A small portion of the property is located in the SC (Special Conservancy) district. This part of the property (approximately 54,000 square feet on the eastern edge; see attached map) includes a single multi-family building. Multi-family dwellings are a permitted use in the URC district. The SC district regulations do not allow multi-family buildings. The existing building predates the changes to the zoning maps and is therefore legally non-conforming. The adjoining property to the north is also zoned URC; to the east, SC, and to the south and west, URB. There are no zoning violations at that location. There are no building code violations outstanding. The signage meets the current zoning regulations. The original project approval predates our current zoning. A copy of that approval is not available but may be recorded at the Hampshire Registry of Deeds. The current zoning regulations (copies attached) allow rebuilding the existing structures in the URC district as of right. Rebuilding the structure in the SC district would require Planning Board site plan approval for that specific structure but not for the rest of the complex. Adding additional units or structures would require a special permit and site plan review by the Planning Board. The buildings on the property comply with the requirements of the 8th edition Massachusetts State Building Code, 780 CMR for an existing building. The property is not in a flood zone. The buildings are R-3 use group (townhouses), and are not subject to periodic inspections. The buildings were constructed prior to the date of the first state building code and we do not have certificates of occupancy in our files.
