NEWPRO is also providing Owner with a labor warranty, which covers NEWPRO's labor. Owner understands that Owner should read all the written warranties for complete details of warranty coverage and that warranties are available for complete review before signing this Agreement. Late Cancellation: Owner understands that Owner has three (3) business days to cancel this Agreement. Owner understands that if Owner wants to cancel this Agreement after those three (3) days, NEWPRO does not have to allow that. Owner understands that if NEWPRO does let Owner cancel, however, that Owner will have to pay to NEWPRO a late cancellation fee equal to 33.3% of the purchase price in order to cover NEWPRO's labor, administrative, and material costs, so long as that is legally allowed. Delay/Unknown Conditions/Damages: Owner understands that if NEWPRO determines within thirty (30) days of the date of this Agreement that it cannot perform the work according to NEWPRO's professional standards, NEWPRO can cancel this Agreement, notify Owner of cancellation, and promptly return Owner's money. Owner understands that issues that may cause NEWPRO to cancel this Agreement include incorrect pricing or unknown pre-existing conditions to the property. When Money Is Due: Owner agrees that when the work is "substantially complete", Owner will pay the balance due on this Agreement. Owner agrees that once Owner has paid the purchase price, if Owner believes any of the work performed by NEWPRO is defective or incomplete, NEWPRO will inspect the work and perform any service Owner is entitled to under this Agreement and/or any warranty. Owner agrees that if Owner does not pay any of the money when it is due, Owner can be charged a late fee of 1.5% on the amount owed for each month the money is not paid. Owner agrees that if Owner defaults on any promises under this Agreement, and NEWPRO hires an attorney to enforce this Agreement, Owner will pay NEWPRO its reasonable legal fees and related costs or expenses, as long as it is legal for Owner to do that. Other Understandings: Owner agrees that Owner will assert a dispute, claim, or controversy (hereafter referred to as a "Claim") arising under or relating to this Agreement only on behalf of Owner's own self and that Owner will not assert a Claim on behalf of, or as a member of, a class or group in either an arbitration proceeding, a private attorney general action or in any other forum or action. If a court determines that this specific paragraph is not fully enforceable, the court's determination shall be subject to appeal. We will arrive between 7:30 and 8:30 am on the day of installation. Please be sure to complete all showering/bathing prior to our arrival as the water will be turned off for up to 4 hours in the morning. Remove all items, including breakables and valuables i.e., lamps, pictures, mirrors, glass shelves, china, dishes, books and knick-knacks from the path leading to the bathroom and from all walls adjoining the bathroom. Remove all items from the bathroom, i.e., shower/window curtains, rugs, removable carpeting, wall decor, etc. If we're removing your cabinetry, please have them completely emptied. We cannot be responsible for damage to removable items left in the bathroom or in the path from the front door to the bathroom; please clear a path for our installers to work. Make sure adequate electricity, water, heat and parking are available during your installation. We will assume we can use your electricity for our tools and park our vehicle and trailer in your driveway, or the street in front of your property, on the day(s) of your installation. If not, please notify our office well in advance to make other arrangements. Please have an adult (over the age of 18) present when we arrive. Your installer(s) will review the installation and ask to be shown the main water shut off before they begin. If no one is staying, be sure to leave a number where you can be reached if necessary. Despite our most diligent care, on rare occasion older or corroded plumbing may break during the removal of drains or fixtures. We can replace these items at the rates listed below*. We will only do so after explaining the work and obtaining your signature of approval on a contract addendum. If you prefer, you can have your plumber make the repairs. Replace whole house water shut off: $500.00 Replace tub/waste overflow, (pipes behind tub):$500.00* NEWPRO does not paint or stain any walls, ceilings or casings. NEWPRO may be required to remove the bathroom entry door in order to install your new walk-in tub. If this occurs, it will be your responsibility to touch up the walls, ceilings and/or casings. Additionally, when converting from a tub to a shower, NEWPRO may need to open up walls and/or ceilings to increase the drain to 2 inches. NEWPRO will repair the area but we are not responsible for re-painting or wallpapering. If you are doing any other work, laying your own floor, removing or building walls/closets, be sure to have it fully completed before we arrive. Although we work with the utmost of care, keep in mind that it is nearly impossible to work in a smaller room without some minor marks and/or scratches occurring on the walls and/or woodwork.
