Allowed Uses 171 King St 2014-08-18Entryway Business District (171 King St)
The range of possible uses for the property at 171 King St is quite extensive. It is in the Entrance
Business district. I reviewed the zoning regulations for that district. There are many positive options for
development and few significant restrictions on that property other than the environmental issues. I’ve
included a summary of the allowed uses; automobile services are allowed in the EB district (subject to
Planning Board approval), so the prior issue of abandonment is moot. I’ve also included an aerial photo
showing the intersection of Finn and King Streets. The entrance to the property would likely need to be
at the intersection where the building was; since the building was demolished, it is easy to see how
that would lay out.
I’ve also met with staff from the Massachusetts Departmental Protection Agency. They’ve explained
the process for dealing with the hazardous materials on the site, including the process for new
construction. I could arrange another meeting with them to review the likely process for various types
of development.
Allowed uses (some require Planning Board site plan approval or special permit with site plan approval):
1. All retail, wholesale and business sales and supply of goods and services
2. Office with or without drive-through component
3. Restaurant (drive-through not allowed), bar, entertainment, community center
4. Hotel/Motel
5. Health/Athletic club, indoor recreation, membership club operated for profit or nonprofit
6. Any residential use above the first floor, home office/occupation
7. Commercial or public parking lot or structure, passenger terminal/stand
8. Facilities for essential services, municipal facility
9. Education, religious use, day care, school-aged childcare program (MGL c. 28A, § 9), family day
care (with registration with Building Commissioner); historical association, and nonprofit
museum (residence of a caretaker above first floor only)
10. Agricultural uses; horses and animals as accessory uses in accordance with § 350-5.3
11. Tradesman, artist’s space
12. Temporary events
13. Funeral establishment
14. Veterinary hospital in which all animals are kept inside permanent buildings
15. Automotive repair (not junkyard) without gasoline sales
16. Telecommunications antennas which are located on existing telecommunications towers or
other structures which do not require the construction of a new tower (in accordance with §
350-10.9)
17. Automotive service station (not junkyard) with or without convenience, commercial selling
leasing renting automobiles and/or used automobiles and trucks, new automobile
tires and other accessories, boats, motorcycles and household and camping trailers
18. New telecommunications structures/facilities (in accordance with §§ 350-2.1 and 350-10.9)
Entryway Business District Dimension and Density Requirements:
1. Front, side and rear setbacks are 0 feet
2. There is no required open space except for required plantings and buffers
3. There is no maximum front setback requirement
4. There is no requirement for 2 story buildings except for residential uses. The minimum building
height is 20’ and the maximum is 65’
5. No parking is allowed in front of the building. Parking along the sides of the can’t be closer to
the street than the front of the building
6. There are no traffic mitigation payment requirements except for gas stations
7. There is no limit to the number of buildings allowed on a parcel, subject to Planning Board
approval, fire lanes and building code requirements for fire separation.
