Melnik Jr.,Esq. patmelnikjr@verizon.net August 29, 2007 Deirdre Cabral, Section Chief Drinking Water and Municipal Services — Resource Protection Department of Environmental Protection Western Regional Office J 436 Dwight Street Springfield, Ma 01103 Re: Beaver Brook Estates Dear Ms. Cabral: In response to your July 31, 2007 letter, enclosed please find letter from the Northampton Board of Assessors. Based upon your correspondence to me we have revised the building plans to the two buildings being constructed so that all units will be constructed as two bedroom units and no unit will be constructed as a three bedroom unit. For each of the units that had three bedrooms one of the bedroom is going to have the closet area eliminated. The builder has been instructed to remove the closet doors and turn the closet areas into book shelf spaces. Pursuant to your correspondence to me see the letter from the Board of Assessors of the City of Northampton indicating that all the units will be assessed as two bedroom and no unit will be assessed as a three bedroom unit. The second building to be built, when built, will provide that each of the units will be built as two bedroom units only unless we change the Master Deed and plans and have agreement from your office as outlined in your August 27, 2007 letter to me. If we -2- have two wells, with one well separately servicing each building without interference from the condominium association, as outlined by your office in your August 27 letter, I will prepare an amended Master Deed for your review and approval. The Condominium documents requiring that no unit be utilized by more than four persons and that the bedrooms be utilized as two bedroom units are already recorded in the Hampshire County Registry of Deeds. I believe this now complies with the request of your July 3 Y letter. Please advise the Building Inspector that, based upon the change of the building plans and the determination of the Northampton Assessor to assess the units only as two bedroom units, that the well servicing the units is not a public water system and the Building Inspector may issue a Building Permit for the second building upon request, provided that the second building is constructed as two bedroom units only. I appreciate your cooperation in processing this request. If you need any other information please contact me. Sine, • y, If . . // atrick J. Melnik PJM/jlp 0807let(48-49) cc.
