton fine sandy loam 3 to 8 percent slope, the Walpole sandy loam 0 to 3 percent slopes, the Sudbury fine sandy loam 0 to 3 percent slopes and the Hinckley loamy sand 0 to 3 percent slopes (NRCS Web Soil Survey). The Charlton series consists of very deep, well drained loamy soils formed in till derived from parent materials that are very low in iron sulfides. They are nearly level to very steep soils on moraines and hills, and ridges. The Walpole Series consists of very deep, poorly drained sandy soils formed in outwash and stratified drift. They are nearly level to gently sloping soils in low-lying positions on terraces and plains. The Sudbury series consists of very deep, moderately well and somewhat poorly drained soils on outwash plains. They are nearly level through strongly sloping soils in slight depressions and on terraces and foot slopes in areas of outwash or glaciofluvial deposits. The Hinckley series consists of very deep, excessively drained soils formed in glaciofluvial materials. They are nearly level through very steep soils on outwash terraces, outwash plains, outwash deltas, kames, kame terraces, and eskers. Buffer Zone Buffer Zone as defined in 310 CMR 10.04 is “that area of land extending 100 feet horizontally outward from the boundary of any areas specified in 310 CMR 10.02(1)(a)”. More specifically, Buffer Zone within the property is associated with BVW and is dominated by upland forest. Observed impacts within Buffer Zone include logging skid roads and landing clearings. Hemlock (Tsuga canadensis) is considered a wetland indicator plant species under The Massachusetts Wetlands Protect Act and its regulations. City of Northampton Zoning and Wetlands Protection Ordinances Based on the City of Northampton Zoning maps the property contains a Water Supply Protection (WSP) zone along the frontage, which hooks around to the rear of the lot. A Special Conservancy Zone is located within the northwest portion of the property (outside of the evaluated area). The central and largest portion of the property is zoned as Rural Residential. Isolated Wetland As stated in the City of Northampton Wetlands Protection Ordinance § 337-2. Jurisdiction, the Northampton Conservation Commission has jurisdiction over “Seasonal wetlands, isolated wetlands, including kettle holes, or within 100 feet of said areas.” The isolated wetland within the property is classified as a Palustrine wetland. As stated in the Classification of Wetlands and Deepwater Habitats of the United States, 1979, “The Palustrine System includes all nontidal wetlands dominated by trees, shrubs, persistent emergents, emergent mosses or lichens…” More specifically, the delineated isolated wetland contains section of forested swamp and wet meadow. The A-series flagging demarcated the boundary of the isolated wetland located within the southerly portion of the subject property. The Wetland Indicator Status classifies a plant based on its frequency of being found in a wetland versus an upland ecosystem. The following five categories are used in the classification system. • An Obligate Wetland (OBL) plant is almost always found in wetlands with a frequency of >99%. • A Facultative Wetland (FACW) plant is usually found in wetlands with a frequency of 67-99%. • A Facultative (FAC) plant is equally likely to occur in wetlands and uplands with a frequency of 34-66%. • A Facultative Upland (FACU) plant is seldom found in wetlands with a frequency of 1-33%. • An Upland (UPL) plant is rarely found in wetlands with a frequency of < 1%. Hydrology The hydrology that maintains the delineated A-series isolated wetland is supplied primarily from direct precipitation, surface water runoff, and seasonal high ground water. Observed indicators of hydrology include: hydric soils, oxidized rhizospheres on living roots, saturation visible on aerial imagery and a dry season water table. The majority of water exits the wetland systems by evaporation and transpiration. Soils The mapped soil types within the isolated A-series are the Walpole sandy loam 0 to 3 percent slopes and the Sudbury fine sandy loam 0 to 3 percent slopes and the Hinckley loamy sand 0 to 3 percent slopes (NRCS Web Soil Survey). Based on the City of Northampton Wetlands Protection Ordinance, the delineated wetlands have associated Protected Zones. The Protected Zone is “The area of land between the edge of a resource area and a parallel line located 50 feet away, measured horizontally.” Furthermore the local ordinance states that “…Thus, in general, work and activity within 100 feet of wetlands should be avoided and discouraged and reasonable alternatives pursued.” As such work within 50 to 100-FT of wetlands may only be permitted if said work is in compliance with the standards provide under Section 337.10.E. Map 41 Lot 70 Route 66 Northampton, MA 6 | P A G E Conclusion In conclusion, Stockman Associates LLC delineated the BVWs closest to the previously described proposed project area. Based on 310 CMR 10.02(1), Statement of Jurisdiction, the BVWs within the property are subject to protection under M.G.L. c. 131. § 40. Any non-exempt proposed work within protected resource areas and associated Buffer Zone requires the submittal of a Request for Determination of Applicability and/or a Notice of Intent to the Northampton Conservation Commission and the Massachusetts Department of Environmental Protection. Regulatory approval of the boundaries delineated by Stockman Associates LLC requires the submittal of a Request for Determination of Applicability (RDA), a Notice of Intent (NOI), or an Abbreviated Notice of Resource Area Delineation (ANRAD) to the Northampton Conservation Commission and the Massachusetts Department of Environmental Protection. The delineated BVWs and isolated wetland are subject to protection under the City of Northampton Wetlands Protection Ordinance. The confirmation of protected resources areas and delineated boundaries under the local wetland ordinance requires review and approval by the Northampton Conservation Commission. The evaluated area also contains resource areas subject to protection under federal regulations. Any non-exempt project may require an application filing with the Army Corps of Engineers and MA Department of Environmental Protection under Section 401 and 404 of the Clean Water Act.
