PERMIT ---NORTHAMPTON
Subject to all the terms, conditions, and restrictions printed or written below, and on the
reverse side hereof, permission is hereby granted to Northwood Development LLC c/o
Development Associates, PO Box 528, Agawam, MA O I 001 to enter upon the State
Highway Layout in the City of Northampton known as Route 1-9 I for the purpose of
constructing and utilizing new indirect drainage connections along the property
boundary of the development known as "Northwood Development II", along the
southerly side of the Route 1-9 l NB Exit 18 State Highway Layout.
The District Highway Director shall be notified in writing, through the District Permit
Engineer, 48 hours in advance of any work by the Grantee. The District Permit Engineer
can be reached at the Northampton District Two office, by fax at (413} 582-0596, or by
email at eric.ehle@dot.state.ma.us. All described work shall be completed as directed by,
and to the satisfaction of, the Director.
Any utility work shall be done in accordance with the relevant sections of the MassDOT,
Highway Division, Utility Accommodation Policy on State Highway Right of Way, dated
May 2013, as amended.
The following documents are hereby incorporated into this permit and all rights are
contingent upon satisfactory execution thereof:
• Plans prepared by Tighe & Bond entitled "Northwood Development II, Atwood
Drive, Northampton, Massachusetts, Final Release Drawings" dated November
2017.
• The WPA Form 5 -Order of Conditions, DEP File Number 246-0674 from the
Northampton Conservation Commission, issued November 14, 2013, extended
August 4, 2017, with all appendices.
The terms and conditions outlined in this permit govern over any discrepancies with the
above listed documents and any provisions contained within said documents.
All present and future discharge rights granted under this permit are contingent upon
the upkeep and maintenance of the site drainage system as specified in the Hospitality
North, Atwood Drive, Northampton, Massachusetts Stormwater Management System
Operation and Maintenance Plan, as prepared by Tighe & Bond and presented as
Appendix E in the Stormwater Management Report and Permit Application Package,
dated May 201 7.

No new, additional, or increase in discharge over the amounts specified in the
Stonnwater Management Report and Pennit Application Package shall be allowed
without the benefit of a MassDOT permit amendment or reissuance.
No work shall be undertaken until this Permit. along with the o & M Plan, has been
recorded at the Hampden County Registry of Deeds, within the chain of title d the
affected property. This Permit and the O & M Plan shall be noted in the Registry's
Grantor Index under the name of the owner of the land which the drainage.rights are
granted. A copy of the recorded document st.amped by the Registry of Deeds, shall be
submitted to the Director.
During construction and subsequent operation of the faciliq,, the Grantee shaff take
appropriate measures to prevent any sediment. debris. or runoff from entering upon
any portion of the State Highway Layout
All shoulder areas, paved areas, sidewalk. grass areas, driveway and street aprons,
drainage lines and structures, granite curbing, edging. guardrail, retaining waUs, or
other highway appurtenances that are disturbed due to the construction work shall be
replaced andjor restored to original or better condition.
Any disturbed area shall be replaced in kind, e.g., foamed, fertilized, limed and seeded,
bituminous concrete. gravel, etc.
Any ponding of water which may occur in this area as a result of the work herein
described shall be the responsiblliq, of the Grantee.
No trees shall be removed nor shall any roots be cut
No tracked vehicles will be allowed on the highway surface without a protective mat
If the Director deems it necessary, an inspector shall be assigned to the work and the
cost of said inspector shall be charged to the Grantee.
All work shall be done in a professional manner; if in the opinion of the Oistri(t Highway
Director the work was not done in a satisfactory manner, the Grantee shall return to the
area in question and perform the necessary work. as directed by the Director.
Adequate warning signs, traffic cones and other traffic control devices must be erected
in accordance with the Manual on Uniform Trame Control Devices /2009 Edition/, as
amended, which can be found at http:ttmutcd,fhwa.dotgov, and in accordance with
the Road Flagger & Police Regulations 701 CMR 7.00 and the attached traffic
management plans. Signs and sign supports located on or near the traveled way must
pass the criteria set forth in the NCHRP 350 Report said devices shaft be placed and
replaced by the Grantee at the work site as required. Reflectorized plastic drums shall
be used in the highway work zones; the use of metal drums is not allowed. Adequate
lights. signs and barriers shall be provided by the Grantee.

All personnel working within the State Highway Layout shall wear approved safet;y
vests.
Uniformed police shall be in attendance at the expense of the Grantee. Traffic shall be
maintained at all times.
No equipment or personnel shall occupy any portion of the State Highway Layout
except betvJeen the hours of 9:00 A.M. and 3:30 P.M. Monday through Friday. Saturday
and Sunday work is not allowed under the terms of this permit Work will not be
allowed the day before or the day after a long weekend, which involves a holiday,
without prior approval of the Director. No work shalt be performed under this permit
during periods of inclement weather to ensure MassOOT Snow and Ice operations are
not impeded.
At the end of each workday, the Grantee shall keep the highway surface free of any dirt.
dust or debris of any nature, resulting from the work. The Grantee shalf utilize
mechanical sweepers, water, calcium chloride or bitumen and sand, in accordance with
Section 440, Roadway Dust Control, of the 1988 MassHighway Department's Stilndard
Specifications for Highways and Bridges, as amended.
DIG SAFE NUMBER: Prior to the start of any work under this permit, the Grantee shall
notify the Public Utilit;y Underground Plant Damage Prevention System (DIG SAFEJ,
which can be found at www.djgsafe,com or by caHing 1-888-34+7233. Upon issuance
of the DIG SAFE NUMBER the Grantee shall forward said number to the MassDOT
Highway Division, District Two Office by calling (413) 582-0599.
All utilft;y companies whose services are located within or adjacent to the proposed
work areas shall be notified in writing of the proposed work at least 48 hours prior to
the start of any excavation in said areas. This is independent of required Dig Safe
notification.
The Grantee shall procure all permits, licenses, required easements and give all notices
necessary and incidental to the due and lawful prosecution of the work (including
Conservation Commissions, Tree Wardens, etc.).
All work proposed and materials used shall conform to Massoors 1988 Stilndilrd
SpeciRcations for Highways and Bridges, with the current SUPPLEMENTAL
SPECIFICATIONS, and Massoors, 1996 Metric Edition of the Construction and Traffic
Standard Details. along with the 1977 Massachusetts Department of Public War.ts
Construction Standards, with the current METRIC/ENGLISH SUPPLEMENTAL
DRAWINGS, as amended. The Grantee shall afso adhere to the Massachusetts Highway

Backfill and gravel material shall meet the requirements of Section l 00 of the 1988
MassHighway Department's Standard Specifications for Highways and Bridges, as

amended. Backfia shall be placed iri successive layers not more than 6 inches in depth,
unlformly distributed, and each layer thoroughly compacted. No frozen material shall
be used as backfill. All Bituminous Concrete shall be Hot Mix Asphalt Pavement and
shall meet the requirements of Section 400. Grading, Fine Grading and all other work
shall be in accordance with the appropriate 5ection(s).
All material necessary for the restoration of the highway (including but not limited to
Hot Mix Asphalt Pavement Cement Concrete Masonry; Control Density Fill; stone;
gravel; backfill materials; etc.) shall be furnished by a MassDOT Certified Supplier. For a
list of specific suppliers, please contact Ms. Amy Bisbee, District Materials Engineer at
(413) 582-0536.
The Grantee must adhere to 520 CMR 14.00: EXCAVATION AND TRENCH SAFETY as
promulgated by the Department of Public 5afet;y in conjunction with the Division of
Occupational 5afety pursuant to authority granted by M.G.L c. 82A § 1.
The shoring and bracing of trenches along with other related excavations shall conform
to the applicable rules and regulations of the Commonwealth of Massachusetts Division
of Industrial Safety and the U.S. Department of Labor, Occupational 5afety and Health
Administration.
Trench walls shall be shored, braced, or tapered as necessary in order to maintain the
integrity of the highway.
Attention is called to the clauses on the back of this permit pertaining to the laying of
pipes. etc.
MassDOT Highway Bounds shall not be disturbed. In the event any bounds are
disturbed, they shall be located by a Registered Civil Engineer or Land Surveyor using
MassDOT Layout Plans and reset according to the current MassDOT standards. An as-
built sketch, induding proper bearings of the reset bound, shall be submitted to the
District Highway Director. All expense shall be borne by the Grantee.
The rights granted under this permit are contingent upon strict adherence to: MGL c.
131, s.40 (Wetland Protection Act -WPAJ and its implementing regulations 310 CMR
10.00; and M.G.L c.13 IA (Massachusetts Endangered Species Act-MESA) and its
implementing regulations 321 CMR 10.00. The Grantee shall ensure that all wor1c is
done in accordance with the. policies and procedures of the WPA and MESA
Regulations. As required, erosion controls shall be installed in accordance with Part Ill
(Erosion and Sediment Control Practices) of the Massachusetts Department of
Environmental Protection Erosion and Sediment Control Guidelines for Urban and
Suburban Areas.
Concerning the discharge rights granted herein, the Grantee shall save blameless the
Commonwealth of Massachusetts. MassOOT and any assigns from any liability claims or
suits as a result of MassDOT State Drainage System failure, for any reason, that affects

his/her property in any way. The Department reserves the right to amend, suspend or
revoke the rights (including drainage rights) granted under this permit if it is determined
that said rights affect state appurtenances or compromise the safety of the traveling
public.
Failure to comply with the terms of this Permit; past and future directives from Mass DOT;
or directives from any other local, state, or federal regulatory agency, shall be cause for
immediate revocation, and may be cause for denial of future permits.
The Grantee shall indemnify and save blameless the Commonwealth and its MassDOT
Highway Division, against all suits, claims or liability of every name and nature arising at
any time out or in consequence of the acts of the Grantee in the performance of the
work covered by this permit whether by themselves or their employees or
subcontractors.
A copy of this Permit must be on thejob site at all times for inspection. Failure to have
this Permit available at such site will result in suspension of the rights granted by the
Permit
The Grantee's attention is directed to the requirement of Chapter 228 of the Acts of
1972 concerning excavation.

All construction within the State Highway Layout shall be completed within 12 months
of the issuance of this Permit.
