17A-297 140 Hillcrest Drive Zoning 2013-11-21City of Northampton Massachusetts DEPARTMENT OF BUILDING INSPECTIONS 212 Main Street ● Municipal Building Northampton, MA 01060 Theodore Parker Kohl Construction Company 31 Campus Plaza Road Hadley, MA 01035 November 21, 2013 Dear Mr. Parker, I have reviewed the building permit application to construct a single family home at 140 Hillcrest Drive in Florence, Massachusetts. I cannot approve this application as presented. The lot at 140 Hillcrest Drive was in common ownership with the lot at 44 Kimball Street. The lot at 44 Kimball Street does not have the minimum amount of frontage to meet the zoning requirements for a conforming lot. It is my determination that when the two lots came into common ownership, they merged to create a conforming lot. Constructing a dwelling on the Hillcrest Drive lot would make the 44 Kimball Street lot again non-conforming, a violation of the City of Northampton Zoning Ordinance, section 350-4.1 (B); “Except as herein provided, any existing conforming use, structure, or lot shall not by any action become nonconforming, and any existing nonconforming use, structure, or lot shall not become further nonconforming.“ It does appear that the lot at 140 Hillcrest Drive could be reconfigured to create a conforming building lot and leave enough frontage for the Kimball Street lot.
