Planning Board Members present and voting were: Chairman
Andrew J. Crystal, Joseph Beauregard, Jody Blatt, Nancy Duseau,
Mark NeJame, and Daniel Yacuzzo.
In Granting the Amendment to the Special Permit, the Planning
Board found that the change from carports to garages does not
significantly change the Site Phan that was originally approved,
and that the criteria used in approving the original Special
Permits continues to apply.
The conditions imposed upon the original permit will remain in
effect with the Amended Special Permit.

Pursuant to Massachusetts General Laws (MGL) , Chapter 40A,
Section 11, no special Permit, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal
has been filed that it has been dismissed or denied, is recorded
in the Hampshire County registry of Deeds or Land Court, as
applicable and indexed under the name of the owner of record or
is -recorded and noted on the owner's certificate of title. The
fee 'for such recording or registering shall be paid by the owner
or applicant. It is the owner or applicant's responsibility to
pick up the certified decision from the City Clerk and record it
at the Registry of Deeds.
The Northampton Zoning Board of Appeals hereby certifies that an
Amendment to a Special Permit, has been Granted and that copies
of this decision and all plans referred to in it have been filed
with the Planning Board and the City Clerk.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the
Northampton City Clerk on the date below.
If anyone wishes to appeal this action, an appeal must be filed
pursuant to MGL Chapter 40A, Section 17, with the Hampshire
County Superior Court and notice of said appeal filed with the
City Clerk within twenty days (20) of the date of that this
decision was filed with the City Clerk.

Planning Board Meeting Minutes of March 23, 1995
At 8 : 55 P.M. Chair Crystal opened the Continuation of a Public
Hearing to amend a Special Permit granted to David McCutcheon for
(3) three-family units. Applicant requests to change proposed
carports to full garages at 48 Chapel Street.
David McCutcheon was present to discuss the application to amend a
Spedial Permit for shared parking. He said that the graded area on
the site had been changed, the width was increased from 40' wide to
50' wide. The reasons for the change are that there are nine
single-story condominiums set up for elderly residents. The first
plan called for carports but it was later decided that potential
residents would rather have full garages.
No one spoke in favor or in oppostion to the appliation.
Daniel Yacuzzo moved to close the Public Hearing. Mark NeJame
seconded the motion which passed unanimously 6: 0.

Nancy Duseau moved to approve the amendment to the Special Permit
and to accept the new site Plan untitled Wildwood Court Site Plan -
Chapel Street, Northampton, MA dated 6/27/94 with revisions
7/17/94, 8/30/94, 8/31/94, and 2/10/95 because the plan meets the
criteria for Special Permit approval. Jody Blatt seconded the
motion which passed unanimously 6:o.
