Proposed multifamily dwellings are allowed in URC with additional requirements per 350 Attachment 1, Table of Use Regulations:
With site plan review for multifamily dwellings not exceeding 3 stories
With planning board special permit for multifamily dwellings exceeding 3 stories
Rogers and Hubbard Halls both have 4 occupied levels, with the lowest levels having access directly to grade on the east side of the buildings. It must be determined if the lowest levels
in either building constitute a story as defined by Northampton’s zoning ordinance.
350-2.0 Definitions
STORY
The portion of a building which is between one floor level and the next higher floor level. If a mezzanine floor area exceeds 1/3 of the area of the floor immediately below it, the mezzanine
shall be deemed to be a story. A basement shall be deemed to be a story, and a cellar shall not be deemed to be a story. An attic shall not be deemed to be a story if unfinished and
without human occupancy. (See Diagram 7 at the end of this section.)
BASEMENT
A portion of a building partly below grade, which has less than 1/3 of its height measured from finished floor to finished ceiling, below the average finished grade of the ground adjoining
the building.
CELLAR
A portion of a building, partly or entirely below grade, half or more than 1/2 of its height measured from finished floor to finished ceiling, below the average finished grade of the
ground adjoining the building. A cellar is not deemed a story. (See Diagram 1 below.)
350-8.0 Off-Street Parking and Loading Regulations
Parking will likely meet the requirements for the residential use. Additional parking will be required for the educational/business uses in Bell Hall.
§ 350-8.3. Existing spaces.
A. Parking or loading spaces being maintained in any district in connection with any existing use on the effective date of this chapter, or any spaces subsequently provided in accordance
with this chapter, shall not be decreased or any way removed from service to the use originally intended to be served, so long as said use remains, unless a number of parking or loading
spaces is constructed elsewhere, such that the total number of spaces conforms to the zoning requirements. This regulation shall not, however, require the maintenance of more parking
or loading spaces than is otherwise required. Existing or new parking spaces that are not allocated to specific projects or uses can be allocated to future projects that are developed
within two years by site plan approval.
