Variation from the requirements of Section 6.2 (Maximum Floor Area Ratio) of C. 44 of the City Ordinances of the City of Northampton. STATEMENT FILED IN CONNECTION WITH PETITION FOR VARIANCES BY NORTHAMPTON PINE REST, INC. "B" ATTACHMENT TO NO. 6 Petitioner has been notified by Federal and State Authorities that the building in which it operates a nursing home no longer complies with appli- cable safety codes. The anticipated expenditure of a disproportionately large sum of money and the loss of licensed-bed capacity render the further renova- tion of the existing structure as completely unfeasible and unsatisfactory. Therefore, in order to continue operating the nursing home at all, and at the present quality and level of service, petitioner has designed this proposed facility to continue and improve its business and provide the area with a quality long-term health care facility. The reasons for granting the variances sought are due to the conditions especially affecting such structures, but not affecting the zoning district in general. In light of these conditions, the literal enforcement of the Zoning ordinance would involve substantial hardship to the petitioner. Furthermore, relief can be granted without substantial detriment to the public good or sub- stantial derogation from the purpose of the ordinance. The hardships upon which the variances sought are being predicated are as follows: The structure on the parcel is substantially unsuitable for any use allowed under UR-B without extensive and expensive modifications. The variances being requested are in conjunction with a use that is allowable under special permit • Page 2 Continuation of Attachment to No. 6 - "B" Re: Northampton Pine Rest, Inc. in the UR-B zone. At the same time, petitioner is faced with external pressures (i.e. Other than Zoning) , by State and Federal agencies, including the Department of Health, Education and Welfare, the Social Security Adminis- tration and Massachusetts Department of Public Health, to correct by repair or otherwise certain deficiencies in the existing structures. If petitioner fails to make the repairs and modificiations, it will lose its license for the opera- tion of a nursing home. These changes cannot be made to the existing struc- ture under the provisions of the Zoning Ordinance. However, without these changes, the structure will have no marketability under its existing non-conforming use and, as previously noted, is not readily adaptable to any allowed use. Thus its marketability in its present state is reduced substantially by all of these factors; and to require the petitioner to comply or to prohibit the proposed changes would, under these circumstances, cause it to bear an unjust and dis- proportionate share of the price of community welfare. By making it possible for the changes to be made, the petitioner will be left in a position to preserve the marketability of its property. Furthermore, it would be a hardship if petitioner was unable to use its property in the most profitable way by not being allowed to expand the structure for the purposes of normal and reasonable business expansion. Inasmuch as zoning is intricately concerned with property values, it would be hard to imagine that any zoning ordinance was intended to strangle an existing business by com- pletely negating any growth, anticipated or otherwise. Therefore, the desirable relief sought will in no way substantially dero- gate from the intent and purpose of the zoning laws. Also the variances are being sought not from usage but rather from building requirements, such that the derogation is of minimal effect as far as the Floor Area Ratio and Open Space requirements are concerned, since there will be no appreciable change from those presently existing on the parcel. •Page 3 Continuation of Attachment to No. 6 - "B" Re: Northampton Pine Rest, Inc. As for the parking requirements, there is ample basis for the premise that, as it stands, the zoning ordinance does not accurately reflect the intent of that particular provision. The requirement of one space per bed at design capacity is unrealistic from a practical standpoint for several reasons: 1. The State requires only one space per four beds for nursing homes. 2. The Northampton Planning Board has been contemplating the downward revision of this parking requirement (i.e. 1:2 or 3 rather than 1:1) . 3. The use of the parking lots at area nursing homes does not approach that which would merit a one space / one bed ratio even at peak use hours. In light of the foregoing, the fact that the zoning ordinance already provides for a 20% variation where it is deemed appropriate (Section 810-13) , and the fact that the proposal provides for parking at a 1:1.54 ratio, the granting of a variance would neither substantially derogate from the intent nor be a substantial detriment to the public good.
