350-2.1 (Definitions, General)
SIGN Any permanent or temporary structure, device, blimp, letter, work, model, banner, pennant, insignia,
trade flag, or representation used as, or which is in the nature of, an advertisement, announcement, or
direction...
SIGN, GROUND A sign erected on or affixed to the land including any exterior sign not attached to a
building.
350-7.2 (General Regulations)
K. In any district one unlighted'temporary sign offering premises for sale or lease for each parcel in one
ownership shall be permitted, provided that it shall not exceed six square feet' in surface area; and it shall
be set back at least 10 feet from the street lot line or 1/2 of the building setback distance whichever is less.
M. The Board of Appeals may issue a special permit2 allowing more than the number of signs herein
permitted and/or for signs of a larger size or height than herein permitted...
350-7.3 (Signs permitted in any R district)
D. For approved residential subdivisions,townhouse, multifamily, and open space developments, one
ground sign identifying the development, provided that:
(1) It shall not exceed 12 square feet in surface areal, on any one side and shall not have more than
two sides.
(2) It shall be located on private property and set back at least 15 feet from any street lot line.
(3)The top of the sign shall not rise more than five feet'above the ground or sidewalk within five
feet of the sign.
F. No more than one sign shall be allowed for any one establishment in the R District.
350-7.7 ... however, that no proposed new nonaccessory sign shall be permitted in any district from and
after the adoption of this chapter...

z a cursory search of the Registry of Deeds did not find a Special Permit, which might allow for this sign.
3 the one allowed ground sign already exists at the Barrett Street frontage/access to the development.
4 the sign appears to be located on parcel 18C-110, a separately owned undeveloped parcel off-premises
from the townhouse development(lot 248-79). Thus, it may also constitute an illegal non-accessory sign.

Hi Louis,
We apologize for this. Our intent was not to violate any ordinance. We have taken our banner down. Our
intent was to study traffic to see if signage on Jackson Street would be beneficial. Should we elect to
advertise again on Jackson Street on a temporary or permanent basis we will follow the proper procedures
with the City.

Subject: Sign on Jackson Street
Dear Property Manager,
I have received a complaint about a new sign on Jackson Street advertising Hathaway Farms Townhomes
rentals.
That sign was erected without a permit. It also violates the Northampton sign ordinance and would not be
allowed without a special permit from the Zoning Board of Appeals.
Please contact me as soon as possible to discuss the situation. This violation must be corrected within one
week. If this has not been resolved by Thursday, February 25th I will take further action in accordance with the
zoning ordinance. These actions may include fines.
