In granting the Variance to reduce a rear yard setback from 20'to 4`in order to convert the existing use from—a g'aleld it single family
dwelling,the Zoning Board made the following findings in accordance with state statute:
I. There were unique circumstances that affect this property or structures relative to others within the abutting UPS district with regard
shape.This parcel abuts I-91 and was reshaped from its original rectangle to a triangular shape as a result of land takings for the 1-91
construction 50+years ago.
2.A hardship would be created without the variance No other use would legally be allowed on the lot The parcel coincidentally is
owned by the owner across the street and would only be allowed to continue as a use in relation to an abutting use if the owner so chose
for the duration that the owner remained on Marshall Street.
I There is no other viable use of the property except for continued use as a garage for the non contiguous abutter. It is a separate
legally deeded parcel not in contiguous ownership with any other parcel. It could potentially be combined with an adjoining parcel if the
abutter wished to buy it No option has come forward.
4. The hardship was not self-created Mass Highway took the portion of the properly that would have enabled the structure to conform
to current zoning.
5 The Board determined that relief could be granted without detriment to public good. There were no abutters who came to the hearing.
The non-conformity requested relates to the rear setback. The impact would only be felt on the rear.which is the 1-91 corridor.
6. This is the least possible relief. All other dimensional requriemenfs for a single family home are being met. The rear setback
dimension is the only issue at hand.
