The Board grants the following waivers for this subdivision as authorized in the Rules and
Ragu|ationaGoverningSubdivisionChapter2S0G3:O2boochiaveaspeoificurbonneighborhood
character and allow for traffic-calming and connectivity to the existing neighborhoods which
overall results in a better project. The applicant has offered to provide a high quality pedestrian
connections throughout and as part of the overall master plan is providing 50% of the total units
as restricted tuconform to the affordability requirements in zoning.

temporary sidewalks in areas where sidewalks will have to be ripped up in the future, to

Conditions: `
1. Prior hoendorsement, all plan sheets shall boamended ounecessary tnincorporate
conditions herein.
2. Prior to endorsement of the definitive plans, a performance guarantee that conforms to
Northampton Subdivision Rules and Regulations §6:06 (4)must be posted. The
developer may place a covenant not to sell lots or, in lieu of placing a covenant, post a
Letter ofCredit inaccordance with the standards inthe Regulations. |faLetter ofCredit
is posted it must be in accordance with the Regulations, two lots must be covered by a
covenant not to sell, and must be adequate to cover the costs of the city completing the
project, at prevailing wages and with a.15% inflation factor, and the Letter may not be
reduced below$100,000 until the project is complete and has been accepted as such by
the Planning Board.
3. The existing escrow account for maintaining the stormwater system shall be increased to
$16,000.
4. The applicant shall amend previously recorded restrictive covenants to incorporate new
lots and street layout and otornnvvaharfacility references,
5. Full public access onbike paths should berecorded incovenants.
8. Hydrant spacing shall conform tonational fire standards.

7. A 10'wide pedestrian access sign at Olander Drive indicating entry to the trap rock gravel
public path within lot 13A should be installed prior to the marketing or construction of any
of the lots along Olander Drive .
8. Prior to pre-construction meeting, an NOI from Cons comm. With order of conditions
must be issued from Northampton Conservation Commission.
9. Headwall allowed as proposed or as modified in permit issued by Conservation
Commission.
10. As offered by the applicant, a CR or land dedication for the open space east of Olander
(except detention pond)shall be placed prior to issuance of the first certificate of
occupancy.
11. There shall be a four-way cross-walk at the intersection of Moser and Village Hill Rd.
12. Duratherm striping, comparable to the existing intersection on Village Hill Road, shall be
used throughout project for crosswalk striping.
13. All tree protection measures as shown in the detail sheet must be reviewed by the city tree warden,
or its designee, prior to any excavation.
