THIS IS AN IMPORTANT NOTICE. FAILURE TO TAKE ADEQUATE ACTION IN
RESPONSE TO THIS NOTICE COULD RESULT IN SERIOUS LEGAL CONSEQUENCES.
An inspection ofyour facility by the Northampton Department of Public Works personnel revealed one or
more "cross connections" to the public water supply, which are in non-compliance with the Federal Safe
Drinking Water Act of 1974 (public Law 93-523) and the Commonwealth ofMassachusetts, Department
of Environmental Protection Drinking Water Regulations, 310 CMR 22.22. A "cross connection" is an
unprotected actual or potential connection between the public or potable water system and any other
source or system which is unapproved for consumption purposes. A cross connection can also be
considered as any by-pass arrangement, jumper connection, removable section, swivel or change-over
device and other temporary or permanent device through which "backflow" or "backflow siphonage" can
or may occur.
The violation of CMR 22.22 found by the inspector as a result of the survey are listed on the attached
Cross-Connection Survey Report Form & Violation Notices.

dealership parcel in Northampton, Massachusetts. The property for which the permit is requested is
located at 171 to 187 King Street.
In accordance with Massachusetts General Law, Chapter 40, Section S4A, a permit shall not be
issued without first obtaining, after a public hearing, the consent in writing to the issuance of such
permit from the Secretary of the Executive Office of Transportation (EOT).
I hereby request that a public hearing be held for.Berkshire-Noho, LLC to determine. whether
consent will be granted by EOT to construct the above on the former railroad property.

Grantor hereby reserves for itself, its successors and assigns, the perpetual right
and easement over, under, through, across and upon a twenty (20) foot wide easement
along and parallel with the east sideline of PARCEL "A" shown on said Plan as
"RETAINED MASSACHUSETTS ELECTRlC COMPANY 20' 'NIDE EASEMENT"
(the "Easement Area"), to construct, reconstruct, install, repair, maintain, operate, inspect
and patrol for the transmission and distribution ofhigh and low voltage electric energy
and for the transmission ofintelligence, lines ofburied and above ground wires and
cables and lines oftowers or poles or both (any ofwhich may be erected and/or
constructed at the same or different times) together with wires and cables strung upon and
from the same, and all necessary ducts, conduits, raceways, conductors, terminals,
sustaining and protective fixtures, underground expansion stabi1izers, manholes, hand
holes, guy wires" junction boxes, foundations, anchors, braces, fittings, riser poles and all
housings, connectors, switches, and any other equipment or appurtenances, including
without 1imitation a buried ground wire and snch fuotbridges. causeways, and ways of
access, ifany, as may be reasonably necessary for the convenient construction,
reconstruction, installation, repair, replacement, maintenance, operation, inspection and
patrolling of said lines over, under, Ibrough, across and upon the Easement Area and to
pave, excavate and/or change the grade so much thereofas is reasonable, necessary and
proper in connection with the exercise ofthe foregoing rights (the "Easement"), which
aforesaid rights shall be exclusive to the Grantor. Also, the perpetual right and easement
from time to time, without further payment therefor, to clear and keep cleared by
physical, chemical or other means, the Easement Area of trees, underbrush, buildings,
structures, both above and below grade (the first clearing may be for Jess than the full
width and may be widened from time to time to the full width) and to renew, repair,
replace, add to and otherwise change the lines and each and every part thereof and all
appurtenances thereto and the locations thereofwithin the Easement Area; and to pass
along the Easement Area to the extent necessary, as determined by Grantor in its sole
discretion, for Grantor's exercise of the rights herein reserved.
By his acceptance hereof, Grantee, his successors, heirs and devisees,covenant
and agree that no acts will be permitted within the Easement Area which are inconsistent
with the rights hereby reserved; that no permanent or temporary buildings, structures or
obstructions will be erected or constructed above or below grade within the Easement
Area, and, that the present grade of tbe Easement Area will not be changed or altered by
excavation or filling.
It is the intention ofthe parties that the rights and easements hereby reserved to
the Grantor shall be assignable. Insofar as permitted by law, the provisions hereof are
intended to bind and inure to the benefit ofthe successors and assigns in title to the
parties hereto.
Grantee and his snccessors, heirs, and devisees covenant and agree to erect,
construct, install, maintain and repair a fence ("Fence") along tbat portion ofPARCEL
"A" which abuts the remaining property of Grantor ("Grantor's Property") and to keep
the same in good repair at all times to prevent pedestrian and vehicular access on or to
Grantor's Property to or from Parcel A. Further, Grantee and his successors, heirs and
