Pursuant to Massachusetts General Laws (MGL) Chapter 40A, Section
11, no Finding or any extension, modification or renewal thereof,
shall take effect until a copy of the decision bearing the
certification of the City Clerk that twenty days have elapsed
after the decision has been filed, or if such an appeal has been
filed that it has been dismissed or denied, is recorded in the
Hampshire County Registry of Deeds or Land Court, as applicable,
and indexed under the name of the owner of record or is recorded
and noted on the owner's certificate of title. The fee for such
recording or registering shall be paid by the owner or applicant.
It is the owner or applicant's responsibility to pick up a the
certified decision of the City Clerk and record it at the
Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that a
Finding has been granted and that copies of this decision and all
plans referred to in it have been filed with the Planning Board
and the City Clerk.
Pursuant to Massachusetts General Law Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If you wish to appeal this action, your appeal must be filed
pursuant to MGL Chapter 40A Section 17, with the Hampshire County
Superior Court and notice of this appeal filed with the City
Clerk within twenty (20) days of the date this decision was filed
with the City Clerk.

2. The Board found that the alteration and change in use of the
non -conforming structure on a non -conforming lot will not
create a new violation of the existing zoning requirements
because the alteration will not change the footprint of the
existing building, and the change in use is to a conforming
use which requires the same or less minimum lot area,
minimum lot width and frontage, minimum lot depth, setbacks,
and parking than is required for the present use.
Conditions imposed with this Finding are as follows:
1. As proposed by the applicant, an experienced property
manager shall reside on the property as a condition of
this permit and have the authority to resolve problems
with abutters.
2. The name and phone number(s) of the property manager
shall be submitted to the Building Department prior to
the issuance of a Certificate of Occupancy. These
numbers shall insure access to a "live" person rather
than a machine in case of a problem.
3. A dumpster shall be placed on the property and
adequately screened.
4. The dumpster shall be in place and verified by the
Building Commissioner prior to a Certificate of
Occupancy being issued.
5. If the applicant chooses to provide on-site parking, a
plan showing the location of parking spaces shall be
submitted to the Office of Planning & Development to
become part of the file.
6. The permit shall expire one year from the date of
issuance of the Occupancy Permit and shall be required
to be renewed. The applicant shall be required to file
for a renewal of the Finding with the Zoning Board of
Appeals to review the project and determine if the
project as established is more or less detrimental to
the neighborhood.

At a meeting conducted on May 15, 1996, the Northampton
Zoning Board of Appeals voted 2:1 (Ghiselin) to grant the request
of Charlie Wang for a FINDING under the provisions of Section 9.3
(1)(D) and 9.3(2)(B) in the Northampton Zoning Ordinance, to
allow alteration of a pre-existing non -conforming structure and a
change in use of a non -conforming structure on a non -conforming
lot at 79 Hawley Street, Northampton, MA.
Zoning Board Members present and voting were: Chair M. Sanford
Weil, Jr., Alex Ghiselin and Elaine Reall.
The Findings of the Board under Section 9.3(1)(D) and 9.3(2)(B)
for an alteration of a Pre-existing non -conforming structure and
for a change in use of a non -conforming structure on a non-
conforming lot were as follows:
1. The Board found that the alteration and change in use will
not be substantially more detrimental to the neighborhood
than the existing non -conforming structure and use. Board
members determined that, although many problems have
resulted because of the past uses of the property, the
applicant's plans to upgrade the building and convert it
into four apartments will improve the conditions in the
neighborhood. The applicant's proposal to subdivide the
existing large second -floor apartment into two smaller
apartments will result in a more orderly, controlled living
arrangement. Also, the applicant's proposal to install an
on-site, experienced manager will insure that problems are
