WORKS HAS BEEN TAKEN ON TIDS APPLICATION BASED ON INFORMATION
PRESENTED:
Disapproval of the Stormwater Management Permit Application based on a
determination within seven days of the receipt of the application that the
application is administratively incomplete (see attached documentation).

Standard Permit Conditions:
1. All clearing, grading, drainage, construction, and development shall be conducted in
strict accordance with the following plans and information submitted with the application
and as amended by any conditions attached to this permit:

b. Massachusetts DEP Checklist for Stonnwater Report, Drainage Calculations, and
Soils mapping and investigation included in the Planning Board Submittal, dated
January 23, 2017, prepared by Juster Pope Frazier Architects, RP Masiello, CME
Associates Inc, and B Kim Erslev.
2. The Northampton Department of Public Works (DPW) or its authorized representative
shall be provided access to the property to conduct inspections before, during, and after
construction activities as necessary. The applicant shall arrange with the DPW to
schedule the following inspections: Initial Inspection, Erosion Control Inspection, Bury
Inspection, and Final Inspection. The DPW may also conduct random inspections to
ensure effective control of erosion and sedimentation during all phases of construction.
3. The owner shall retain the design engineer to document the construction of proposed
stonnwater infrastructure. The design engineer shall check elevations, inverts, layout,
materials and other critical aspects of the system as they are being constructed. At the
completion of the work, including construction of stormwater management facilities and
landscaping, the applicant shall submit to the DPW as-built plans stamped by a
professional engineer of record in the Commonwealth of Massachusetts and a statement
from a professional engineer of record in the Commonwealth of Massachusetts certifying
that the materials and construction of the stonnwater management system was
constructed in accordance with the approved plans and will function as designed. All
changes to the approved stonnwater facilities shall be documented by a professional
engineer of record in the Commonwealth of Massachusetts and approved by the DPW
prior to submission of as-built plans and the certification statement described above. The
preparation of as-built plans requires routine inspections and surveying of stormwater
system components while they are being constructed.
4. Annual Reports that are stamped by a Registered Professional Engineer documenting
the actions completed as required by the Operation, Maintenance and Inspection
Agreement shall be submitted to the Northampton Department of Public Works by
October 1 st of each year (see Specific Condition 1 below).
5. If construction of the proposed stonnwater system has not started within five years of the
issue date of this permit, then the pennit will expire and a new pennit will be required.
Construction is defined as clearing, grading, excavation, filling, and installation of
drainage structures on the lots specified in this pennit.
Specific Permit Conditions:
1. Prior to the start of construction and issuance of a Building Permit, the applicant shall
record an executed Stonnwater Operation, Maintenance, and Inspection Agreement that
is binding on all subsequent owners ofland served by the private stormwater
management facility by recording it in the land records of the Registry of Deeds. The
maintenance schedule and responsibility for maintenance of all components of the
proposed stonnwater management system must be adequately specified in Attachment A
to this Agreement. This agreement shall be approved by the Northampton DPW and
signed by the owner and the Mayor of Northampton. Chapter 281 of the Northampton

Stonnwater Management Ordinance provides additional guidance for the requirements of
this agreement.
2. This project will be required to submit one or more Notice ofIntent (NOI) to the U.S.
EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of
the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to
the Northampton DPW for approval prior to the start of construction and prior to issuance
of a building permit for each phase of construction.
3. The proposed stormwater management system is designed to mitigate peak stonnwater
flows and retain stormwater on site. The proposed plans specifY an overflow connection
that connects to the municipal drainage system in Prince Street. The drainage calculations
show a proposed peak flow from both Lot 19 and Lot 18 to the municipal drainage
system in Prince Street of 4.8 cfs for the 100 year, 24 hour design storm. The municipal
drainage system in Prince Street currently has no additional capacity for overflow from
this site. If, after construction of the proposed system, the system is found to increase
stormwater flows to adjacent properties or to the municipal storm drain system, the owner
shall redesign and reconstruct the drainage system to prevent any increased stonnwater
flows to adjacent properties or to the municipal storm drain system.
4. Sheet 4 of the Site Plans includes the note, "Provide a Minimum of 4 Test Pits
Throughout Infiltration Area to VerifY Seasonal High Groundwater Elevation &
Infiltration Rate." The DPW requires that prior to the start of construction, the applicant
shall submit to the DPW for approval, written confinnation by a Professional Engineer of
Record in the Commonwealth of the results of the 4 test pits, the soil textures, soil types,
and the elevation of seasonal high groundwater at the location of subsurface infiltration
basin. If soil and groundwater conditions are found to be different than the conditions
assumed for the proposed design and the expected infiltration rate or design of the system
is impacted, the design of the proposed infiltration system and related drainage
calculations must be revised and resubmitted to the DPW for approval. The elevation of
the bottom of the proposed infiltration system must have a separation of at least two feet
to the seasonal high groundwater elevation.
5. Within 30 days of the issuance of this Stormwater Management Permit, the applicant
must submit additional details of the proposed subsurface infiltration system. The detail
of the proposed 4'x4'x4' Concrete Gallery Cross Section on Sheet 5 does not indicate
stone below the gallery or provide specifications for the compaction of material that the
gallery sits on. Additional information for the construction of the subsurface infiltration
system must be submitted to the DPW for approval and included in construction plans for
the project.
6. Prior to the start of construction of the proposed subsurface infiltration basins, the
applicant shall notifY the DPW ofthe expected start date of construction of these
structures for inspection by the DPW.
7. Prior to the start of construction and prior to issuance of a building permit, construction
plans shall be submitted to the DPW for approval.
