DECISION OF
NORTHAMPTON ZONING BOARD OF APPEALS
At a meeting held onailletella the Zoning Board of
Appeals of the City of Northampton voted unanimously to grant
the request of Quickbeam Realty Trust for a Special Permit
under the Provisions of Sections 7.4 and 7. 2(15) of the
Ordinance, to allow the placement of five canopy signs and
five wall signs on the south side of a building located at
492 Pleasant Street. Present and voting were Chairman Robert
C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr.
The Findings were as follows:
The requested uses are allowed by Special Permit under the
conditions of Sections 7. 2(15) and 7. 4 of the Northampton
Zoning Ordinance.
The requested use bears a positive relationship to the public
convenience, in that the signs properly identify several
places of business.
The requested use will have no bearing on traffic, pedestrian
safety, nor will it overload any municipal systems.
The requested use will not unduly impair the integrity or
character of the district, and is in harmony with the general
purpose and intent of the ordinance.

The Northampton Zoning Board of Appeals met at 8 :05 p. m. on
Wednesday, September 6, 1989 in Council Chambers, Wallace J.
Puchaiski Municipal Building, to conduct a Public Hearing on the
Application of Quickbeam Realty Trust for a special Permit under
the Provisions of Section 7 .4 of the Northampton Zoning Ordinance
for the purpose of allowing five canopy signs and five wall signs
on the south side of a building located at 492 Pleasant St.
present and voting were Chairman Robert C. Buscher, Dr. Peter
Laband, and M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, Section 7.4 and Section 7.2( 15) and a memorandum
from the Planning Board. Matthew M. Pitoniak, Trustee gave a brief
history of events leading up to this evening. He said that, some
time ago, the Building Inspector gave him permits for all the
signs, and he had them erected. Later, the Building Inspector told
him the permits had been issued in error, and the signs must come
down. The wall signs were taken down, but the canopy signs remain
in place. He stresses, "We are not here after the fact. We went
through the process!" He addressed the Section 10.10 criteria one
by one, and said this project meets all of them. He pointed out
that Section 7 .2( 15 ) gives the Board the authority to approve more
signage than is allowed normally. He showed the Board photos of
the signs.
Dr. Laband offered, "I think you're being put upon. Fitzwilly's
and Bananarama have canopy signs without our blessing. We should
give you a gold star. I would be very hard put to say no to these
signs. " The Chair called for proponents, and Mary Ford said she
thought canopy signs appropriate on Pleasant St. , and Moira
Callahan said, "They are cheerful and good-looking." There was no
one in opposition, so Dr. Laband moved the Public Hearing be
closed. Mr. Weil seconded, and the motion passed unanimously.
Dr. Laband found that the requested use is listed, in Sections 7.4
and 7 .2 ( 15) as being allowed by Special Permit. He felt the signs
bore a positive relationship to the public convenience in that they
properly identify several places of business. There are no
concerns with traffic, pedestrian safety, or municipal systems.
He found the signs in harmony with the district, and tastefully
done. He moved to approve the Special Permit. Both Ch. Buscher
and Mr. Weil concurred with Dr. Laband. Mr. Weil seconded the
motion, which passed unanimously.
Also present, in addition to those mentioned, was R. J. Pascucci,
Board Secretary.

paragraph) provides that no variance or special permit, or any
extension, modification or renewal thereof, shall take effect until
a copy of the decision bearing the certification of the City Clerk
that twenty days have elapsed after the decision has been filed in
the Office of the City Clerk and no appeal has been filed or that,
if such appeal has been filed, that it has been dismissed or
denied, is recorded in the Registry of Deeds for the county and
district in which the land is located and indexed in the grantor
index under the name of the owner of record or is recorded and
noted on the owner' s certificate of title. The fee for such
recording or registering shall be paid by the owner or applicant.
