In accordance with M.G.L.,Chapter 22,Section 135, I hereby apply for modification of or substitution for the rues and
regulations of the Architectural Access Board as they apply to the facility described below on the grounds that literal
compliance with the Boards regulations is impracticable in my case.

This space is in a turn of the century 5 story building on Main Street in downtown Northampton. The restaurant
Fitawilly's is a first floor space accessed from the sidewalk. Fitzwilys desires to expand into an adjacent first floor
space which is currently occupied by a pizza shop. The two spaces are commercial condominiums owned by the
ame owner.

B. Briefly describe the extent and nature of the work performed or to be performed:(Use additional sheets If necessary).
Flzwillys Restaurant,a downtown Northampton landmark that opened in 1974,would like to expand into an adjacent
space and add an additional bar and additional seating for the restaurant. There is only one area for a connector
door into the expansion space. That door will connect the spaces and create an accessible rade between the
spaces. The Fwdlly's toilets,including its accessible unsex toilet,will then be accessible from the expansion
space. The current accessible entry into both FXtwilys and the building's elevator has been proposed as the
accessible entry into the expansion space. In a decision by the Architectural Access Board on July 13,2004,a
variance was granted for the use of this entry as the accessiNe entry for the expansion space.
The referenced variance required Nohominium Realty Trust to make application for a second variance to allow
one handrail on one side of the improved ramp proposed for access into FRwilly's and the elevator of the
building. Due to the excessive width of the lobby,and the location of the stair to the upper floors,
it Is not feasible to install a second handrail and hence the purpose of this request for a variance.
As part of the redesigned accessthle entry,the applicants will install auto openers on both the exterior door to the
lobby and the lobby entrance to Fitawilly'a and will install signage at the inaccessible doors directing people to
the accessible entrance.

We are requesting a variance in order to Install one handrail at the upgraded accessible entrance to both
Fdxwilly's and the elevator of the baking. Essentially,the installation of a second handrail running up the
middle of the lobby would block access to the stairwell of the main building and,as well,block access to
the elevator from the other direction.The installation of a second handrail on the wall adjacent to the
stair would not help disabled people trying to aces the elevator or the accessible entry to Fltzwilly's.
