Tew 11 Building Inspector EJT/ld DECISION OF THE NORTHAMPTON BOARD OF APPEALS / " ' - 37 The Northampton Board of Appeals met on June 20, 1983, and unanimously voted to deny the petition of Thomas Tuperkeizsas to use his property at 311 Haydenville Road for the sale and repair of used cars. Present and voting were Chairman Robert C. Buscher, William Brandt and Dr. Peter Laband. Based on evidence presented to the Board and evidence received by a visit by each of the Board members to the site at issue, the following findings in regard to the variance request were made: 1 . While there are conditions affecting this parcel which create a hardship for the petitioner, specifically, its failure to pass a percolation test, relief may not be granted without substantially derogating from the intent of the Zoning Ordinance due to the fact that the proposed use, notwithstanding the small size of the operation, would be incompatible with this Suburban Residence Zone. 2. A substantial hardship was not proven by the petitioner. 3. Failure to pass a percolation test was not unique to this particular parcel , but rather affected several other lots in the area. 4. The applicant-petitioner was unable to show that the property cannot be used for any other purpose. The Northampton Board of Appeals voted unanimously to deny the petition of Thomas Tuperkeizsas. Present were Chairman Robert C. Buscher, Peter Laband and Kathleen Sheehan. The Chairman read the public hearing notice as it was published in the Daily Hampshire Gazette on June 15th and 22nd, 1984. The Chairman explained that this hearing had originally been scheduled for Wednesday, May 30, 1984, however, because of the flood conditions on that date a Board member was unable to attend; thus the necessary quorum could not be met. The hearing was rescheduled. The Chairman read a letter from Ms. Tuperkeizsis dated June 21, 1984 and received on June 27, 3984 requesting an extension of time because she had a previously scheduled dance event which could not be canceled or postponed. Dr. Laband suggested the public hearing continue without Ms. Tuperkeizsis or a representative present. Chm. Buscher suggested that because the Board originally postponed the hearing and because of the advanced scheduling required by the event which prevented her from attending, the petitioner be allowed to withdraw without prejudice and resubmit her application with accompanying fees. It was moved, seconded and unanimously approved to allow the petitioner to withdraw without prejudice and resubmit her application with accompanying fees. Present were: Acting Chairman William b- .9, Peter Laband, Kathleen Sheehan. The Acting Chairman read the public notice as it appeared in the Daily Hamp.t, Gazette on September 5th and 12th, 1984, and criteria for a special permit. He al - read a letter from P. MCErlain, Board of Health, who inspected the septic system a, !nand it could adequately handle any increased flow resulting from the requested -.activity. He then read a memo dated 5-25-84 from L. Smith, Planner, on behalf of the Northampton Planning Board recommending in favor of the petition with conditions comments from Mr. Smith and the definition of a home service occupation. He advist those present of their right to appeal . Gloria Tuperkeizsis briefly explained the circumstances leading to the resubmis -.e ni her application. She stated that she bought her daughter's dance business and has been renting space, but wishes to construct a studio adjacent to her home because e`. the problems incurred in renting, and added that she would be catering to Florence, Leeds and HaydenviLle clientele. She stated that her daughter would be teaching th- classes and has no problem with meeting size and time restrictions suggested by the Planning Board. She presented a design to the Board explaining that there is ample space for the building as her home is situated on eight acres, and the building wou;r.. constructed straight back from the existing structure, far from the property line ar-i not drastically changing the character of the existing structure. Responding to an inquiry from Mr. Brandt, she stated that 12 cars could comfortably be parked on th existing lot . Mrs. Tuperkeizsis stated that she presently has a total of 28 students, with n. more than six students/class, attending on Wednesdays from 3:00 - 6:30 p.m. and Thursdays from 3:00 to 7 :00 p.m. When asked by Dr. Laband about her reaction to cla; - limitation, Mrs . Tuperkeizsis replied that she did not intend to have more than 10-12 students/class as she believes in small classes. Responding to an inquiry from Ms. 5h , itgarding any programs being held in the proposed studio, Mrs. Tuperkeizsis stated tbs . programs would be held in rented halls or schools. Mrs. Tuperkeizsis expressed her wishes for a larger studio than the dimensions submitted on her application of 24'x 24' . After some discussion, the Board moved, seconded and voted unanimously to allow Mrs. Tuperkeizsis to withdraw without prejw and reapply without the mandatory two-year waiting period, but with attending fees, ro request the desired larger dimensions. Mrs. Tuperkeizsis agreed to withdraw. P. Laband suggested she may wish to obtain an attorney. ft was moved, seconded and voted unanimously to adjourn the public hearing at 9 1 Present in addition to those mentioned were J. Present and voting were: Chairman Robert Buscher, ' Peter Laband and Charles Maguire. The findings were as follows: R. Buscher, referring to Section 10.10, found a home service occu- r. d potion is allowed by special permit in a SR zone, however, after reading the f definition of Home Service Occupation in the Zoning Ordinance, found that Mrs. Tuperkeizsis does not meet the conditions listed, as her daughter, who does not reside at the premises, is the principal teacher, with Mrs. Tuper- keizsis managing the business end. He also read the definition of Home Occupation and also felt those conditions were not met. Re found the requested use bears a positive relationship to the public convenience, as r, there is demand for teaching dance, but that Mrs. Tuperkeizsis stated that she does have an alternative space for the dance classes; that the requested use would not create any undue traffic congestion or impair pedestrian 1' safety, as the requested use would not overload municipal systems; and that the proposed addition would make the dwelling more than a home, operating as a commercial enterprise and is not in keeping with the Ordinance. P. Laband found the applicant does not fall under the definition of Rome Service Occupation; that any restrictions for hours of operation would be unenforceable; and the requested use would not be in harmony with the I! intent of the Ordinance by placing a commercial. business in a residential zone. C. Maguire concurred with the other Board members finding the requested use not listed and inconsistent with the residential character of the immediate neighborhood, and undermining the purposes of the zoning provision, ji Robert C.
