Box 210 Northampton, MA 01061-0210 January 6, 2017 re: Westhampton Road Parcel 42-131 Attorney McLaughlin, I have reviewed your request for a determination as to whether the parcel of land on Westhampton Road in Northampton, identified on city maps as 42-131, is a legal building lot. Based on your information, the lot was created prior to the 1975 Northampton zoning ordinance and has been held in separate ownership since 1975. I have determined that the parcel is a legal building lot. It is a nonconforming lot and is protected by Northampton Zoning chapter 350, section 9.4: § 350-9.4 Single-lot exemption for single- and two-family use. Any increase in area, frontage, width, yard or depth requirements of this chapter shall not apply to a vacant lot for single- and two-family residential use, which: A. Has at least 5,000 square feet of area and 50 feet of frontage; and B. Is in an area zoned for single- or two-family use (A special permit must be obtained if one is required.); and C. Conformed to existing zoning requirements when the lot was legally created, if any; and D. Is in separate ownership prior to the City Council vote which made the lot nonconforming, and has maintained its separate identity. Any structure on the lot does need to meet current setback, lot coverage and height requirements for the WSP zoning district. I've sent a copy of those requirements by email.
