HARDSHIP - DEFI DF 4U:V39:,iNSrECrlONS CONDITION OF APPROVAL. i"iY y..''-JN Pk 01060 FINDINGS: The Zoning Board of Appeals granted the Special Permit for more than one wall sign on an establishment for the purposes of identifying a new bar space associated with Fitzwilty's restaurant The Board based the approval on the information included in the application. The Board granted the request for additional signage upon determining that: A. The requested use protects adjoining premises against seriously detrimental uses. The additional 26 square foot sign would be located over the storefront that was previously occupied by another tenant, where a wall sign was removed. B. The requested use will not change safety of vehicular and pedestrian movement within the site and on adjacent streets, nor affect traffic on the streets and roads in the area. C. The requested use will not affect the relationship ofsWctures and open spaces to the natural landscape, existing buildings and other community assets in the area; D. The requested use will not overload, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools;and E. The requested use meets the special regulations set forth in section 7.2(13)of the Zoning Ordinance.Specifically, 1.Signs are located only where they are otherwise permitted in the district;and 2. The Board of Appeals determined that the architecture of the building, the location of the building or the land or nature of the use being made of the building or land is such that additional signs or signs of a larger sin would not detract from the character of the neighborhood and should be permitted in the public interest 3. The Board of Appeals allowed,as proposed by the applicant a 26 square foot sign. F. The requested use bears a positive relationship to the public convenience or welfare. The use will not unduly impair the integrity of character of the district or adjoining zones, nor be detrimental to the health, morals, or general welfare. The use will be in harmony with the general purpose and intent of the Ordinance;and G. The requested use will not adversely effect the City's planning objectives,as defined in City master or study plans adopted under M.G.L. Chapter 41,Section 81-C and D. '2 ,OS 1 i L a August 17,2004 ^`1s Anthony Patillo,Building Commissioner City of Northampton Building Department 212 Main Street,RM 100,MA Northampton,MA 01060 RE: New electric service and alarm system for 21-31 Main Street Dear Mr.Patillo, I am writing to you at the request of Mr.Mathew Pitoniak to set out our plans for the new electric service and fire alarm systems for the `Masonic'building at 21-31 Main Street in Northampton. This building is a Condominium Association with two owners.Nohominium Realty Trust with Matt Pitoniak as Trustee owns three first floor units that include the Fitzwilly's restaurant and the recently closed pizza restaurant. Chamisa Corporation with Doug Kohl as principal owns the balance of the building. Over the passed month, I have been working with engineers from Western Mass Electric, our electrician Rich Chenevert and design engineers at General Electric to develop a plan to upgrade the electric service at this building and to abandon the second electric service that presently supplies the LaVeracruzana space, the new restaurant space and the main building boiler. We will be nursing a new underground service from the pad mount transformer located behind the Calvin Theatre to the existing switchgear that is in the basement of the Fitzwilly's restaurant. The new underground conductors will be sized to carry 1000 Amps, 3 phase current, which is the rated capacity of the main breaker in the existing switchgear. The LaVeracruzana space, the building boiler and a new 200 amp panel for the Hakkasan restaurant will all be moved to the existing switch gear. We have placed an order with General Electric, the makers of the existing building switchgear, for the hardware that is needed to connect the new underground lines to this gear. The GE factory is rushing production of this hardware and I hope to have the gear on site within two weeks. Before the gear arrives, our electrician will be preparing for the service upgrade by installing underground conduits and new meter sockets inside the switchgear room. Finally, I have scheduled a meeting for next Monday morning with George Fournier,Rich Chenevert,Buster Symanski,(Fitzwilly's electrician)and Peter Normandin from Mass Electric,to review all of the details of the new electric service installation. We are also making progress on the new building fire alarm system. We have retained Industrial Residential Service to design and install a comprehensive fire alarm system for all of the first floor restaurant spaces and the mixed use/office spaces on the upper floors. This system will include a new addressable main panel that will be located in the main entrance to 25 Main Street and new smoke detectors, notification units and power supplies that will be located throughout the building. Industrial Residential Security has a complete set of plans for the entire building and is currently preparing permit application documents for this new alarm system. By mid next week,I plan to meet with representatives of Industrial Residential Security and Fire Chief Brian Duggan to review our permit application and the plans for the new alarm system. th We are eager to get both of these building improvements installed and operational. While there are several parts to both of these projects that are outside of our control,I want to assure you that we are doing all that we can to expedite the completion of this work.
