31B-145 (18) DECISION OF THE l / II NORTHAMPTON BOARD OF APPEALS 18 ' /y��l b Ii I At the Northampton Board of Appeals meeting held on June 20, 1983 , the II Board voted unanimously to deny the special permit request of B & F Enterprises ! to use a cellar of an apartment building located at 114 King Street for office ! space. IPresent and voting were Chairman Robert C. Buscher, William Brandt and Marianne Zurn. Based upon evidence presented to the Board, the Board made the following findings in regard to the special permit: 1 . Mr. Brandt found that the use is listed in the Table of Use Regula- h tions; that the proposed use does not bear a positive relationship to the public welfare because of the lack of off-street parking. He noted that, with five dwelling units now occupying the site, ten parking spaces are required but only six would be provided to accom- modate the apartments and the office space. He also found that no turnaround space would be available and cars would be forced to back out onto King Street. 2. The Chairman, referring to Section 9.3 which allows for extension or alteration of a pre-existing, nonconforming use if that extension or 1! alteration would not be more detrimental than the present use, found 1 that the proposal would be more detrimental_because of the lack of parking; that, even though the petitioners were planning to use spaces jI on neighboring parcels, one of the proposed locations is in a resi- ! dential zone and renting out parking spaces would, in effect, be using the property for commercial purposes; that King Street is already too congested and is not an appropriate location for the proposed office; Iand that using space below ground for an office would be in violation .I of the Massachusetts Building Code. j 3.
