NATURE OF PROPOSED WORK:
Remove existing house; create two flag lots and one standard lot
HARDSHIP:
CONDITION OF APPROVAL:
1. Prior to issuance of a building permit for any lots, the applicant must submit proof of recording of
driveway maintenance agreements and easements.
2. As offered by the applicant, prior to issuance of a building permit, easements for the public to cross
the property between Water S.treet and Reservoir Road shall also be recorded.
3. Prior to issuance of a building permit for the 2nd home $2,000 payment in lieu of traffic mitigation
must be submitted to the City of Northampton.
4. Prior to issuance of a BUILDING PERMIT for the lrd lot, the applicant must pay an additional $2,000
in lieu of traffic mitigation.
5. The applicant shall submit for approval from Department of Public Works and record an amended
easement aI/owing the detention. There shall be a minimum of 5' of cover and city not responsible for
6. The applicant shall install on site fire protection wells or cisterns (according to Fire Department
specifications) with sprinklers in each residential unit.
7. Prior to issuance of a CERTIFICA TE OF OCCUPANCY for any home, the applicant shall submit an
as-built plan, stamped by an engineer indicating the driveway has been completed with the grades
shown on the plan.
The Planning Board approved the special permit for the three flag lots and a common driveway based upon the following plans submitted
with the application:
1. "Residential Lot Development" prepared by The Berkshire Deisgn GrouP. Inc., Prepared for Sweet Meadow Properties, LLC, Dated
2/23106. Sheets 1 to 3, Sheet 2 revised 413106.
The Planning Board found:
A. The requested use protects adjoining premises against seriously detrimental uses. The single family house lots are consistent with
the development patterns in the vicinity.
B. The requested use will not affect the safety of vehicular and pedestrian movement on adjacent streets. The lots will be served by a
common driveway to minimize curb cuts onto Westhampton Road.

The project, including any concurrent road improvements. will not decrease the level of service (LOS)·of all area roads or intersections
effected by the project below the existing conditions. A total of$4,000 will be paid to the City of Northampton in lieu of traffic mitigation
at the time building permits are pulled.
C. The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings
and other community assets in the area. There are no chanqes to the character of the buildings planned.
D. The requested use will not overload, the City's resources including the effect on the City's water supply and distribution system.

E. The requested use meets the regulations set forth in the Zoning Ordinance in section 5.2. 6.13, 10 and 11 for flag lots and common

F. The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of
character of the district or adjoining zones. nor be detrimental to the health, morals, or general welfare.
G. The requested use will promote City planning objectives to the extent possible and will not adversely effect those objectives, as
defined in City master or study plans.
H. Compliance with the following technical performance standards:
1. One curb cut will serve three new house lots.
2. Pedestrian, bicycle and vehicular traffic movement on site have been separated to the extent practicable. A public walking path will
traverse the lower portion of the property.
