Briefly describe the nature and extent of work: The Yup Coffee Roasting, Inc. building is located in an industrial zone in the Florence section of Northampton Massachusetts, off-street and behind a large former mill building.Within that zone a portion of a building, 10%of the gross floor area,may be used for retailing products produced in the facility. In this case, Yup Coffee Co. is allowed 140 square feet of retail space. Given the size limitation, we expect the retail portion of the business to be relatively small, with "grab and go",customers,consisting mainly of the employees of the two large nearby buildings. One building is directly adjacent to the Yup facility and another is across a street.To make the retail area accessible,will be cuttinga code-compliant ramp into an existing wood- foisted "deck".This deck is built on a concrete loading dock,which slopes upwards, and away, from the entry door. We are also considering having seasonal tables under an overhang, outside the building.There is no room inside for tables. If we provide tables for retail customers we must provide public restroom facilities,which would not be required without the addition of tables.We have enough space in the building for one,single use bathroom,which,by code, limits the number of seats to 18.1f we provide a public restroom it must,of course,be accessible. 9. Reason's why compliance is impractical: Yup Coffee Co,is requesting a variance for Section 30.7.1, Figured, the required layout for a single use Water Closet. Given the constrictions of the existing conditions(see floor plan)—specifically the location of the existing exterior door, the existing raised concrete and wooden platforms,and the 8' wide windows—conforming to the exact layout of Figure d is extremely impractical. ef To create the prescribed 72"x 90"Water Closet rectangle would incur significant additional expense relative to the cost of the project. To comply, the door would have to be moved 2' to the south. Doing so would, because the concrete loading dock that's beneath the wood deck slopes upwards to the south, require the demolition of significant portion (approximately 22%) of this concrete loading dock.Additional costs would be incurred to remove the door, reframe the opening(also requiring some demolition of concrete) and reinstalling the door. Also, the prescribed plan would require the door opening to be at the east end of the WC, lengthening the travel path to the WC, infringing on non-retail, roaster space. The proposed plan fits well in the existing space, enhances the traffic pattern inside the building and conforms to all the space and clearance requirements as listed in sections 6.3 (Figure 6d), 26.6.3 (Figure 26d.latch side approach and Figure 26e., front approach,and 30.5,and 30.7.1 Figure 30d. The clear space around the sink is a more than 30"wide and more than 48"to the front of the toilet. The center of the toilet is 18" from the wall and there is 42"of space from the center of the toilet to the wall. The bathroom door will have a closer,as will the front door, which will not have a latch. We are also requesting a variance for Section 26.6.4.Although there is a jog in the door wall,the jog is 6"deep,which appears to comply with intent of Section 26.6.2. A case can be made that this arrangement—a jog that puts a 6" recess on only one side—is actually easier to access than a door that is fully recessed 6"on both sides. Although the door swing could be reversed to meet the code that would make the bathroom more difficult to access for everyone and actually would put the travel path into what is intended to be private space not open to the public.Adding an automatic door closer would add significant expense relative to the overall cost of the project. Additionally,Yup Coffee has filed an Affidavit with this Variance Application, stating that the entire portion of the building that is open to the public will be accessible. a.
