APPLICATION FOR VARIANCF In accordance with M.G.L.,Chapter 22,Section 135, I hereby apply for modification of or substitution for the rues and regulations of the Architectural Access Board as they apply to the facility described below on the grounds that literal compliance with the Boards regulations is impracticable in my case. 1. State the name and address of the owner of the building/facility: Nohomirium Realty Trust,a/k/a Downtown Associates 125A Pleasant Sheet Northampton,MA 01080 Tel:413-586-5364 2. State the name and address or other identification of the building/facility: 21 and 23 Main Street,Northampton,MA The Masonic Block',a/k/a the Fttwillys building 3. Describe the facility:(Number of floors, type of functions, use, etc.) This space is in a turn of the century 5 story building on Main Street in downtown Northampton. The restaurant Fitawilly's is a first floor space accessed from the sidewalk. Fitzwilys desires to expand into an adjacent first floor space which is currently occupied by a pizza shop. The two spaces are commercial condominiums owned by the ame owner. 4. Total quare footage of the bulling: Perfloor 10,311 a.total square footage of tenant space(if applicable): Ftzwilly's space 4.289 quare feet Expansion space 1,030 square feet Total 5,319 square feet 5. Check the work performed or to be performed: New Construction Addition xxx Reconstruction, remodeling, alteration_Change of Use B. Briefly describe the extent and nature of the work performed or to be performed:(Use additional sheets If necessary). Flzwillys Restaurant,a downtown Northampton landmark that opened in 1974,would like to expand into an adjacent space and add an additional bar and additional seating for the restaurant. There is only one area for a connector door into the expansion space. That door will connect the spaces and create an accessible rade between the spaces. The Fwdlly's toilets, including its accessible unsex toilet, will then be accessible from the expansion space. The current accessible entry into both FXtwilys and the building's elevator has been proposed as the accessible entry into the expansion space. In a decision by the Architectural Access Board on July 13,2004,a variance was granted for the use of this entry as the accessiNe entry for the expansion space. The referenced variance required Nohominium Realty Trust to make application for a second variance to allow one handrail on one side of the improved ramp proposed for access into FRwilly's and the elevator of the building. Due to the excessive width of the lobby, and the location of the stair to the upper floors, it Is not feasible to install a second handrail and hence the purpose of this request for a variance. As part of the redesigned accessthle entry, the applicants will install auto openers on both the exterior door to the lobby and the lobby entrance to Fitawilly'a and will install signage at the inaccessible doors directing people to the accessible entrance. ]. State each section of the Architectural Access Boards regulations for wtddh a variance s being requested: ]a.Check appropriate regulations:_1996 Regulations 1982 Regulations xxx 2002 Regulations SECTION NUMBER LOCATION OR DESCRIPTION Section 25.1 General(entrances) 8. Is the building historically significant? xxx yes no. If no,go to number 9. 8a. If yes, check one of the following and indicatedate of listing: National Historic Landmark Listed Individually on the National Register of Historic Places xxxx Located in registered historic district Listed In the State Register of Historic Places Eligible for listing Bb. If you checked any of the above and your variance request is based upon the historical significance of the building, you must provide a letter of determination from the Massachusetts Historical Commission, 80 Boylston Street, Boston, MA 02116. 9. For each variance requested, state in detail the reasons why compliance with the Board's regulation is impracticable.State the necessary cost of the work required to achieve compliance with the regulations.PLEASE NOTE THAT YOU SHOULD SUBMIT WRITTEN COST ESTIMATES AS WELL AS PLANS JUSTIFYING THE COST OF COMPLIANCE.Use additional sheets if necessary. We are requesting a variance in order to Install one handrail at the upgraded accessible entrance to both Fdxwilly's and the elevator of the baking. Essentially, the installation of a second handrail running up the middle of the lobby would block access to the stairwell of the main building and,as well, block access to the elevator from the other direction. The installation of a second handrail on the wall adjacent to the stair would not help disabled people trying to aces the elevator or the accessible entry to Fltzwilly's. 10.
