Standard Permit Amendment Conditions: 1. All clearing, grading, drainage, construction, and development shall be conducted in strict accordance with the following plans and information submitted with the application and as amended by any conditions attached to this permit. a. Site Plan for Light Industrial Development at The Village at Hospital Hill, Northampton, MA, Sheets 1-10, dated 6/21/2007, stamped by Robert Eric Mellstrom, P.E., Stantec Consulting Services, Inc.. b. Letter to Northampton Department of Public Works re. Stormwater Permit Amendment, The Village at Hospital Hill South Campus Lot 12A, from Richard Henderson, Executive Vice President, MassDevelopment, dated July 24, 2007. c. Letter to Northampton Department of Public Works re. Stormwater Permit, The Village at Hospital Hill South Campus Lot 12A, from Richard Henderson, Executive Vice President, MassDevelopment, dated July 17, 2007. d. Drainage Plan and Profile, Sheet 5A, South Campus Detention Pond 5, dated 7/2007, prepared by Tighe and Bond Consulting Engineers. Specific Permit Amendment Conditions: 1. This project will be required to submit one or more Notice of Intent(NOI) to the U.S. EPA for coverage under the NPDES Stormwater Construction General Permit. A copy of the final NOI and Stormwater Pollution Prevention Plan (SWPPP) shall be submitted to the Northampton DPW for approval prior to issuance of a building permit. 2. The original Permit specified the following condition (number 3): The drainage from the proposed 45,000 sq.ft. building on Lot 12A has not been discussed or included in the drainage calculations. The applicant will be required to submit a separate application for a Northampton Stormwater Management Permit for this building. The DPW has waived the requirement for a separate application for a Northampton Stormwater Management Permit for development in the 45,000 square foot (sf) area specified in Condition 3 of the Permit. The DPW shall require that within 60 days of issuance of this amendment to the Permit, the Applicant shall submit revised drainage calculations for the drainage areas flowing to Detention Basin 5 and to Earle Street showing no increase in the peak discharge to Drain Point 5 for all design storms and including the 45,000 sf area excluded in the original drainage calculations. These revised calculations will serve as the new baseline for review of future development proposals in drainage area 5. Based on the area specifications in the revised drainage calculations, a revised impervious area accounting table shall be completed and approved by the DPW and the applicant. The DPW has prepared a summary table for the South Campus based on the Revised Stormwater Management Calculations For South Campus Site Plan Submission, dated April 8,2005 by Beals and Thomas, Inc., pages P-34 to P-41 (see attached Table 1) as guidance for this table. The three tables attached to the Letter from MassDevelopment dated July 23, 2007 summarizing impervious areas by Lot do not appear to match the overall areas specified in the Revised Stormwater Management Calculations For South Campus Site Plan Submission. The DPW proposes the use of these area numbers as defined in Table 1 as the accurate reference point to track build out until the drainage calculations are revised to include the 45,000 sf area on Lot 12A as discussed above. 3. The operation and maintenance of the proposed 24" drain line across Lot 12B from MH- 55 to the Lot 12A property line must be clearly specified and included in drainage easements and the final Stormwater Operation, Maintenance, and Inspection Agreement (to be executed by the applicant as specified in Condition 8 of the Permit) as the responsibility of The Village at Hospital Hill Owners Association. 4. If the drainage structures proposed as part of the Site Plan Permit requested by VCA, Inc as specified in the Plans referenced above will be owned and maintained by the property owner of Lot 12A and not by the proposed owners association for The Village at Hospital Hill, then, prior to issuance of a Building Permit for development on Lot 12A, a separate Stormwater Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land served by the private stormwater management facility must be executed and recorded in the land records of the Registry of Deeds. This agreement shall _ be approved by the Northampton DPW and signed by the owner and the Mayor of Northampton.
