The MSN school has to go through public dding process foo some of their work (like extending the sewer line
from Crosby up Bates). They have balke at taking on that process. So could you please write on the building
permit that prior to co, they will need to nstruct all reguuired utilityhedestrian infrastructura that is in the_publi
way in accordance with the Citssi@ndards for public bidding+(since they need the sewer for the building they
are going to have to build the line in Bates anyway so it is likely they will need to do this well before co)

Hi Jordi-
The permit to add fill between the retaining walls is valid until June 2017. The three wetland flags shown on
that plan can be considered still accurate. Any work outside the roo foot buffer along Bates Street would
generally not require review,although there are some circumstances in which projects outside the buffer could
affect wetlands,but that is pretty rare. My new work involving wetlands or buffer zones not shown on that plan
would require a new review.

From our conversation it is my understanding that:
• The permit for the work (limited fill) described in the Determination of Applicability is valid
till June of 2017.
• That for both the Conservation Commission and Northampton Planning Department Site
Plan Review purposes the wet lands boundaries indicated in the Montessori School of
Northampton's 2010 RFD application should be referenced/shown on their Site Plan Review
submission and can be considered unchanged.
• In applying for Site Plan Review the Montessori School of Northampton would need to
present no further determination regarding the location of wetlands or the impact of a
building project on the wetlands, as long as a proposed project would be a reasonable
distance* to the east of the 100 ft buffer utilizing the Bates Street frontage.
If I misconstrued anything please advise. Otherwise, to the extent I have it right, I am
hopeful your letter will reflect the essence of the above.

measurement to avoid uncertainty? The northern and eastern most projections of the
retaining wall are already 10 feet outside the 100' buffer. The currently considered project
would be east of--further from the 100' buffer than--the retaining wall.
